AFFIDAVIT

I, DANIEL AKSAYA, of legal age, Filipino, married, a resident of

100 Barangay 27-C, Sta. Ana, Davao City, after having been duly sworn to
in accordance with law, hereby depose and state:

1. That I am the father of Asiong Aksaya;

2. That my son Asiong Aksaya was continuously with us in Davao

City from January 11, 2016 while his mother, Katarina Aksaya was
still in the hospital; on the day of her mother’s death on January 12,
2016 to the day she was buried on January 16, 2016; and until the last
day of the “pasiyam” on January 25, 2016;

3. That after my wife’s entombment, our family together with my son,

Asiong Aksaya, offered prayers every evening for nine days pursuant
to the “pasiyam” custom for the dead which begun from the date she
was buried on January 16, 2016 to January 25, 2016;

4. That on January 25, 2016, the “pasiyam” was concluded by a

formal meal with our family and friends;

5. That I and my son, Asiong Aksaya, had a photograph during the

formal meal of the “pasiyam” taken by his brother, James Aksaya;

6. That such photograph had never been edited nor tampered with by
any other means;

7. That I have kept such photograph to remind me of my dearly

departed wife and the gathering of our family to strongly go through
the process of grieving.

8. That I am executing this Affidavit to attest to the truthfulness of the

foregoing and for all legal intents and purposes.

IN WITNESS WHEREOF, I have hereunto set my hands this 6 th day
