Dear Richard:

This letter shall serve as the Application for Temporary Use by the undersigned, Steve
Wirrig, owner of the following real property requesting approval of a Temporary Use at the
property identified as 4866 U. S. Rt. 68, Yellow Springs, Ohio 45387 ("Property"). This request
is being made pursuant to Section 18.5 ofthe Township's Zoning Resolution and more specifically
the applicant is seeking a Special Exception and Conditional Use pursuant to Section 18.5.2
Temporary Structures and Uses.

As approved by the Miami Township Board of Zoning Appeals ("Miami Twp."), the
production billed as "Dave Chappelle and Friends: A Talk with Punchlines, A Socially Distanced
Affair," was the first comedy show of its kind conducted during the lockdown period and summer
of the COVID-19 pandemic. It continued with a limited run, during the spring of 2021. Held in
Miami Twp., the shows garnered national and international attention and were lauded as the
standard for safely conducting comedy and entertainment shows during the pandemic. Guests and
patrons from over 48 states traveled to attend the shows and most sought food, lodging, shopping
and recreation throughout the Township and region. Dubbed "Comedy in a Cornfield" and
"Summer Camp"by artists and media, the shows provided both the comedic and economic boosts
needed for the local community and the state, amid the challenges ofthe pandemic. A third-party
impact study concluded the run of shows generated over $10 million in direct economic relief to
local community members and business owners, as well as local and state tax revenues. A
welcome benefit under any circumstance, but especially so during an economic downturn.

Mr. Chappelle partnered with locally renowned Emmy and Academy Award Winning
documentarians, Steve Bognar and Julia Reichert, to produce a documentary highlighting a rural
community managing through the pandemic and the racial inequalities and tensions highlighted by
the murder of George Floyd. This effort was undertaken during the 2020-2021 shows. The
documentary has been viewed by over 500,000 people and will be premiered locally for a limited
multi-week series in Yellow Springs in the coming weeks. Mr. Chappelle and his team would like
the opportunity to conduct a limited run ofadditional comedy shows with guest artists this summer,
between the Memorial Day and Labor Day weekends(as detailed below), to further highlight the
success and national recognition of these events in OUR community. While Mr. Chappelle could
be conducting shows at mass theaters around the world; he would like to conduct this limited string
ofshows to further honor his community and continue the positive impacts to Miami Twp. and the
surrounding area through additional economic benefits and national attention. The specifics
related to the Temporary Use for the Property are set forth in more detail below.

The Applicant is requesting a Temporary Use for the Property to allow the existing Wirrig
Pavilion on the Property to be temporarily utilized in a limited seating capacity for the purpose of
hosting ticketed Dave Chappelle's comedy shows with guest artists to be conducted on not more
than four(4)days per week,up to a maximum oftwenty-four(24)shows in total to occur between,
and inclusive of, May 26, 2022 through September 5, 2022. Shows will not be held on Sundays,
except when there is a three-day holiday weekend, with the holiday resting on a Monday, being
the Sundays of May 29, July 3, and September 4.

The applicant is requesting the conditions of approval be essentially the same as for the
Chappelle shows previously held at the Wirrig Pavilion. Seating capacity would be increased to
not more than 1,000 ticketed patrons for these events. To further limit the amount of traffic on
Meredith and Mosely Roads, a maximum of200 patron cars will be parked at the Property and the
remaining patrons will be bused to the site of the Pavilion from a local parking area(s), using
chartered buses. The hours of operation for the Temporary Use would begin at 5:00 p.m. for
parking, with gates to the Pavilion opening at 7:30 p.m. All shows would be completed by 11:00
p.m. on Sunday through Thursday, and by 12:00 a.m. on Friday and Saturday. There would be
limited access to the Property and Pavilion prior to and after such times for event security and staff
for the setup and closure ofthe events. Normal operations for the Pavilion during regular business
hours throughout the week would continue and not be affected by the approval ofthe Temporary
Use. Consistent with past practices, all shows will have event security and be professionally
produced, staffed and managed.

The event sound system and portable lighting for the parking areas are specifically
designed and professionally operated so as to minimize impact on surrounding properties. Similar

to procedures followed during prior shows, Mr. Wirrig will ensure the operation of the sound
system, including real-time feedback adjustments, will be designed to limit impact on surrounding
properties. As before, communication with the surrounding neighbors will occur prior to the dates
ofthe events.

A maximum of four (4) food trucks (locally owned and sourced) would be at the venue
each performance night. All food trucks will be established food vendors with appropriate
licensing and permits. Appropriate restroom facilities would be provided.

The Property has a dedicated entrance off Meredith Road and staff parking attendants
would be stationed at this entrance consistent with prior practices. To further address past traffic
concerns presented by neighbors, parking onsite will be limited to 200 patron cars. All other
patrons will park off-site and be bused to and from the site, via dedicated transportation that we
would provide. This further mitigates any concerns in relation to vehicle stacking or roadway
congestion. There is a turnaround located at the end ofthe existing driveway and event staff would
be on hand to address any concerns related to parking.

A site plan showing the layout of the event is included with this Application. Additional
details will be provided during the BZA hearing and the applicant will be happy to answer any
questions at that time.

In the event supplemental information is requested between the filing of this Application
and the BZA hearing, the Applicant is prepared to provide the same or answer any preliminary
questions.
