1. What is Rep. Act No. 8293?


Rep. Act No. 8293 is an act known as “Intellectual Property Code of the Philippines.”. In this
act it aims to secure and protect the original work of the owner and shall give credits to the
owner. The other people can’t copy this work because it is already protected and it is
secured by the law. Rep. Act No. 8293 is an act that includes the intellectual property office,
law on patents, law on trademarks,service marks, and trade names, law on copyrights and
lastly the final provision.

2. Describe the IPO and its organizational composition.


The Intellectual Property Office (IPO) is the official government body responsible for
intellectual property (IP) rights including patents, designs, trade marks and copyright and
shall have the custody of all records, books, drawings, specifications, documents, and other
papers and things relating to intellectual property rights applications filed with the Office.
The organizational composition or structure of the IPO is/are: The Office shall be headed by
a Director General who shall be assisted by two (2) Deputies Director General. The Office
shall be divided into six (6) Bureaus, each of which shall be headed by a Director and
assisted by an Assistant Director.

3. Describe the different Bureaus under the IPO and explain their functions.
[a] The Bureau of Patents - A patent is an exclusive right that allows the inventor to
exclude others from making, using, or selling the product of his invention during the life of
the patent. Patent owners may also give permission to, or license, other parties to use their
inventions on mutually agreed terms. The functions of this Office shall record assignments,
licenses and other instruments relating to the transmission of any right, title or interest in and
to inventions, and patents or application for patents or inventions to which they relate, which
are presented in due form to the Office for registration, in books and records kept for the
purpose.
[b] The Bureau of Trademarks - A trademark is a word, a group of words, sign, symbol,
logo or a combination thereof that identifies and differentiates the source of the goods or
services of one entity from those of others. The functions are search and examination of the
applications for the registration of marks, geographic indications and other marks of
ownership and the issuance of the certificates of registration; and conduct studies and
researches in the field of trademarks in order to assist the Director General in formulating
policies on the administration and examination of trademarks.
[c] The Bureau of Legal Affairs - The Bureau of Legal Affairs is responsible for among
other things, the civil administrative affairs, such as registration, family register, nationality
and deposit to protect the property and identity matters of the people. The functions are to
hear and decide opposition to the application for registration of marks, cancellation of
trademarks, of patents, utility models, and industrial designs; and petitions for compulsory
licensing of patents; and to exercise original jurisdiction in administrative complaints for
violations of laws where the total damages claimed are not less than P200, 000. The Director
has the power to hold and punish for contempt all those who disregard orders or writs issued
in the course of the proceedings and after hearing impose administrative penalties.
[d] The Documentation, Information and Technology Transfer Bureau - The Director of
the Documentation, Information and Technology Transfer Bureau shall exercise quasi-
judicial jurisdiction in the settlement of disputes between parties to a technology transfer
arrangement arising from technology transfer payments, including the fixing of appropriate
amount or rate of royalty. Their functions is to provide technical, advisory, and other
services relating to the licensing and promotion of technology, and carry out an efficient and
effective program for technology transfer; and register technology transfer arrangements, and
settle disputes involving technology transfer payments.
[e] The Management Information System and EDP Bureau - Management Information
System (MIS) is an integrated user-machine system for providing information to support
operations, management and decision-making functions in an organization while the
Electronic data processing (EDP), is a frequently used term for automatic information
processing. It uses the computers to manipulate, record, classification and to summarize data.
The functions are to introduce and maintains computerized information systems to
process data efficiently to produce useful and timely information to the office.
[f] The Administrative, Financial and Personnel Services Bureau - The Administrative,
Financial and Personnel Services Bureau are the ones who’s providing services like
cashiering, payment of salaries and other Office's obligations, employment records and
reports, they are also formulating and managing a financial program to ensure availability
and proper utilization of funds, and provide for present and future manpower needs of the
organization.
4. Discuss 5 examples of items that can be patented.
 Business Method - A business method is a method of operating an aspect of an economic
enterprise. A business method patent is a type of patent that claims or shows a new way of
doing business.
 Makeup - Makeups or cosmetics can be patentable, they are patentable. Makeup is patented
because of the natural or organic ingredients that is used within it. It can also be patented by
a formulation of the natural or organic cosmetics.
 Food Recipe - Food Recipe is also can be patented for they qualify to be patent protection,
the invention must have a patentable subject matter. Food recipes fall within the scope of
patent protection because they qualify as a composition of matter. Food recipes qualify as a
composition of matter because ingredients are combined to produce a final product.
 Drinks - A drink may be patented if it meets the legal requirements for patentability.
They are also qualified to be protected by a patent. Drinks are typically patented using
utility patents.
 Games - Games can be patented also. There are some things to keep in mind with patents
for games, the first thing is how to prevent your game from being stolen. The games
without the patent protection can be stolen by the others if post your ideas online or
somewhere else that is accessible to the general public.
