respect of an area of 7000
sq.ft(3000+4000 Sq.ft.) office
space located at Ground Floor,
Bllock 1&2, Premises No. 80,
Lala Babu Shire Road, Bally,
Howrah.
Dear Sir,
I, Swapan Das, S/o- Kalipada Das residing at 16/1/H, BK Pal Temple
Road, P.S- Belur, P.O- Belurmath, District- Howrah, beg to state as
follows for your kind consideration and necessary action:-
1. That on 10/08/2021, I confronted a Notice which was pasted in
front of my shop room on the Ground floor, Block No.2 within
Holding No. 80, Lala Babu Shire Road, wherein it reveals that a
company namely M/S VIBGYOR ALLIED INFRASTRUCTURE
LTD., allegedly owned 7000 sq.ft. office space on the ground floor
Block No. 1&2, Premises No. 80, Lala Babu Shire Road, Bally,
Howrah.
2. That after going through the same notice, I come to know, that my
said shop is allegedly also within the area owned by the aforesaid
company, but as per direction of the said notice I submitted all
relevant documents o 16/08/2021 in your office.

3. That after complying your order as per said notice, I verified my


documents and the documents allegedly made by said company in
it’s favour and come to conclusion that the owners and developers
have cheated me as because they have sold the shop area occupied
by me in my favour, but inspite of knowing the said fact they inter-
alia sold the area of my said shop to the aforesaid company.

4. That finding no other alternative I lodged a F.I.R against the


owners, developers and company for their fraudulent act being
Bally P.S Case No. 224 of 2021 dated 26/09/2021, Under Section
420, 406, 418 and 34 of IPC and the investigation on the basis of
the said F.I.R is going on.

5. That I also filed a Declaratory Suit against the owner, developer


and the said company, being Title Suit No. 1094 of 2021 and the
same is still pending before the Ld. 1st Civil Judge (Jr. Division) at
Howrah.

6. That copy of F.I.R and plain of Title Suit is annexed herewith for
your perusal.
Therefore, being a poor person I request you to withdraw your notice
dated 10/08/2021 with immediate effect and release my property/shop
room as early as possible.
