The Cause having come befo re this Court upon the Moti
on for Summary Judgment filed
by First American Bank whic h was heard by the Cour
t at a 45-minute specially set hearing on
Monday, June 26, 2017, and the Court, having heard
and cons idere d argument from First
American Bank , it is

ORD ERE D AND ADJ UDG ED THAT:

("Pr oper ty").

4. Sale of Property. The Cou rt is withholding havin


g a sale of the Prop erty,
pending application by Plaintiff, FIRS T AMERICA
N BAN K, requesting a sale of the
Prop erty and certifying that the Amended Final
Judgment, date d June 30, 2017
("Mo netar y Judgment''), awarding damages has
not been satisfied. Upo n application by
Plaintiff, FIRS T AMERICAN BAN K, requestin
g a sale of the Property and certifying
that the Mon etary Judgment has not been satisfied,
this Cour t shall ente r an Orde r
instructing the Clerk of Cour t to sell the Prop erty.

5. Cost s. Plaintiff, FIRS T AME RICA N BAN K, s hall


advance all subseque nt cost s
of this actio n and shall be reimburse d for them by
the Cler k if Plain tiff, FIRS T
AME RICA N BAN K, is not the purc hase r of the
Prop erty for sale, provided that the
purc hase r of the Prop erty fo r sale shall be respo
nsible for the documentary stamps
payable on the certi ficat e of title. If Plaintiff, FIRS
T AME RICA N BAN K, is the
purchaser, the Cler k shall cred it Plain tiff's bid with
the total sum with inter est and cost s
accruing subsequent to this Judgment, or such part
of it as is nece ssary to pay the bid in
full.

6. Distribution of Proc eeds . On filing the certificat


e of title the Cler k shall
distribute the proc eeds of the sale, so far as they
are sufficient, by paying: first, all of

any remaining amount pending further order of this Cour
t
7. Right of Redemption/Right of Poss essio n. On filing the
certif icate of sale,
Defendants and all perso ns claiming under or against Defen
dants since the filing of the
Notic e of Lis Pend ens shall be forec losed of all estate
or claim in the Prope rty and
Defen dants ' right of redem ption as presc ribed by sectio
n 45.0315, Florid a Statutes
(2013) shall be terminated, exce pt as to claims or rights
w,der chapt er 718 or chapt er 720,
Florida Statutes, if any. Upon the filing of the certif icate
of title, the perso n named on the
certif icate of title shall be let into posse ssion of the Prope
rty.
8. Attorneys' Fees . The Cour t finds that Plaintiff, FIRS T
AME RICA N BAN K, is
entitled to reaso nable attorn eys' fees, costs and expen
ses incurred in conne ction with
this action. The Cour t will retain jurisdiction to detennine
the total amow,ts of attorneys '
fees , costs and expen ses to which Plaintiff is entitled.

9. Jurisdiction Retained. Jurisdiction of this action is retain


ed to enter further
order s that are prope r including, without limitation, a defic
iency judgment.
