My dear Mr Aslam
Thank you very much for contacting me for seeking legal opinion regarding your case pertaining to FIR Registration .
As per my knowledge and experience police should register your FIR and if local police is not doing so then you can go
to superintendent of police and after that you can go to court also.
Let’s see what law says:-
The code of criminal procedure,1973.
Section 154(3) in the CrPC,1973.
(3) any person assigned by a refusal on the part of an officer, incharge of a police station to record the information
referred to in sub-section (1) any send the substance of such information, in writing and by post, to the superintendent of
police concerned who, if satisfied that such information discloses the commission of a cognizable offences, shall either
investigate to be made by the police officer subordinate to him.
CrPC,1973
Section 36- Power of superior officers of police officers superior in rank to an officer in charge of a police station may
exercise the same powers, throughout the local area to which they are appointed, as may be exercised by such officer
within the limits.

Function of police complaint Authority:-
The state level complaint Authority take cognizance of only allegations of serious misconduct by the police personnel,
which would include incident involving death, grievous hurt or rape in police custody.
• • The district level complaint Authority would, apart from above Cases, may also Inquire house grabbing or any
incident involving serious abuse of authority.

Power of police complaint Authority:-


May recommend:-
For any action, department or criminal, against a declinquent police officer shall be binding on the concerned authority.
