I. SUMMARY

Lectures in Day 1 learnings:


1. Very beneficial - importance of financial evidence in prosecuting OSEC cases, for
gathering information.
2. serves as an eye opener that we can Utilize several agencies to bolster
evidence.
3. Connection with different agencies particularly AMLC.
4. Building up connections.
5. The Use of receipt to establish the identity of the accused.
6. Presentation of witnesses

Value of Financial Records:


1. very valuable in Establishing the accused’s pattern and the paper trail and will
help prove the elements of OSEC.- offer, payment or for consideration
2. Unlawful activities are also established, sender recepient

Challenges in gathering financial records


1. seeking cooperation from financial institutions, need to authenticate and present
representatives
2. Some financial institutions, not only banks, are not cooperative during initial
stage.
3. Some institutions require Court orders.
4. Obtaining original copies to present in Court.
5. Time constraint – some financial documents are active only for 5 years

4. Protective Measure:
It can be very helpful as we are trying to protect the child from testifying. - prevent
retraumatization. it must be established together with other pieces of evidence.

5. What can you consider as promising good practices for connecting or linking
financial records to other pieces of evidence?
- must be linked with the online engagment or chat logs; from the start it
must be used already sa case build up and later on turned over to the
proescutor so it can be utilized properly.
- time stamp sa chat logs correlated sa receipts is very important.

NBI – SRA BATI: online engagement or initial communication. maganda na maiconnect


na agad yung personality nung recipient ng financial consideratin sa victim. Merong
recipient iba sa nag ooffer ng victim online. Dun palang sa online engagement,
maganda na mailink na agad yung personality ng recipient.

PROSEC. DALOPE: online engagement. na nagbigay siya ng name niya, paano siya
nagbigay. anong remittance center. eto yung connectin niya.

OCP JONI ROSS: agree with Sir Bati. dapat sa initial pa lang, well-planned na. kasi
magiging challenge yan eh. We have to antipicate those transactions na magiging
entered into. after that, there whould be turn over from law enforcement to prosecutors.
Maganda nga evidence pero hindi naman mairelate sa prosecutor, hindi rin maipprove
sa court. After the entrapment.

OTHER COMMENTS:
[Atty. Kath] Financial records may date and time, matali siya sa chat log. Yung amount
bago magtransafer, nabanggit na. Timestamp is important.

Base sa nahandle ko na case, yung ginagamit nilang channel are - Cebuana. Kung
nakatira siya sa Mabalacat Pampanga. Yung remittance center na nag encash,
important din yung lugar. Kung saan malapit nakatira yung accused.

so if ever na mahirapan tayo sa case, with this kind of evidence, it can establish a
pattern. Makikita natin from financial aspect na he's receiving money. The possibility na
hindi na ipresent yung victim.

II. DISCUSSION PROPER


1. What are your takeaways or crucial learnings from the lectures in Day 1
and how do you see it beneficial to your investigation (LE) and
presentation (Prosecutors) of financial evidence?
NBI - SRA BATI: From the law enforcement’s point of view, very beneficial. Para sa info
na need like addresses, conducting operations, applying for search warrants.

OCP William: hindi lang siua learning pero eye opener din sa part namin na we could
utilize/tap several agencies para matulungan kami pra mabolster ang evidence sa mga
cases na hinahawakan or hahawakan namin.

OPG Yanga: Sobrang helpful. Narealize ko yung with AMLC, connected din pala sa
trafficking and prosectuing cases in exploting children. Interconnecting ang mga
agecies. nagiging wholistic. It's really helpful like sa AMLC, may kakilala ka na. Alam mo
sino pwede lapitan if may mga ganitong cases, may pwede na pagtanungan. as
prosecutors, hindi lang kami magpprosecute. We need evidence and support the case
for conviction. help from law enforcemet and AMLC, magkakasama pala.

Prosec Dalope: Very beneficial, lalo na yng lecture ni Prosec Ding kasi very inspring
yung ginawa niya from the scratch talaga. Nagbuild up siya ng case. Nakacontact siya
ng partners sa ibang bansa. Nakakatulong samin yun kapag nagpprosecute ng cases.

OCP Joni Ross: Madami palang pwede magamit sa particular receipt. Alam mo how to
establish and present other witness - AMLA for that matter. Just to build up a strong
case against the accused. Pwede pala. They can identify the signature, makikita na
agad. Madami pala pwede iexplore with that particular evidence.

AMLC Eileen Guerrero: Yung lecture ni fiscal Ding- how to present witness and OSEC
cases. May naifile na yung AMLC sa OSEC cases.

2. What do you think is the value of the accused’s financial records in


establishing and proving OSEC activities?

NBI - SRA Bati: Nakita natin yung value na naprovide natin yung financial record ng
accused. Naprove natin na yung accused offered the victims online exploitation,
financial consideration.

OPG Yanga: like kanina, nag present ng GA, may witness, yung financial record ng
accused important siya sa pag present, makikita natin yung paper trail. Yung pag offer
then pag payment. Madali natin mattrace back from sender to recipient. Yung time, kita
mismo sa receipt. Kung nasa ibang bansa siya, mkikita na yung time difference and
yung date. Name and addresses. Macoconnect mo yung details sa accused. kahit
gumamit pa siya ng alias.

Prosec. Dalope: makikita natin yung pattern ng offender. It's outside the country. Then
the offer, receipt of money. yung elements ng OSEC cases mapprove natin sa financial
records.

OCP JONI: aside from establishing the pattern, it is crucial. how often the transaction is
happening. I share with Atty Dalope witht he opinion.

AMLC Guerrero: considering that we are handling financial records, dun namin
naestablish yung unlawful activities.

3. What challenges do you see or can anticipate regarding the admissibility of


financial records in OSEC prosecution (prosecutors) and in gathering
financial evidence (LE)?
NBI-SRA BATI: in gathering evidence, there is financial institution not cooperative
sometimes. that’s why very thankful din kami na ang Western Union ay committed sa
pagbibigay ng informatin kshit investigation stage pa lang. Yung iba binabalewala yung
letter request.

OCP WILLIAM: some agencies would require a court order before they will divulge a
particular info, court (some) may/will not issue an order to avoid the impression that they
are helping the prosecution in gathering its evidence, authenticating financial records in
the event the financial institution will close/cease operation

OCP YANGA: I agree with Sir Bati. Yun ang common. pati with other cases. hindi
cooperative yung institution na nagrerequest ng records. Isa pa yung copies, kung
makapag secure ka kailangan original naman. Pero minsan hindi napprovide yung
original, kapag meron, maiiwan sayo yung photocopy. Although revised na ang Rules
ngayon accepting photocopies na. Siyempre marami financial records. pertaining to
admissibility. at the same time, kailangan din mauthenticate. Not only in OSEC, but also
with other case.

PROSEC. DALOPE: like sa Western Union, since this is joint effort sa pag build ng kaso
na ito. Need din ng authentic, representative from them.

OCP JONI ROSS: May namention si Prosec Ding. International - may witness na hindi
magtestify dahil covered sila ng immunity, parang diplomat.

What can I anticipate?: Yung mga agents na nagcoconduct ng operation, using money
remittances. sa western came from abroad. what theyre saying pinapadala nalang nila
pero sa Pilipinas nanggagaling. hindi na napapansin yung perpetrator dun kasi need
lang money. Next time magiging maingat na sila. For now it's useful. pero later, pag
nadiscover na nila na ganung ginagawa ng law enforcement, they can go away.

AMLC GUERRERO: Additional challenge. Meron kasing Financial Institution they can
only give until 5 years. So after 5 years, we will have difficulty to access the record.

4. Do you see presentation of accused’s financial records as a child


protective measure or one that can lead to victim independent evidence?
NBI – SRA BATI: Human trafficiking na pinpresent as evidence - sa OSEC, Yung
pinpreprent naman is financial record. Very vital yun na nag exist yung transaction.

May instances na yung actual perpetrator wala siyang ability to receive by his own. As
under cover, maganda sa online engagement, maitanong na sa target or accused kung
sino na magrereceive ng pera at kung ano relationship sa recipient.

Very challenging, kasi mahirap iverify yung identification. Madali lang dayain yung ID.
Then marami din gumagamit na scammer. Without going to the bank mismo. Not sure
kung ano ginagawa ng Banko Sentral. Di na nasusunog yung KYC.
