Abstract

This research aims to study the interpretation and significance of the Polluter Pays Principle in
India. The research focuses on the scope of damages caused and the liability a Polluter must hold
as per the principle as a part of the cost of restoration and compensation and also justifies the
same with significant reasons and cases. Polluter Pays Principle forms a significant part of the
evolution of Environmental law in India from the time it was first recognized, in 1996. The
significance of this principle forms a basis for sustainable development in the country. Polluter
Pays Principles is a well-known and well renowned environmental legal principle. There is no
meaning of the concept "polluter pays principle," as well as the breadth of its applicability is
likewise questionable, with no clear consensus on allowable expectations. The polluter pays
concept states that people who cause pollution should suffer the consequences. This idea is
currently essential in both national and international environmental strategy. River pollution is
becoming more visible all over the world. The repercussions of river pollution affect all living
things, including humans. Controlling and managing contamination and its repercussions is
critical. Consequently, the polluter pays principle refers to the concept of paying the whole
societal cost of such an act instead of just the individual cost. It's a technique for internalising the
externality.
