AIRWORTHINESS NOTICE
No: 66 Issue: 3 Date: 1 March 2000 AIRCRAFT REGISTRATION 1. 1.1 2. 2.1 Introduction This Notice is issued for information and guidance on the requirements and process relating to registration of aircraft in Malaysian Civil Aircraft Register. Requirements No aircraft shall fly in or over Malaysia unless it is registered in Malaysia or a Contracting State, EXCEPT the following aircraft which may fly unregistered within Malaysian airspace only : a) b) NOTE : 2.2 A glider flying not for the purpose of public transport or aerial work. Any aircraft flying in accordance with the "B Conditions" set out in the Second Schedule of MCAR. Kites or captive balloons are not subjected to this requirement. Page: 1

Only QUALIFIED persons may be the registered owner of a Malaysian registered aircraft. Qualified persons are defined as follows : a) b) c) the Government of Malaysia. a citizen of Malaysia. a body incorporated and having its principal place of business in Malaysia.

2.2.1

An unqualified person residing or having a place of business in Malaysia may be the registered owner of a Malaysian registered aircraft, if the aircraft is owned by the unqualified person, provided the aircraft is not used for the purpose of public transport or aerial work. An unqualified person may also be the registered owner of a Malaysian registered aircraft, if the aircraft is owned by the unqualified person, provided the aircraft is chartered by demise or hired to a qualified person. An aircraft shall not be registered in Malaysia a) if the "aircraft type" has not been accepted by the DCA having regard to the design, construction, workmanship and materials of the aircraft, including any engines and equipment fitted in the aircraft, if the aircraft is already registered in another country, or if it would be inexpedient in the public interest for the aircraft to be registered in Malaysia.

If an unqualified person, other than persons described in paragraphs 2.2.1 and 2.2.2, becomes entitled (other than by virtue of his membership of a flying club) as owner to a legal or beneficial interest in a Malaysian registered aircraft or a share therein, the registration of the aircraft shall become void, EXCEPT if the aircraft is the subject of an undischarged mortgage entered in the Malaysian Civil Aircraft Register. The registered owner shall return the Certificate of Registration (C of R) of the aircraft to the DCA for cancellation. The registered owner of a Malaysian registered aircraft shall inform the DCA in writing of : a) any change in the particulars which were furnished upon application being made for the registration of the aircraft; the destruction of the aircraft, or its permanent withdrawal from use; or in the case of an aircraft which was subject to any hiring agreement or a demise charter, the termination of the agreement or the demise charter.

NOTE : The reference to the registered owner of an aircraft includes : i) ii) in the case of a deceased person, his personal representative. in the case of a dissolved body corporate, its successor.

Any person who becomes the owner of a Malaysian registered aircraft shall, within 28 days from the date he becomes the owner, inform the DCA in writing to that effect and apply for a new C of R. Otherwise the aircraft shall not be flown until a new C of R is obtained. The registration of an aircraft shall be cancelled if it would be inexpedient in the public interest for the aircraft to continue to be registered in Malaysia. Similarly, the registration of an aircraft shall not be cancelled if it would be inexpedient in the public interest to do so. The registration of an aircraft, which is the subject of an undischarged mortgage entered in the Malaysian Civil Aircraft Register, shall not be cancelled unless all persons specified in the Malaysian Civil Aircraft Register as mortgagees of that aircraft have consented to the cancellation. Malaysian Civil Aircraft Register The Malaysian Civil Aircraft Register is kept and maintained in a computer database. Hardcopies of the Malaysian Civil Aircraft Register records shall also be kept in a file. Aircraft with Certificate of Airworthiness (C of A) that has expired for more than 7 years are considered INACTIVE and shall be considered for the cancellation of its registration. Registration markings are issued in sequence (9M-AAA, 9M-AAB, through 9M-ABA, 9M-ABB, through 9MBAA, 9M-BAB, to 9M-ZZZ). Out of sequence registration marking may also be issued provided the applicant has reserved the registration marking. The following registration markings shall be reserved : i) ii) "9M-E__" "9M-U__" for amateur built aircraft. for microlight aircraft.

For aircraft that is built from own design or from plans/drawings, the builder shall be the manufacturer of the aircraft and may allocate builder's own aircraft serial number. Similarly, for Kitplanes that exceed the 51% rule. Process Of Aircraft Registration Application for registration may only be made by the owner or a person authorised by the owner. For aircraft registration application, the applicant is required to submit the following :a) b) c) d) An official letter from the owner for the application for C of R. Application form JPA Borang AP1 (1 copy). Registration reservation form JPA Borang AP 1A (if applicable). Required fees (refer back of application form).

The applicant is also required to submit the following supporting documents : Evidence of eligibility as applicant a) b) c) For Malaysian citizens, a certified copy of National Registration Identification Card. For bodies incorporated in Malaysia,a certified copy of certificate of incorporation. For Foreigners residing in Malaysia, i) ii) d) a certified copy of Passport Documentary evidence of residency e.g. utility bills (phone, electricity, water, etc.)

Other Foreigners with lease agreement i) ii) a certified copy of Passport or registration certificate a certified copy of Lease agreement with Qualified person.

Confirmation of Deregistration/Unregistration from Aviation Authority in country of export

Evidence of ownership Conveyances completing the chain of ownership from the last registered owner, through all intervening owners, to the applicant, must be submitted.

For first issue of C of R for the aircraft, the applicant shall also make an application for the C of A. For first of type and model imported into Malaysia, a registration notice shall be issued to the State of Design for the aircraft to advise that the aircraft has been entered into the Malaysian Civil Aircraft Register. Process Of Aircraft Deregistration Application for deregistration may only be made by the current registered owner or a person authorised by the current registered owner. For aircraft deregistration application, the applicant is required to submit the following :a) b) c) Application form JPA Borang AP 1AA. Duly endorsed C of R and all original DCA document e.g. C of A, Flight manual approval page. Evidence of free from any lien e.g. Mortgage Discharge Form.

If aircraft is being exported, a deregistration notice shall be issued to the Aviation Authority of importing country by AFTN, telex or fax. Process For Reservation Of Aircraft Registration Marking For reservation of aircraft registration marking, the applicant is required to submit the Registration Reservation form JPA Borang AP 1A (2 copies) Upon making an application to reserve an out of sequence registration marking for an aircraft, the applicant shall pay a charge of RM500.00 for each 6 months period of reservation. Cancellation This Notice cancels Airworthiness Notice No. 66 Issue 2 dated 1 July 1997, which should be destroyed.
