AFFIDAVIT COMPLAINT
I, _______________, of legal age, Filipino, married and a
resident of___________________, Philippines, after being sworn
to in accordance with law, hereby depose and state THAT:

1. I am instituting a criminal complaint for defamation, threat

and or unjust vexation against__________, a resident
of_________________, Philippines. The ultimate facts of
which are discussed herein below;
2. Presently, I am the incumbent Barangay Chairman
of_____________, Philippines;
3. The sometime on March 11, 2019 at about 11:30 Am,
_____________went inside the barangay hall and requested
from me a Certificate of Good Moral Character;
4. Pursuant to what I have learned in our seminar conducted
by the Department of Interior and Local Government (DILG)
barangay chairman and other officers of the barangay are
not bound to issue such certificate if the requesting party is
involved in any case/s. Consequently, I refused to give her
the said certificate because ___________was involved in
some cases in our barangay;
5. ______________asked a ballpen and paper
from_____________. She wrote something in the paper
about the reasons why I did not gave her such certificate.
Thereafter, she directly pointed that ballpen to me while
shouting, in a very loud voice and within the hearing
distance of other people in the barangay hall, the words
“________________” (translated as: “Why will you

 not issue? I will call 8888 and I will let them remove
you as barangay captain if you will not issue such
certificate”);
6. I was seriously threatened by her actions when she pointed
the ballpen to me while giving a threat that she will remove
me from my position as barangay chairman;
7. Likewise, I was shocked and insulted when she uttered
those discourteous and offensive words against me but I
happened to control my composure and just zipped my
mouth inasmuch as I am the barangay chairman and owing
the fact that there are many people in the barangay hall that
time;
8. I was embarrassed and humiliated when she shouted to me
such a rude and impolite words in public disregarding my
position as Barangay Chairman;
9. Even_________, barangay health worker, who was present
that time, even said to me, “_____________.” (translated
as: She is such a rude woman. She did not respect you as a
barangay chairman). Attached herewith is the Affidavit of
Witness marked as Annex “A”;
10. On March 12, 2019, I informed the chairman
of_____________, to call the attention of
______________so that we can discuss the said incident
and to settle the issues between us but she vehemently
refused and ignored such invitation. Attached herewith is the
letter marked as Annex “B”;
11. I am therefore executing this Affidavit Complaint to charge
for defamation, threat and or unjust vexation, punishable
under the Revised Penal Code.
