Hence in order to achieve completion of project by 14th October 2018 ( as per your work program) it is imperative that ICP Dawki project is substantially completed before onset of monsoon season in 2018. 3. 29.05.2017 Respondent’s email Pg. 57, Annexure Respondent’s As the monsoon season is approaching R-34, Vol RD-1 letter. fast and the good working season is running out , the project will be thrown out of gear, if certain works are not completed in next one month. 4. 06.06.2017 Respondent’s email Pg. 66, Annexure Respondent’s As the monsoon season is approaching R-41, Vol RD-1 email fast and the good working season is running out , the project will be thrown out of gear, if certain works are not completed in next few days. 5. 10.07.2017 Claimant’s email Pg. 52, Annexure Claimant’s email It was stated that in all the days of July C-26, Vol CD-1 2017 there has been incessant rain at the site in which no civil work can be done. 6. 11.07.2017 Respondent’s email Pg. 96, Annexure Respondent’s I hope you will appreciate the gravity of R-56, Vol RD-1 email the situation and look into the issues of inadequate resource deployment for its intimidate resolution so that the works which are feasible even in rainy season does not suffer and some progress can be made at site. 7. 14.07.2017 Rains have started at site from 2nd half Pg. 55-56, Claimant’s letter of May when water started rolling Annexure C-27, down the hill to the site. Contractor’s Vol CD-1 suggestion of engaging dewatering pump(s) and keep joint records of HP- Hr. did not find nod from the engineer; and now the whole site has become a pool in 1st half of July 2017. 8. 24.07.2017 Respondent’s letter Pg. 106, Annexure Respondent’s The aforesaid works could have been R-59, Vol RD-1 letter progressed well before start of rainy season and even during rains some progress in these works could have been made. 9. Minutes of MOM: Pg. 58, Annexure meeting held on Contractor mentioned heavy rains for C-29, Vol CD-1 04.08.2017 past 1½ months have also badly affected the progress of work, bringing Pg. 128, Annexure it to virtually a complete standstill. R-67, Vol RD-1 10. 11.08.2017 Claimant’s letter: Pg. 62, Annexure Claimant’s letter The dry period from Oct, 2016 to May, C-31, Vol CD-1 2017 was lost in land availability. By the time the land issue was cleared by the engineer, full rainy season started from May, 2017 which is continuing till now (vide copy of DPR attached from 01.06.2017 to 03.08.2017). 11. 15.09.2017 Contractor mentioned heavy rains for Pg. 165, Annexure Respondent’s past 2½ -3 months have badly affected R-88, Vol RD-1 email the progress of work, bringing it to virtually a complete standstill. GM/AP mentioned that contractor’s other site arrangements like establishment of laboratory/ casting of paver blocks / design of pre fabricated sheds etc. which were independent / unaffected due to rains are also lacking behind the schedule. The contractor mentioned that as the rains have now started receding they are committed to put in extra efforts and shall makeup the shortfall in progress in next two months. 12. 23.10.2017 The existing ground where foundations Pg. 72, Annexure Claimant’s letter of various buildings are to come up is C-34, Vol CD-1 still very much surcharged with water and cannot even withstand the dead weight of the Excavator itself. Not to speak of the impact load, when it will work. The contractor are afraid that, though the rains have stopped, the excavator may tend to sink, as it happened in July 2017, if it is taken on the existing ground, todo excavation for foundations. 13. 31.10.2017 Respondent’s email Pg. 182, Annexure Respondent’s The respondent stated that the R-94, Vol RD-1 letter monsoon has now receded compare to in July when it was at its peak. 14. 03.01.2018 The respondent stated during monsoon period, rainfall occurs at dawki only intermittently. 15. 26.06.2018 The contractor mention that the Pg. 279, Annexure MOM revised work program could not be R-136, Vol RD-2 achieved due to frequent rain and water logging/stagnation at site.
