HEALTH & AYUSH DEPARTMENT NOTIFICATION 01/21/2018-1 HB-I Dated 30-12. 2021 Subject:- Procedure for admission to BAMS/BHMS in all Government/Government ions of the State of Haryana including those s (SGT University, Gurugram & Baba Mast (Shri Dhanwantry Aided/Private BAMS/BHMS Insti under Private/Deemed Universit Nath University, Asthal Bohar) and UT Chandig Ayurvedic College) for Academic Session 2021-22, ‘The Governor of Haryana is pleased to notify the admission procedure in supersession of all the earlier notifications issued in this regard, to be adopted for admission to Under Graduate Courses i. BAMS/BHMS in all the Government/Government Aided/Private Ayurvedic and Homocopathic Institutions under Shri Krishna AYUSH University Kurukshetra, for Academic Session 2021-22 in the State of Haryana including those under Private/Deemed Universities (SGT University, Gurugram & Baba Mast Nath University, Asthal Bohar) and UT Chandigarh (Shri Dhanwantry Ayurvedic College). It is notified that in Government/ Private Institutions! Private/Deemed Universities covered under | this Notification, 15% of the seats are under All India Merit Category of NEET UG-2021, | counseling for which is conducted by Ministry of Ayush , Govt. of India/ National Commission for Indian System of Medicine (here in after called as NCISM)/ Shri Krishna AYUSH University, Kurukshetra on the basis of all India merit of NEET UG 2021 and the counseling for remaining 85% of the scats would be conducted by Shri Krishna AYUSH University, Kurukshetra, on the basis of NET UG 2021. It is further notified that in all Private Institutions in the state of Haryana for Academic Session 2021-22 covered under this Notification, 50% of the seats will be filled under State Quota seats and remaining 50% of seats will be filled under the Management category. Out of 50% of Management category seats, 15% seats will be in the Non-Resident Indian (NRI Category). The tentative seat distribution& reservation policy of BAMS Course in various Government/Government Aided &Private Ayurvedic Colleges for Academic Session 2021-22 in the State of Haryana is attached at Annexure-I & I. ‘The tentative seat distribution and reservation policy in BAMS college under UT Chandigarh (Shri Dhanwantry Ayurvedic College) will be as per UT reservation policy as Annexure IIT. The tentative seat distribution and reservation policy in BAMS college under SGT University, Budhera Gurugram and Baba Mast Nath University, Asthal Bohar, Rohtak would be as per section- 35 of Haryana Private University Act 2006 will be as per Annexure IV. The tentative seat distributioné& reservation policy of BHMS Course in Private Homoeopathic College (J. R. Kissan Homoeopathic Medical College & Hospital, Rohtak)for Academic Session 2021-22 in the State of Haryana is attached at Annexure-V. ‘The State Reservation Policy shall be applicable for admission to all State Quota seats in Government/Government aided Ayurvedic and Homoeopathic Colleges and for 50% (State Quota seats) in Private Ayurvedic/Homoeopathic Colleges of the state of Haryana, j 5% seats of the State Quota seats shall be filled up by candidates with benchmark disabilities in accordance with the provisions of guidelines regarding admission to students with specified disabilities under the Rights of Person with Disabilities Act, 2016 based on the merit list of NEET- 2021 and as per NCISM guidelines issued from time to time. The PwD Certificate should be as per | the guidelines issued by Central Govt. & notified (available on counseling website namely ywww.aacce.gov.in under Counseling Scheme & FAQs)(Annexure-VI)and the Medical Board constituted by PGIMS, Rohtak will only be considered valid for counseling/admission purpose for the academic session 2021-22. The dates on which the Medical board at PGIMS Rohtak will sit shall be duly publicized on the website of Shri Krishna AYUSH University, Kurukshetra (wowweskauac.in). Shri Krishna AYUSH University Kurukshetra, is authorized to conduct online Combined Centralized Counseling as per Merit of NEET UG-2021 for admission to all the Government/Government Aided/Private Ayurvedic and Homoeopathic Colleges, for Academic Page 1 of 50 Session 2021-22, located in the State of Haryana including those under Private/Deemed Universities (SGT University, Gurugram & Baba Mast Nath University, Asthal Bohar) and Union Territory igarh subject to verification of eligibility and original documents by the Admission Committee constituted by the State Government/ Shri Krishna AYUSH University Kurukshetra, The seats in each institute are subject to the final approval from Ministry of Ayush, Govt. of India/NCISM/National Commission for Homocopathy(herein after called as NCH) /State Government/Affiliating University. Accordingly, the final distribution of seats may vary depending upon the sanction/decision of the Ministry of Ayush, Govt, of India/NCISM /NCH /State Government/Affiliating University. Roster for all categories of seat including of PwD, EWS, ESMIFF ete. shall he maintained by concerned college which will be verified by Shri Krishna AYUSH University, Kurukshetra for allotment of seats under reserved category. Reservation for EWS Category shall be provided as per Haryana Government Notification dated 25.02.2019 (Annexure-VII). The candidates will be required to submit Income and Asset/Income Disclosure Certificate issued from Competent Authority as per (Annexure-VIII) of the said Notification dated 25.02.2019,subject to the enhancement of seats above the annual intake capacity of last academic session as per Punjab & Haryana High Court order of CWP. No. 7283 of 2020 (O&M) dated 06.05.2020. Haryana Govt. vide Gazette Notification No. Leg. 15/2020 dated 15" May, 2020 has notified that the 50% of the 20% seats reserved for Schedule Caste for admission in any Govt. Educational Institution shall be set aside for candidates belonging to Deprived Schedule caste. (Annexure XV) Accordingly for admissions to BAMS/ BHMS courses of the session 2021-22 the reservation to Schedule Caste category will be followed as per Haryana Govt. notification dated 15" May, 2020 (Annexure XV) Where a seat set aside for candidate from Deprived Schedule caste for admission in Govt. | educational institution is not filled up in any academic year due to non-availability of candidate of Deprived Schedule caste possessing the requisite qualifications, the same shall be made available to candidate of Schedule caste. It is further notified that all the students desirous of seeking admission to BAMS/BHMS Courses will have to get registered online through authorized admission web portal. The details of authorized web portal including dates for inviting online applications and Counseling schedule shall be duly publicized as well as uploaded on the website of Shri Krishna AYUSH University, Kurukshetra ie. www.skau.ac.in. Detailed schedule and procedure will be announced later on and the candidates are required to regularly visit the website as stated above. ‘The Registration cum Counseling fee shall be as under: (Non-Refundable) 1) Rs. 2,000/- for Unreserved Category. 2) Rs. S00/- for SC/D-SC/BC/EWS/FF/ESM (Alll reserved) Category of Haryana. 3) Rs. 500/- for SC Category of UT Chandigarh 4) Rs. 500/- for Physically Handicap (PwD). 5) Rs. 2,000/- for all Reserved Category of Other states of India not included in 2), 3) & 4) 6) Rs. 2,000/- for any Central Nominee Seat reserved by Ministry of Ayush, New Delhi/NCISM. 7) Rs. 10,000/- for NRI Category. ‘The candidates are required to regularly visit the website as stated above for updates. ‘* A candidate for admission to BAMS/BHMS Courses in Govt/Govt. Aided Ayush Colleges and Open Merit Category (State quota) Seats in Private Ayush Colleges will be eligible if he/she: i. isacitizen of India The candidates, who are bonafide residents of Haryana as per instructions issued by the Chief Secretary to Govt. Haryana and who/whose parents produce(s) Haryana Residence Certificate as per Government instructions given in Annexure —- IX, X, XI (A, B, C, D, E) or any modification issued by competent authority from time to time. iii. AIL candidates (General/SC/D-SC/BC-A/BC-B/Benchmark _disabilities/EWS/ESM/FF) desirous of seeking admissions in any category of seats should fulfill the minimum eligibility criteria/qualifications/qualifying criteria as prescribed in the information bulletin for national Eligibility-cum-Entrance Test (NEET) issued by NTA for the Academic year Page 2 of 50 2021-22 and as per regulations of NCISM/NCH, New Delhi issued from time to time. No candidate who has failed to obtain the minimum eligibility marks (as specified in NEET UG-2021) shall be eligible for admission to BAMS/BHMS courses. iv. In case of Shri Dhanwantry Ayurvedic College Chandigarh all candidates belonging to different reserve categories would submit the relevant documents issued by the concemed ‘competent authorities. © For Management category, candidates from All Over India shall be eligible, irrespective of their State of domicile and place of study. Note: The candidate shall have to bring in all the relevant certificates/ documents, in original, as per Annexure-XII at the time of document verification without which their candidature will not | be considered for admission to BAMS/BHMS course. Attested photocopies of certificates/documents will not be considered valid for the purpose of admission. ‘After commencement of UG courses if a candidate has joined the Course/ Institute, leaves the course after the three days prior to the last date of admission as prescribed by NCISM/NCH, New Delhi, (eg. 18.12.2021 as prescribed by NCISM/NCH ie. on/after 15.12.2021), then he/ she shall have to pay entire course tuition fee of the respective college. In this regard the candidates would {ill the BOND with the concerned college at the time of reporting for admission. a Procedure for Admission to State Quota seats in Govt/Govt. Aided and to Open Merit category seats (State quota seats) in Private Ayurvedic and Homoeopathic Colleges of Haryana including those under Private/Deemed Universities located in the State of Haryana and UT Chandigarh is given as under - ‘The admissions under above stated categories among all the registered candidates on the admission web portal will be made online on the basis of Haryana State Merit list prepared on the basis of NEET 2021. Gi) ‘The schedule of counseling, admissions and start of classes shall be inconformity with the schedule laid down by NCISM/ NCH (Ministry of AYUSH, Government of India and State Government. Gi) ‘Candidates applying on the basis of NEET UG 2021 should fulfill the eligibility criteria for being granted admissions as fixed under NEET UG 2021. oo) For admissions under ESM category, preference will be given as per FNo.6(1)/2017/D(Res.11) Dated May 21, 2018. (Annexure ~ XX) @) The choice of the course/institution shall be filled by the candidate on the online web portal. The choice of course/Institute given by the candidate will be considered final. wi The allotment of the institution/course shall be made strictly as per merit prepared/drawn on the basis of merit of NEET-UG-2021 of the candidate in the State List/All India List as the case may be. In case of a tie between two or more candidates having equal marks, the inter-se ranking of such candidates will be based on NEET-2021 rank. (wii) The candidates who have been allocated seat will have to appear in person for document verification (with all original documents and two scts of self-attested Photostat copies) before the admission committee of the Concer College. The allocation list of the candidate as per merit list will be uploaded on the admission web portal. The detailed schedule will be announced later on and the candidates are required to regularly visit the website as stated above for updates. The allocation of the seat online shall give no legal right to the candidate for the said seat and the scat shall be confirmed only after document verification as per the specific time period notified. The ‘Admission Committee of the Concer College reserves the right to cancel the allocation of seat allotted to a candidate in case of incomplete/invalid documents. If in case any of the documents found false/ wrong the admission shall not be considered however the decision regarding the eligibility/ ineligibility’ cancellation of admission will be taken by the Admission Committee of SKAU. Further, the admission Committee is empowered to take decision in all admission related disputes. Note: I. The Additional Chief Secretary to Government of Haryana, Department of Health &AYUSH, will be the final Appellate Authority for the decisions taken by the Admission Committee and 2 day’s time limit for filing appeal and procedure thereof is provided and his decision shall be the final. Il. Personal appearance of the candidates along with all original documents in front of the admission committee of the Concern College shall be compulsory. Note: Due to COVID impacted scenario the schedule may be changed and intimated time to time on University web portal www.skau.ac.in and authorized official admission web portal. II, Final number of seats in each course/institute under each category will be available on the website of Shri Krishna AYUSH University, Kurukshetra (www.skau.ac.in), IV. In case there is vacancy after the first round of counseling due to any reason, such seats will be filled up during the second round of counseling. a.) Fresh registration shall be allowed for participating in the second round. Fresh candidates will have to register themselves on the admission web portal along with the necessary registration fee mentioned above. The candidates are advised to regularly visit the website of Shri Krishna AYUSH University, Kurukshetra- www.skau.ac.in and the admission web portal for updates. b.) The candidates, who have already registered themselves for first round and wish to participate in the second round, shall not be required to register again. However, they shall have to give their willingness/option by filling-up of the College/course choice again to participate in the second round of counseling online. c.) The candidates who have joined the allotted seat in the first round shall have a right to retain already allotted seat and this shall be changed only if he/she gets an updated and opted seat during second round. However, the candidates who wish to participate in the 2" round of counseling will have to submit their choices/preferences of Colleges afresh again. Candidates who have been allotted seat (College) in first round should give the fresh choices in order of preferences for the College/course in which they wish to upgrade themselves. 4.) The candidate who wish to participate in the second round of counseling and want to opt for State Quota Seats in Shri Krishna Govt. Ayurvedic College, Kurukshetra & MSM Institute of Ayurveda, Khanpur Kalan, Gohana, Sonepat only shall be required to submit Rs.5,000/- {Rs.2500/- for SC/D-SC/BC/EWS/PWD/ESMIFF* of the State of Haryana (*if applicable)}, as Security Fee at the time of fresh registration/choice filling for 2"! round of counseling, If the candidate wishes to opt for State Quota seats in Government as well as/or State Quota Seats/ Management Quota seats in Private BAMS/BHMS Institutes/Universities then he/she will have to deposit Rs.50,000/-, as Security Fee at the time of fresh registration/choice filling for 2" round of counseling. If.a candidate does not deposit the requisite amount of Security Fee then he/she shall not, bbe eligible to participate in the second round of counseling. This amount shall be later ADJUSTED in the fee of first year course, if the candidate joins the allotted seat; The Security money will be FORFEITED, if a candidate who has been allotted a seat and does not join the respective institution or surrender the seat due to Page 4 of 50 ‘any unforeseen reason before and after joining. Also the Security Money will be forfeited, | if the admission gets cancelled due to any reason on the part of student. i.e in case the candidate gives wrong information at the time of registration on the basis of which a seat may be allotted and later cancelled by the Admission Authorities at the time of reporting or fails to produce the required documents at the time of admission (within the stipulated time) and REFUNDED (after following the process of refund) in case no seat is allotted, €.) The allotment of the course/institution shall be made strictly as per merit prepare/drawn on the basis of merit of NEET-UG-2021, and the choice/preference of the course/institute filled up by the candidate on the online portal shall be taken as final. £) Before filling up of the choices/preference read these points clearly — i) Before filling the choices/preference first segregate the Ayurvedic and Homoeopathic Colleges. ii) In this counseling only one private Homoeopathic College is participating (J. R. Kissan Homoeopathic Medical College & Hospital, Rohtak). Rest all are Govt./Govt, aided/Private/Private (Deemed) Universities Ayurvedic colleges iii) Then segregate Govt./Govt. aided/Private/Private (Deemed) Universities colleges iv) Check their tuition fees V) Check the place of the Institute vi) There are two colleges which are only for Girls. Rest all are co-ed. Consider this, also before filling. vii) You need not have to fill all the colleges in your choices/preferences. Only filling of one college is mandatory. Rest all can be filled as per your preference. 8.) The Security money, mentioned in d.), will be FORFEITED, if a candidate who has been allotted a seat and does not join the respective institution or surrender the seat due to any unforeseen reason before and after joining. Also the Security Money will be forfeited if the admission gets cancelled due to any reason on the part of student. ie. in case the candidate gives wrong information at the time of registration on the basis of which a seat may be allotted and later cancelled by the Admission Authorities at the time of reporting or fails to produce the required documents at the time of admission (within the stipulated time), however they will be eligible to participate in the mop-up round. h,) If the seats still remain vacant even after the two rounds of counseling then left over seats will be filled up via Mop-Up Round as per direction of Ministry of Ayush, Government of India/NCISM/State Goverment and as per SKAU, Kurukshetra notified Schedule, The candidates who join the seat allotted to them during the first or second round of All India Counseling/State Counseling shall not be eligible to participate in the Mop-up Round. 4.) Fresh registration shall be allowed for participating in the Mop-up round. Fresh candidates will have to register themselves on the admission web portal along with the necessary registration fee mentioned above. The candidates are advised to regularly visit the website of Shri Krishna AYUSH University, Kurukshetra- www.skau.ac.in and the admission web portal for updates. ,) The candidates, who have already registered themselves for first or second round and are eligible to participate in Mop-up round as per the laid conditions and wish to participate in the Mop-up round, shall not be required to register again. However, they shall have to give their willingness/option to participate in the Mop-up round of counseling online, by filling up the choices/preferences again. V. Seats remaining vacant under State Quota Seats in Private Colleges/Universities after two rounds of Counseling will be converted to Management Category seats and filled up as per directions of State Government and Shri Krishna AYUSH University Kurukshetra on the basis, of All India Merit of NEET-2021. Shifting to other institutes would be allowed only in 2"! round of counseling and not thereafter. (1, No candidates would be allowed to participate in Mop up round counseling if he/she have already taken admission in any other institute under this University counseling/ All India Counseling, If such candidates want to participate in mop up round counseling Page 5 of 50 then he/she would have to get his/her admission cancelled (with documentary proof) | before participating in mop up round counseling, their Security Fees (mentioned in point IV d) submitted to the University shall stand forfeited. However, the candidates who to participate in the Mop-up round of counseling will have to submit their preferences afresh again. VIII. The candidate who wish to participate in the mop-up round of counseling and want to opt for State Quota Seats in Government/(Government aided Ayurvedic Institutes only shall be required to submit Rs.5,000/- {Rs.2,500/- for SC/D-SC/BC/EWS/PWD/ESMIFF* of the State of Haryana (*if applicable)}, as Security Fee at the time of fresh registration/choice filling for Mop-up round of counseling, If the candidate wishes to opt for State Quota seats in Government as well as/or State Quota Seats/ Management Quota seats in Private BAMS/BHMS Institutes/Universities then He/she will have to deposit Rs.50,000/-, as Security Fee at the time of fresh registration/choice filling for Mop-up round of counseling. If a candidate does not deposit the requisite amount of security fees then he/she shall not be eligible to participate in the mop-up round of counseling. This amount shall be later ADJUSTED in the fee of first year course, if the candidate joins the allotted seat; The Security money will be FORFEITED, if a candidate who has been allotted a seat and does not join the respective institution or surrender the seat due to any unforeseen reason before and after joining. Also the Security Money will be forfeited, if | the admission gets cancelled due to any reason on the part of student. i.e. in case the candidate gives wrong information at the time of registration on the basis of which a scat may be allotted and later cancelled by the Admission Authorities at the time of reporting or fails to produce the required documents at the time of admission (within the stipulated time) and REFUNDED (after following the process of refund) in case no seat is allotted. 1X. Process for Admission to Management Category seats in Private Ayurvedic and Homoeopathic Colleges of Haryana including those under Private/Deemed Universities 12.1 ‘Similar procedure as followed for Counselling of BAMS/BHMS courses for filling up State Quota seats in Government/Government Aided, Ayurvedic and Homoeopathic Colleges and Open Merit Category seats in Private Ayurvedic and Homoeopathic Colleges as described under Section 11 above shall be followed for admissions to Management Category seats also. However, the merit shall be drawn on the basis of All India Merit of NEET UG- 2021. 3 | Process for Admission to All India Quota seats in Private Ayurvedic and Homoeopathic Colleges of Haryana including those under Private/Deemed Universities located in the State of Haryana and UT Chandigarh is given as under. 13.1 Counselling for All India quota seats of ASU&H UG courses of Government, Government Aided ASU&H colleges, National Institutes, Central Universities and Deemed Universities shall be conducted by AACCC, Ministry of AYUSH. 132 Counselling for all India quota seats of ASU&H UG courses of Private Institutions other than Deemed Universities under their jurisdiction shall be conducted by respective counselling authority of State/UT Government. rs ‘State/(UT counselling authorities shall conduct minimum Two Round of counselling for all India quota (Al) UG seats of Private ASU & H Institutes and after 02nd Round, if AIQ seats are not filled, these vacant seats shall be converted into the State(JT Government quota seats and same will be filled up as per State Government rules. 13.4 There will be no requirement for any domicile certificate for allotment of seat in AIQ UG seats of Private ASU & H Institutes, 135 Reservation for allotment of AIQ UG seats in Private ASU & H Institutes: all AIQ UG seats of Private ASU & H Institutes are open in nature. However, relaxation in qualifying criterion shall be provided category wise as mentioned in relevant regulations. Page 6 of 50 && ‘Admission to NRI Category (NRIs/PIOs/OCIs/Foreign Nationals) ‘All admissions under NRI category seats shall be as per merit of NEBT-2021. Person of Indian Origin (PIO), Overseas Citizen of India (OCI) and Foreign Nationals who are NEET qualified can also apply under the NRI category, however for admission under NRI quota Foreign Nationals shall be considered only for any vacant seat left after exhausting the list of NRIs/PIOs/OCIs. Preference of admission shalll be as given below: @ Actual NRIs/PIOs/OCIs Candidates who originally belonged to the State of Haryana (for the colleges situated in the State of Haryana)&UT Chandigarh (for only Shri Dhanwantry Ayurvedic College, Chandigarh) respectively as the case may be. Gi) Children of NRIS/PIOs/OCIs who originally belonged to State of Haryana (for the colleges situated in the State of Haryana)&UT Chandigarh (for only Shri Dhanwantry Ayurvedic College, Chandigarh) respectively as the case may be. (iii) Actual NRIs/PIOs/OCIs Candidates who originally belonged to an Indian State or Union Territories other than Haryana &UT Chandigarh respectively as the case may be. (iv) Children of NRIs/PIOs/OCIs who originally belonged to an Indian State or Union Territories other than Haryana &UT Chandigarh respectively as the case may be. Note: ‘© If sufficient number of eligible candidates under first category is available then they will be admitted first even if students under subsequent category are higher in merit. ‘© The NRI students will have to give a Bank Guarantee/Surety Bond for the balance of fee, if they opt to pay the fee in installment as provided. «Any seats remaining vacant under NRI category after the second round of Counseling shall g0 to the NEET qualified eligible foreign nationals. However, if the seats still remain vacant, these shall be converted to General Category seats in Govt/ Govt. aided B.A.MS/ BIH.MS. Colleges and Management Category seats in Pvt. Colleges. 15. | The mode of payment will be intimated on the website before filling up of the form for all kind of fees like Registration fee, Security fee, Tuition fee, etc. 16._| Fee Structure The fee structure for BAMS/BHMS courses in all Ayurvedic and Homoeopathic Colleges of the state of Heryana & UT Chandigarh are as under: For BAMS Course 1. Shri Krishna Govt. Ayurvedic College, Kurukshetra (Haryana) Tuition Fees Other Charges Total 5,0007- 10,482/- 15482 2. MSM Institute of Ayurveda, Khanpur Kalan, Sonepat (Haryana) — Rs, 67500/- per annum (payable annually/semester wise as per policy of Institute). Any special provision for the advancement of any economically weaker sections of citizens other than the classes mentioned in clauses (4) and (5); in so far as such special provisions relate to their admission to educational institutions including private educational institutions, whether aided or unaided by the State, other than the minority educational institutions referred to in clause(1) of article 30, which in the case of reservation would be in addition to the existing reservations and subject to a maximum of ten per cent of the total seats in each category. =xplanation- For the purposes of this article and article 16, “economically weaker sections” shall be such as may be notified by the State from time to time on the basis of family income and other indicators of economic disadvantage.” Amendment of article 16 In Article 16 of the Constitution, after clause (5), the following clause shall be inserted, namely:~ (6) Nothing in this article shall prevent the State from making any provision for the reservation of appointment or posts in favour of any economically weaker sections of citizens other than the classes mentioned in clause (4), in addition to the existing reservation and subject to a maximum of ten cent of the posts in each category”. In the wake of above enabling provisions, State Government has considered the matter and decided to provide benefits of reservation on a preferential basis in Civil Posts in all the Page 24 of 50 Departments/Boards/Corporations/Local Bodies and in Admissions to Government/Government Aided Educational Institutions to those Economically Weaker Sections (EWSs) who are not covered under the existing scheme of reservation for the Scheduled Castes, Backward Classes (Block-A) and Backward Classes (Block-B). 2. QUANTUM OF RESERVATION: The persons belong to EWSs who are not covered under the existing scheme of reservation for scheduled Castes, Backward Classes (Block ~ A) and Backward Classes (Block-B) shall get 10% reservation in direct recruitment to Group A,B,C and D posts in the Departments/Boards/Corporations/Local Bodies of Government of Haryana and also in admission to GovernmenvGovernment Aided Educational Institutions in the State of Haryana. 3. EFFECTING RESERVATION-ROSTER POINT: 34 Direct recruitment in case of Group-A & B Roster point No. 11-20-30-40-51-60-70-80-90 and 99 32 Direct recruitment in ease of Group-C & D Roster point No. 4-14-24-34-43-53-66-76-82 and 94 33 Where in any recruitment year any vacancy earmarked for EWS cannot be filled up due to non-availability of a suitable candidate belonging to EWS, such vacancies for that particular recruitment year shall not be carried forward to the next recruitment year as backlog and will be filled from unreserved category. 34 Persons belonging to EWS selected against the quota for persons with benchmark disabilities/ex-servicemen shall be placed against the roster points earmarked for Ews. 4. CRITERIA OF INCOME & ASSETS: 4.1 Persons who are not covered under the exiting scheme of reservation for Scheduled Caste, Backward Classes (Block-A) and Backward Classes (Block-B) and whose family has gross annual income below Rs. 6.00 lakh (Rupees six lakh only) are to be identified as EWSs for benefit of reservation. Income shall also include income from all sourees i.e. salary, agriculture, business, profession etc. for the financial year prior to the year of application. 4.2 Also persons whose family owns or possesses any of the following assets shall be excluded from being identified as EWS, irrespective of the family income:- i, 5 acres of agricultural land and above; ii, Residential flat of 1000 sq ft. and above; Residential plot of 100 sq. yards and above in notified municipalities; Residential plot of 200 sq. yards and above in areas other than the notified municipalities. v. Total immovable assets owned are valued at Rs. One Crore or more. 4.3 The property held by a “Family” in different locations or different places/cities would be clubbed while applying the land or property holding test to determine EWS status. 4.4 The term “Family” for this purpose will include the person who applies for benefit of reservation, his/her parents, spouse as well as children and siblings below the age of 18 years. 5. INCOME _AND_ASSET_CERTIFICATE_ISSUING AUTHORITY AND VERIFICATION OF CERTIFICATE: 5.1 The benefit of reservation under EWS can be availed upon production of an income and Asset Certificate issued by a competent Authority. The competent Authority for EWS Income and Asset Certificate shall be Tehsildar of the area where the applicant normally resides. 5.2. The prescribed format for EWS income and Asset Certificate shall be as provided at Annexure-I. 5.3 The Officer who issues the certificate would do the same after carefully verifying all relevant documents following due process as prescribed by the State. Page 25 of 50 54 55 The crucial date for submitting Income and Asset Certificate by the candidate may be treated as the closing date for receipt of application for the post, except in cases where crucial date is fixed otherwise. ‘The appointing authorities should, in the offer of appointment to the candidates claiming to be belonging to EWS, include the following clause:- “The appointment is provisional and is subject to the income and asset certificate being verified through the proper channels and if the verification reveals that the claim to belong to EWS is fake/false the services will be terminated forthwith without assigning any further reasons and provisions of the Indian Penal Code for production of fake/false certificate." ‘The appointing authority should verify the veracity of the Income and asset certificate submitted by the candidate through the certificate issuing authority. 5.6 Instructions referred to above should be strictly followed so that it may not be possible for ‘an unscrupulous person to secure employment on the basis of a false claim and if any person gels an appointment on the basis of such false claim, her/his services shall be terminated and penal action shall also be invoked. ADJUSTMENT AGAINST UNRESERVED VACANCIES: A person belonging to EWS cannot be denied the right to compete for appointment against, an unreserved vacancy. Henceforth, the following categories of persons would be eligible for the grant of Resident Certificate: i) Candidates, who have passed the examination qualifying there for selection in an institution from a school/college in Haryana. ii) Children / Wards (if parents are not living) / Dependents: - (@ Of the regular employees of Haryana State posted in or outside Haryana State or working on deputation; (b) Of the regular employees of the statuary bodies! corporations established by or under an act of the State of Haryana who are posted in Chandigarh or in Haryana or outside Haryana" (©) Of the reguiar employees of the Government of India posted in Chandigarh or in Haryana in connection with the affairs of the Haryana Government; iii) Children /Avards (if parents are not living)/dependents of persons who after retirement have permanently settled in Haryana and draw their pensions from the treasuries situated in the State of Haryana. iv) Children/wards (if parents are not living)/dependents of pensioners of Haryana Government irrespective of the fact that the original home of the retiree is in a state other than Haryana or hehas settled after retirement in or outside Haryana; ¥) Children/Wards (if parents are not living)/dependents of persons, who have permanent home in Haryana and include persons who have been residing in Haryana for a period of not less than 15 years or who have permanent home in Haryana but on account of their occupation they are livingoutside Haryana; vi) The wives of such persons who are bonalide residents of Haryana irrespective of the fact that they had belonged to any other State before marriage; vii) Persons who were bom in Haryana and produce a certificate to that effect; provided that the parents) guardians (if parents are not living) of persons belonging to any one of the abovementioned categories are: a) Citizen of India; b) Produce an affidavit to the effect that they or their children/wards (if parents are not living)/dependents have not obtained the benefit of Resident in any other State. 2, All candidates claiming to be bonafide residents of Haryana should produce a Haryana Resident Certificate signed by the District Magistrate/General Assistant to Deputy Commissioner or Sub- Divisional Officer (Civil) of the District/Sub-Divisions to which the candidates belong. Government is of the view that the procedure be institutionalized by delegating powers at proper level for ensuring speedy disposal of | work without any harassment or exploitation, The present modification of the policy also aims at simplifying the procedure for obtaining certificate by an individual falling under the reserved categories. ‘The matter has also been reconsidered in depth by the State Government in view of the problems being faced by the Government employees in obtaining these certificates. With a view to improve the existing system in issuing various certificates, it has been decided by the Government that henceforth Circle Revenue Officers (Tehsildar, Naib-Tehsildar-cum-Executive Magistrate) concerned will be authorized to issue Resident as well as Caste Certificates (SC/BC/OBC) after getting the verification done through the subordinate revenue staff in case of applicants residing in the rural area and trough the Executive Officer/Secretary of the concemed Municipal ‘Committee/Municipal Council/Municipal Corporation concerned in case of applicants resi urban area, It has further been decided that in case of Haryana Government employees serving in the offices located at Chandigarh/Panchkula and residing at ChandigarlvPanchkula, the Resident certificates and caste certificate to SC/BC employees and for their children, may be issued by their respective Heads of Departments also. ‘The validity of Resident Certificate issued by the competent authority shall be as long as the holder of this certificate maintains his residential address in Haryana State. SC certificate once issued shall be valid as long as the caste is not removed from the Schedule of the Constitution and BC certificate shall be valid for life from the date of issue of the certificate or till the applicant does not fall into creamy layer category as defined from time to time. The applicant applying for BC certificate would also submit a self-declaration on simple paper that he does not fall under creamy layer category. The format for this declaration is given at Annexure'A’ However, if the certificate has been obtained by fraud or misrepresentation or concealment of facts or by some other means, the said certificate shall be declared as invalid/ and benefit taken by the applicant will be withdrawn and a criminal case shall be registered against the applicant misrepresenting the facts as well as against the guilty officers/officials, if any. In addition, Social Justice & Empowerment Department, Haryana is being, directed to finalize the __ modalities and procedure to constitute the Scrutiny Committee. ‘The files relating to Caste and Resident certificate shall be retained for 10 years and Register shall be retained permanently, The performa of the application form, Register and SC/BC certificates prescribed by the Government shall be followed by all the Departments/Institutions in letter and spirit as it has come to the notice of the Govt. that some Departments/institutions demand such certificates in performa which are at variance with the performa in which these certificates are being issued by the competent authorities (Tehsildar/NaibTehsildar/HODs). Ist Nov- 10th Nov. every year. Verification by: Sarpanch/ Namberdar in case of rural areas and Municipal Councillors in case of urban areas. Verification by Patwari in case of rural areas /EO/Secy.(MC) any other officer/official authorized by the local body for the purpose in case of urban areas. Upto 30" ‘November every year. The schedule will be finalized bythe concerned Deputy ‘Commissioner in this regard. It has been further decided that in case of SC/BC students claiming benefit under various welfare schemes upto Class IX, the benefits will be given by the Head Master/Head Teacher after getting the verification done from Sarpanch/ Namberdar/MC and a caste certificate issued by the ‘CRO(Tehsildar/ NaibTehsildar) may not be demanded for this purpose by the School authorities. The matter regarding issue of income certificate to the students for claiming various benefits ineducational institutions has been considered and it has been decided that in future the income certificate for educational purpose will be issued by the CRO (Teehsildar/Naib'Tchsildar concerned) and income certificate for other purposes by the SDO concerned taking into account income of the applicant from various sources including agriculture, trade, profession, salary etc. The verification will be got done through the subordinate revenue staff in case of applicants residing in rural areas and through the Executive Officers/Secretary ofthe concemmed Municipal Committee/Council/Municipal Corporation in case of applicants residing in urban areas. thas also been brought to the notice of the Government that when posts are advertised, fairlylarge ‘number of candidates applies for such posts and Haryana Public Service Commission/Haryana Staff Selection Commission /Department demand attested copies of Resident/Caste certificates and other documents from the candidates. This creates not only financial problems for the unemployed youths but also increases the work load in the offices. Similar is the position in case of admission to ‘educational/professional Engineering institutions. To give relief to the public, it has been decided that at the time of applying for job or for admission in educational institutions including ‘technical/professional institutions ete. self-attested photo copy of the certificate about the residence and caste status shall be sufficient and at the time of final interview/selection, original papers including castes and Resident certificate issued by the competent authorities may be obtained/examined/inspected by the concerned departments/institutions and attested copies thereof be kept in record. The fact may also be cross _checked/ verified at the time of verification of the antecedents of the applicants before he/she joins the Government service. Similar practice will be followed for degrees/mark sheets/other certificates of academic qualifications.
