Re: Legal Notice for recovery of an amount of

Rs. 23, 61, 390/- (rupees twenty three lacs sixty one
thousand three hundred ninety only) (“The Notice”)

We have been retained by GHV Advanced Care Pvt. Ltd.

(“Pristyn Care”), having its registered office at 3rd Floor,
Capital Cyberspace, Ullahvas, Sector 59, Gurugram-122102
(“The Company”) who have advised us:

1. That the Company is duly incorporated under the

provisions of the Companies Act 2013 and is engaged in
the business of providing patient-centric healthcare
 services with a Pan- India business eco-system of 80+
clinics, 400+ partner hospitals, and 140+ in-house super
speciality surgeons for Proctology, Urology, ENT,
Gynaecology, Vascular, Laser, and Laparoscopic surgeries.

2. That you the addressee are running amongst other units,

a registered & licensed hospital, Horizon Prime Hospital
located at Vibgyor, B-Wing, Patlipada, Ghodbunder Road,
near Hiranandani Estate, behind Ritu Nissan Showroom,
Thane (W) -400607 Maharashtra.

3. That an Agreement dated 23.06.2021 was executed

between the Company and you Addressee which was
signed by Dr. Ria Vaidya whereunder it had been agreed
between the parties thereto to jointly provide health care
services upon terms and conditions including financial
term contained therein.

4. That in the routine course of work activities under the

aforesaid agreement dated 23.06.2021, payment from
your side accrued unto the Company as per the accounts
maintained with regard to such work and on mutual
reconciliation an amount of Rs. 23, 61, 390/- (rupees
twenty three lacs sixty one thousand three hundred ninety
only) has been found due and payable by you the
Addressee to the Company.

5. That the Company raised bills from time to time and has
sent reconciliation working on email of the due and
 payable receivable from you periodically, latest being vide
email dated April 29, 2022.

6. That you the addressee have thus far failed to make

payments of the principal balance of Rs. 23, 61, 390/-
(Rupees twenty three lacs sixty one thousand three
hundred ninety only).

7. That the Company has requested you, the addressee

several times through telephonic messages, personal
visits and emails for release of the outstanding payments
but you the addressees have been denying making
payment of the same by raising extraneous
disputes/issues which have no bearing at all on the
contractual relationship between you the addressees and
the Company.

8. That through this legal notice you are hereby called upon
to pay unto the Company Rs. 23, 61, 390/- (Rupees
twenty three lacs sixty one thousand three hundred ninety
only) within a period of 5 (five) days from the date of
receipt of this legal notice.

9. Further take notice that in case the needful is not done in

terms hereof, you would also be liable to pay interest on
the amounts due, such interest being payable @ 15% per
annum, said being the prevailing rate of commercial
borrowing and lending.
Be further informed that in case of failure to carry out the
mandate per this notice, the Company would be constrained to
initiate appropriate legal proceedings as may be advised for
recovery of the aforesaid sums of money alongwith interest as
indicated hereinabove.
Needless
s to say, any such legal action(s) if necessitated would
be entirely at your risk & cost and the consequences shall be
borne by you alone.
You are also called upon to reimburse unto the Company a sum
of Rs.22,000/- being the cost incurred by it towards issuance of
this Legal Notice.
