FORMULATE YOUR STATEMENT OF THE PROBLEM

I. Title : MY HUSBAND’S LOVER:

A Critical Analysis on the Proposed Bill Penalizing Extra-
Marital Affairs of Lovers of Same Sex

Statement of the Problem

The foremost focus of this research is to resolve whether or not the My Husband’s Lover Bill
is constitutional in its attempt to broaden the provisions of the Revised Penal Code by including
same-sex extramarital affairs in promoting gender equality, especially now that society
recognizes the LGBT (lesbian, gay, bisexual, transgender) community.
To further determine the constitutionality of the bill, the following questions must be
answered and explained:
a.) Does the proposed law violate substantive rights, since it will amend obsolete
provisions of the Revised Penal Code?
b.) Does the proposed law violate the constitutional guaranty of the equal
protection of laws?
c.) Is the proposed law in accordance with the mandate of the Constitution to
uphold and preserve the sanctity of marriage?
