2
How Can I Avoid Probate?
In many cases, property can be transferred without probate. For example,
IRAs, insurance policies, and some other assets may be transferred through a
beneficiary designation. If you are on title with another person as joint tenant
with right of survivorship, under state law property rules, the real property
will be transferred to the survivor. Finally, many Trusts hold real estate, and
that property will be transferred to the Trust beneficiary.
3
Who are Primary Beneficiaries of a Will?
One of the first decisions that you make is to decide who receives specific
land, homes, or personal items. These heirs are your primary beneficiaries.
4
When Should You Select a Contingent Beneficiary?
If you have given a primary beneficiary a specific item like a family heirloom,
it is a very good idea to select a contingent beneficiary. However, if you do
not, then the property simply is part of the residue of your estate. After
distribution of specific property and payment of costs and taxes, the balance
of the estate property is called the residue.
5
Why Should You Create a Trust for Minor Beneficiaries?
Receiving property at a young age frequently leads to indulgence and serious
problems. If you plan to leave property to minors, it is important to select a
Trustee to manage the property.
page 39
E S TAT E P L A N N I N G I N F O R M AT I O N
6
Should You Forgive Your Children’s Debts?
Many parents pass away with outstanding loans to children. If you do decide
to forgive debts to children or other family members, you may also want to
include an offsetting gift of cash or other property to those family members
who do not receive any debt forgiveness. In this way, you can keep the total
benefits under the Will even among your children or other heirs.
7
Why is Selecting a Guardian for Minor Children so Important?
The guardian will perform most of the functions of a parent in teaching the
child, selecting his or her school, providing ethical or religious education and
many other aspects of the child’s life.
8 If You Have Minor Children and a Substantial Estate, Should the Same
Person be Guardian of Your Children and Trustee of Their Trust?
If there is a substantial property inheritance for the child, it is quite risky
to transfer both the guardianship and the property to the same individual.
After the parents pass away and the guardian has control of the property, the
temptation to spend income and principal for personal benefits rather than
for the care of the child is extremely strong. A better plan is to select another
person or commercial institution as Trustee to manage the property. The
Trustee performs an important check-and-balance role. He or she can also
distribute income, and if needed, principal for the benefit of the children.
9
Should Medical Papers and a Living Will Be Kept in Your Safety Deposit
Box?
No. If you are ill and in the hospital, the durable power of attorney for
healthcare or advance healthcare directive will need to be available to your
healthcare agent. They may not have access to your safety deposit box. Your
healthcare powers should be given to a friend or advisor so they are available if
you are in the hospital and need their assistance.
11 Is a Family Member Who Lives in Your Area a Good Choice for Your
Healthcare Agent?
While you can select any family member who lives in another state as your
healthcare agent, it is helpful to select a person who is in the area so that he or
she is available if you need an immediate healthcare decision.

Will Your Personal Preferences on Pain Management Have Substantial
Impact on Your End-of-Life Care?
If you desire a high comfort level even though that leads to less mental clarity,
or prefer a more moderate or even low comfort level with greater mental
clarity, that will have great impact on the level of pain medication provided
to you.
13
For a Young Person with a Modest Estate, is a Will a Better Option than
a Trust?
For a young person with a modest estate, it is important to get started in the
estate planning process. A Will is the basic step and is much more reasonable
in cost than a Living Trust. However, if you own substantial real property, a
Trust may be a good addition, even for a younger person.
15
Does a Living Trust Protect You in Your Very Senior Years?
With a Living Trust, you normally serve as the initial Trustee and select the
successor Trustee. Your chosen successor will be able to take over if you are in
your very senior years and are ill or otherwise unable to manage your property.
This is a great comfort and protection for both you and your property.

I praise God for giving me a loving, caring, Christian helpmate in my spouse. She/He has been a
blessing to me, and a wonderful mother/father to our children. Knowing that we both share our faith
in Jesus as our Savior, we will praise the Lord forever in Heaven.
I pray that the Lord would guard and protect my children. You are very special to me and I thank
the Lord for you. I urge you to remain faithful to Christ until you are called home to be with the
Lord. I love you and I look forward to eternity with you in Heaven.
I pray that the Lord would shower His blessings upon my grandchildren. May the Holy Spirit guide
you along the narrow path of salvation through faith in Jesus Christ. I urge you to respect your parents
and honor them as your parents have honored me.
I recognize that all of my earthly possessions are a gift from God. Therefore, I have made provisions
in my Will to continue my Christian stewardship after I have gone to Heaven to be with the Lord. I
trust that what I offer as a gift will be blessed many times over by the Lord in building His Kingdom.
My heirs will receive, through me, gifts from God. May you always remember that everything you have
is a trust from God. Be good and wise stewards of His blessings, faithfully managing and returning to
Him a generous portion for the work in His Kingdom.

Our blessing to you, our children and grandchildren, is that you always recall how forgiving the Lord
is. Whatever comes your way, live daily in the assurance and renewal of forgiveness, practice this with
each other and never stop forgiving. Remember your Creator in the days of your youth and He will
sustain you as you grow old. Remember also that the Lord longs for a relationship with you. Jesus
Christ is the only way to Heaven. He knows your thoughts and understands your wants. Delight
yourself in the Lord and He will give you the desires of your heart (Psalm 37:4). Go to God as you
used to come to us as your earthly parents; your Heavenly Father will provide all your needs according
to His will for you (Philippians 4:19).
Please know that your parents lived imperfectly in the sufficiency of grace. It is God’s goodness that
covered our imperfections. We know that as we meet Him face to face, His judgment is mercy and joy.
When the seed of our bodies dies and falls to the ground, the mystery that God planted in us sprouts
in the new birth in eternity that He created. We bless you to live in a personal relationship with Christ
daily. As you walk through the days to come, think about and talk with God as He gives you time as
daily manna. Then you will be very near us.
Be joyful as you live and walk humbly with God – embracing others with the love of Christ. We bless
you with a special blessing in the [include unique qualities and vulnerabilities] that God gave to you.
Live out your vocations of [reference vocations] as if unto the Lord (Colossians 3:23). Nourish and
protect your family as a sign of God’s faithfulness and favor. Know that the turmoil and struggles you
encounter serve to strengthen you and make you more fit for His service.
Always be confident in sharing your faith and acknowledge your Lord Jesus before others. Use your
faith to teach the Lord’s law and the way of salvation to your children and grandchildren. Make this a
top priority for your life.
