I, JEZYL ESCONDE, of legal age, single, and living at Zone 4 Blk 8

Lot 9, Sunrise Village, Tiguma, Pagadian City, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me was Atty. Kate Valerie Anne S. Zamora

with business address at Zamora Law Office, Pagadian City. The
examination was also held at the same address. I answered her questions
fully conscious that I do so under oath and may face criminal liability for
false testimony and perjury.

PURPOSE: This affidavit/testimony of JEZYL ESCONDE is being

offered to prove that Plaintiff Michelle A. Vale Cruz gave oral and written
demands to Defendant Lanz Aidan L. Olives in default of his payment of
rentals.

1. Q: Please state your name and personal circumstances for the record.
A: I am Jezyl Esconde, 25 years old, single and a resident of Zone 4
Blk 8 Lot 9, Sunrise Village, Tiguma, Pagadian City.

2. Q: Do you know a certain Michelle A. Vale Cruz?

A: Yes. She is the plaintiff in this civil suit.

3. Q: How did you know her?

A: I know her because she was the occupant of the apartment next to
my house before she leased it to others.

4. Do you know a certain Lanz Aidan L. Olives?

A: Yes. He is the respondent in this civil suit.

5. Q: How did you know him?

A: I know him because he became the lessee of the apartment next to
my house sometime later in 2019.

6. Q: What happened on October 28, 2021?

 A: Michelle went to the apartment to ask for the payment of rentals.

7. Q: How did you know it happened?

A: I was in front of my house, hanging my newly washed clothes
when she arrived.

8. Q: What happened next?

A: They had an argument about the payment of rentals but Lanz
insisted that he was done paying.

9. Q: What happened next?

A: Michelle left but went back again some time on November and
again on December.

10.Q: What did she do that time?

A: She came to again ask Lanz for payment of rentals.

11.Q: Did Lanz pay that time?

A: I am not sure.

12.Q: Do you know about any written demand made by plaintiff?

A: Yes.

13.Q: How did you know about it?

A: The courier inquired at our house about a certain Lanz Olives.

14.Q: What happened next?

A: I asked the purpose of the inquiry and he said that a demand letter
is sent to him by Michelle Vale Cruz.

15.Q: What happened next?

A: I just told the courier that he lived next door.

16.Q: Do you have anything else to add?

A: None.

I, JOURDAN ATILLANO, of legal age, single, and living at Zone 1

Blk 5 Lot 5, Alta Tierra, Tiguma, Pagadian City, state under oath as follows:

PRELIMINARY STATEMENT

The person examining me was Atty. Kate Valerie Anne S. Zamora

with business address at Zamora Law Office, Pagadian City. The
examination was also held at the same address. I answered her questions
fully conscious that I do so under oath and may face criminal liability for
false testimony and perjury.

PURPOSE: This affidavit/testimony of JOURDAN ATILLANO is being

offered to prove that Plaintiff Michelle A. Vale Cruz tried to have the issue
of the payment of rentals amicably settled before the Lupon Tagapayapa of
Tiguma but Defendant Lanz Aidan L. Olives failed to appear.

1. Q: Please state your name and personal circumstances for the record.
A: I am Jourdan Atillano, 28 years old, single and a resident of Zone 1
Blk 5 Lot 5, Alta Tierra, Tiguma, Pagadian City, Barangay Captain as
well as Lupon Chairman of Brgy. Tiguma.

2. Q: Do you know a certain Michelle A. Vale Cruz?

A: Yes. She is the plaintiff in this civil suit.

3. Q: How did you know her?

A: I know her because she came to the Lupon Tagapayapa of Tiguma
to attempt to settle the issue of the payment of rentals with Lanz
Aidan Olives amicably.

4. Do you know a certain Lanz Aidan L. Olives?

A: No. I only know he is the respondent in this civil suit but I was not
able to personally see him.

5. Q: Why were you not able to personally see him?

A: He did not come to the supposed amicable settlement.
 6. Q: What happened?
A: As per the minutes of the meeting, he did not appear after having
been summoned thrice for the amicable settlement.

7. Q: Can you give me the details?

A: He was called to upon on January 20, 25 and 30, 2022 but he did
not appear.

8. Q: How can you prove that?

A: We can check the records of the minutes of the meeting.

9. Q: What happened next?

A: Since he did not appear, we advised Michelle to proceed with the
filing of the complaint.

10.Q: Do you have anything else to add?

A: None.
