Dear General Counsel Kamoutsas,
We write you in response to your request for further information on behalf of our client
John/Jane Doe (Doe) who would like to make a Section 68.087(3) voluntary original source
disclosure to the Office of the Attorney General and Department of Financial Services. Doe
supplements their Section 68.087(3) voluntary original source disclosure to the Office of the
Attorney General and Department of Financial Services dated March 10, 2022, and March 24.
2022. In our communication you were informed that per Doe’s information and belief
notwithstanding certifications to comply with Section 1006.38(5)-(7) pricing restrictions, some
out of State instructional materials publishers (Publishers) engage in a pattern and practice of

overcharging many Florida school districts resulting in false claims for payment being made
against the State.
Included with this letter as Exhibit 1 is a spreadsheet that describes the pattern of discounts
provided by McGraw Hill to various school districts across the state. As Florida Rule of
Administrative Code 6A-7.0710 states, “bid(s) must state the lowest price at which materials will
be furnished at the contract start date. Variations in price based on volume purchases are not
acceptable.”
Illustrating how the discounts work a specific example comparing Miami Dade Public
Schools (Miami Dade) and the School District of Lee County (Lee) is described further. Exhibits
2 and 3 are two purchase orders for the same product, one from Miami Dade and one from the Lee.
Exhibit 2 is a copy of the purchase order for Miami Dade for McGraw Hill’s Florida
Comprehensive Student Bundle with 5-year print/digital subscriptions. Exhibit 3 is a copy of the
purchase order for the Lee County McGraw Hill’s Florida Comprehensive Student Bundle with 5-
year print/digital subscriptions. The FSBD product numbers for these products are 03-527-0, 13-
527-0, 23-527-0, 33-527-0, 43-527-0 and 53-527-0. The first digit of the number represents the
grade level with 0 indicating kindergarten. For example, FSBD product number 23-527-0 is for
the 2nd grade version of McGraw Hill’s Florida Comprehensive Student Bundle.
Line-Item 1 3 in Exhibit 2 shows Miami Dade purchased 15,352 copies of FSBD number
23-527-0 at the list price of $154.68. Line-Item 4 shows that Miami Dade also received 3,075
copies of the same item for free. Line 2 5 in Exhibit 3 shows that Lee purchased 6,004 copies of
FSBD number 23-527-0 at the list price of $154.68. Line 6 shows 335 corresponding free copies.
Miami Dade received an effective price of approximately $128.87 for FSBD number 23-527-0.
Lee received an effective price of approximately $146.51 for FSBD number 23-527-0. At that
price Lee County was overcharged $111,819.96 on FSBD number 23-527-0.
Line-Item 5 in Exhibit 2 shows Miami Dade purchased 15,862 copies of FSBD number
copies of the same item for free. Line 7 in Exhibit 3 shows that the Lee purchased 6,255 copies of

copies of the same item for free. Line 9 in Exhibit 3 shows that Lee purchased 6,399 copies of
copies of the same item for free. Line 11 in Exhibit 3 shows that Lee purchased 6,534 copies of
Based on the comparison of Exhibits 2 and 3 the School District of Lee County was
overcharged $485,940.83 on McGraw Hill’s Florida Comprehensive Student Bundle with 5-year
print/digital subscriptions for grades two, three, four and five.
The overcharges are not limited to Lee County. In Franklin County for just the ELA
adoption last year and in just 1st grade through 5th grade, Franklin County was overcharged by
$10,233.04. In Hamilton County in just the ELA adoption last year and in just Kindergarten, 1st
grade, 3rd grade, 4th grade, and 5th grade, Hamilton was overcharged by $19,383.55. Madison
County was overcharged in ELA adoption last year only in 1st grade, and Madison was
overcharged by $17,496.00.
Larger counties are also overcharged when state textbook procurement rules are not
followed. For just the ELA adoption last year and in just Kindergarten and 1st grade, Miami-Dade
County was overcharged $1,245,888.88. For ELA adoption in Lee County last year and in just
Kindergarten through 5th grade, Lee County was overcharged by $842,703.28. Polk county
likewise in ELA adoption last year in kindergarten through 5th grade, Polk County was
overcharged by $731,568.74.
These examples based on comparison of the purchase orders show a potential overcharge
to the State of Florida of nearly 2.4 million dollars just on ELA in K-5 for only seven out of
Florida’s sixty seven school districts. As Florida Statute 1006.38 says, publishers must
“(f)urnish the instructional materials offered by them at a price in the state which, including all
costs of electronic transmission, may not exceed the lowest price at which they offer such
instructional materials for adoption or sale to any state or school district in the United States.”
Publishers must “(r)educe automatically the price of the instructional materials to any district
school board to the extent that reductions are made elsewhere in the United States.”, and Publishers
must “(p)rovide any instructional materials free of charge in the state to the same extent as they

are provided free of charge to any state or school district in the United States.” These variations in
pricing seem to violate that statutory mandate. The Publishers affirmative pledges to follow the
pricing statutes lead to the conclusion that false claims for payment were made against the State.
