RE: COMPLAINT AGAINST TRANSFER ORDER

I am writing this in reference to Marching Order Ref: Pol. 1/2/29/Vol.


V/127 dated 27th January 2021.

The said Marching Order is transferring me from Garissa Police Station to


Takaba Police Station. I wish to state that the transfer order is unjust and has
been issued unfairly for biased and malicious reasons.

I have sufficient reason to believe that the transfer order was issued following
an incident in which I was assaulted while on duty. This incident has already
been referred to you in my previous letter dated 15 th March 2021. I have
forwarded my complaint regarding this incident to your office which complaint
is pending investigations.

After I raised my complaints regarding the accused MOHAMMED FARAH


KARUR and the authorities about the incident, I have been singled out and
targeted by the same authorities who have conspired with MOHAMMED
FARAH KARUR to ensure I am transferred far away from Garissa. The accused
person is a very influential businessman in Garissa town and has the
capability of persuading and using the authorities in his favour. MOHAMMED
FARAH KARUR holds a personal resentment against me following the
aforementioned incident wherein he was the aggressor and I was the victim. I
believe that after he was charged in court, he managed to induce the
authorities into issuing the transfer order to ensure I would be too far away to
be able to follow up on my complaints about the incident.
Moreover, there is a very dubious coincidence in the manner and timing of the
marching order. As explained above, the incident wherein I was assaulted took
place on the 8th of January 2021 and I was hospitalized in the days following
the incident. The marching order was then prepared and readied for issuance
on the 27th January 2021 after the assault was already reported and booked.
Later, upon my recovery, I returned to my duties. At this time, the duty roaster
did not relieve me from any duty following the incident and I remained on the
roaster from January up to 9th April when I was removed. Despite the marching
order being issued in January, I was working normally in Garissa and
discharged my duties diligently. It wasn’t until I filed my complaint and it was
circulated to various departments that I was forcefully issued with the
marching order and removed from the duty roaster. I believe the act of
removing me from the duty roaster was a vengeful and prejudiced
counteraction by the authorities to my complaints. This a spiteful retaliation
vicariously orchestrated by the accused MOHAMMED FARAH KARUR.

Furthermore, the area where I am being transferred to is neither safe nor


convenient for me. The area is where I was born and raised and the area is
recurrently volatile due to two communities clashing against each other. The
transfer order would force me to move to an area where I would not be able to
perform my duties because I will be in constant danger of getting caught up in
violent clashes. There is no legitimate reason by the authorities to transfer me
to the area. I have been working in Garissa for many years. I also need to
remain in Garissa in order to follow up on my complaints. It is my
understanding that the accused shall be tried afresh and therefore my
presence here as the complainant will be crucial to ensure the case proceeds
without any complications.

I have contacted the authority concerned on the matter of investigation without


any help. Furthermore, I have been threatened by authorities that my salary
shall be withheld if I continue to file complaints. I have also been told that I
shall be transferred forcefully no matter where I take my complaint.

I am therefore asking for your office to intervene, cancel and/or suspend the
transfer order until all the issues in the complaint are sorted out. The transfer
order is biased, malicious and is aimed at victimizing me. It would be in the
interest of justice and fairness for my complaints to be taken into
consideration.

I hereby wish to file a formal complaint against Garissa Police Station for
unfairly issuing Marching Order Ref: Pol. 1/2/29/Vol. V/127 dated 27th
January 2021. I wish to ask that the marching order be withdrawn in view of
the aforementioned reasons.

I hope this complaint shall be duly considered.
