Parole and Probation Administration (PPA)

AGENCY
The Parole and Probation Administration is an attached agency under the Department of Justice
responsible for providing a less costly alternative to the imprisonment of first-time offenders who
are likely to respond to individualized, community-based treatment programs.
It was created by virtue of Presidential Decree No. 968 or "The Probation Law of 1976", to
administer the probation system. Under Executive Order No. 292, "The Administrative Code of
1987", which was promulgated on November 23,1989, the Probation Administration was
renamed "Parole and Probation Administration" and given the added function of supervising
prisoners who, after serving part of their sentence in jails are released on parole or pardon with
parole conditions.
On August 17, 2005, by virtue of a Memorandum of Agreement with the Dangerous Drugs
Board, the Administration performs another function of investigating and supervising first-time
minor drug offenders who are placed on suspended sentence pursuant to Republic Act No.
9165. Additionally, under RA 11362 or the "Community Service Act", offenders rendering
community service are also placed under its supervision.

MISSION
To rehabilitate and reintegrate persons on community-based connections for peace and social
justice.

MANDATE
The Parole and Probation Administration is mandated to conserve and/or redeem convicted
offenders and prisoners who are under the probation or parole system.

GOALS
The Administration's program is mandated by pertinent laws, and as such, sets to achieve the
following goals:
a) Promote the correction and rehabilitation of an offender by providing him with
individualized treatment;
b) Provide an opportunity for the reformation of a penitent offender which might be less
probable if he were to serve a prison sentence; and
c) Prevent the commission of offenses.

FUNCTIONS
To carry out these goals, the Agency, through its network of regional and field parole and
probation offices, performs the following functions:
a) to administer the parole and probation system;
b) to exercise supervision over parolees, pardonees, probationers, first-time minor drug
offenders under suspended sentence, and clients rendering community service; and
c) to promote the correction and rehabilitation of criminal offenders

FUNCTIONAL STRUCTURE

ADMINISTRATOR
Acts as Head of the Agency and Executive Officer of the Administration

DEPUTY ADMINISTRATOR
Assists the Administrator in such duties as may be assigned

LEGAL DIVISION
Provides legal opinion/advise/counsel to the Administration.

ADMINISTRATIVE DIVISION
Provides efficient and accurate management of disbursement and collection; provision of
general support services to the Central Office; information dissemination thru quadric media;

efficient and effective records management and communication dissemination; screening of
applicants for hiring and employees for promotion through psychological testing and evaluation;

PLANNING DIVISION
Develops, monitors and evaluates the agencies thrusts, strategies and priority PAPs using
timely, accurate and relevant data generated from its various offices and units and measures
achievement of performance targets.

REGIONAL PAROLE AND PROBATION OFFICES


Exercise Supervision and control over all Provincial/City Parole and Probation Offices within
their jurisdiction and perform such duties as may be assigned by the Administrator.

PROVINCIAL/CITY PAROLE AND PROBATION OFFICES


Undertake the investigation of petitioners for probation and applicants for parole/executive
clemency referred by the Courts/BPP; supervise & rehabilitate probationers/ parolees/
pardonees/FTMO and perform such other duties as may be assigned by the Administrator.

CASE MANAGEMENT AND RECORDS DIVISION


Provides assistance to the field offices to improve investigation and supervision caseload
recording and casework services; and manages case documents of the clients.

FINANCIAL AND MANAGEMENT DIVISION


Provides the administration with advice and assistance in budgeting and sound financial
management

COMMUNITY SERVICES DIVISION


Ensures strengthened community involvement in the rehabilitation of clients and generation and
mobilization of resources.

TECHNICAL SERVICES DIVISION


Evaluates and manages reports on applicants for Parote/Executive Clemency; functions as the
service arm of the Agency to the Board of Pardons & Parole.

BRIEF HISTORY
Adult probation as a reformation idea was twice attempted to be implemented in the country's
justice system. First was in 1935 and second in 1972.
On August 7, 1935, the Philippine Legislature passed Act No. 4221. This Act created the
Probation Office under the Department of Justice, headed by a Chief Probation Officer
appointed by the American Governor-General with the advice and consent of the US Senate.
The Act also granted probation to first-time offenders 18 years old above and convicted of
certain crimes. However, two years after its implementation, on November 16, 1937, the
Supreme Court declared it unconstitutional because of its constitutional and procedural defect.
In 1972, House Bill No. 393 was filed in the Congress with the purpose of establishing a
probation system in the country. Its provisions removed the defects of the previous law that
made it constitutionally and procedurally defective. Despite the Congress passing the bill, HB
No. 393 gathered dust in the Senate of the Philippines upon the declaration of Martial Law.
In 1975, the late Assemblyman Teodulo C. Natividad introduced another probation decree. The
proposed decree was presented on April 24, 1976, at the seminar on probation system
sponsored by the National Police Commission (NAPOLCOM) at the UP Law Center. It was also
presented at the First National Conference on Crime Control on July 22-24, 1976. The Bill
underwent eighteen (18) technical hearings and submitted to select behavioral scientists and
law practitioners before it was endorsed for approval.
Finally, on July 24, 1976, President Ferdinand E. Marcos signed the proposed decree known as
Presidential Decree No. 968 (PD 968) or the "Adult Probation Law of 1976". With its enactment,
it created the Probation Administration. The late Congressman Teodulo C. Natividad recognized
as the Father of Philippine Probation was appointed as its first Administrator.
With PD 968, probation became an added component of the Philippine Corrections System and
proved its institutional worth.
On November 23, 1989, with the issuance of Executive Order No. 292 or "The Administrative
Code of 1987% the Probation Administration became PAROLE AND PROBATION
ADMINISTRATION (PPA). EO 292 expanded PPA's mandate to include supervised treatment of
released prisoners, who after serving a part of their sentence, are released on parole or granted
presidential pardon with parole conditions.
In line with this expanded function, the Board of Pardons and Parole issued BPP Resolution No.
229 dated April 11, 1991 granting PPA the authority to conduct pre- parole or pre- executive
clemency investigation on prisoners confined in local jails and national penitentiary and penal
colonies.
Additionally, the investigation and supervision of First-time Minor Drug Offenders (FTMDO)
placed under suspended sentence became another responsibility of PPA. This is pursuant to
Sections 66, 68 and 81(b) of Republic Act No. 9166 or "The Comprehensive Dangerous Drugs
Act of 2002", of DDB Resolution No. 2 dated July 19, 2005 and the Memorandum of Agreement
between Dangerous Drugs

Board and PPA However, with RA No. 9344 enacted known as "The Juvenile Justice Welfare
Act of 2006", these minor drug offenders are now included in the probation supervision program
of PPA, if qualified under existing Probation Law. This is to stay true to the Restorative Justice
principle and take into account the best interest of these children.
To strengthen PPA's community engagement, Executive Order No. 468 dated 11, 2005, was
issued to revitalize the Volunteer Probation Aide Program now called Volunteer Probation
Assistant (VPA), This places PPA in the forefront in relation to crime prevention, treatment of
offenders in a community-based setting, and the overall efforts in the administration of criminal
justice.

MAJOR PROGRAMS AND SERVICES


Investigation
The objective of this function is to provide the Courts and the Board of Pardons and Parole
(BPP) with the necessary and relevant information which can be used in determining
petitioner/prisoner's fitness for probation, parole or any form of executive clemency,
This task involves the investigation and evaluation of the physical, mental and moral
background of the client and the identification of the available community resources.
Supervision
The monitoring of offenders in a community correction program to ensure strict adherence to
and compliance with the terms and conditions attached to their conditional release whether
probation, parole, pardon with parole condition or suspended sentence, and likewise prevent
further reoffending .
Rehabilitation
PPA employs the community-based intervention through a three-pronged approach:
Therapeutic Community Ladderrized Program, Restorative Justice (RJ), and Volunteerism
through utilization of Volunteer Probation Assistants.
Therapeutic Community Ladderized Program (TCLP) is a treatment modality for clients with
five components: affective/emotional/psychological, relational/ behavior management,
cognitive/intellectual, spiritual and psychomotor/ vocational-survival skills.
Restorative Justice (RJ) is the philosophical foundation for reintegration of clients into society
by restoring their relationship with the victim and community. RJ processes include mediation,
conferencing, circle of support and the practices of indigenous people.
Volunteerism is a program of PPA that encourages maximum citizen participation in the
rehabilitation of the clients. The Volunteer Probation Assistants (VPA) act either as direct
supervisor of the clients or as a resource individual.

ACCOMPLISHMENTS
Anti-Drug Abuse Program

The PPA actively participates in the implementation of the drug rehabilitation program of the
national government. For CY 2020, a total of 28,661 violators were referred through the Agency
for various assistance by the different member-agencies of the ICAD. Also, during the same
period, 6,951 voluntary surrenderers were assisted by the Agency. On the other hand, 24,296
agency clients from the different regions were subjected for drug testing as part of their
rehabilitation.
COVID Related Programs
In compliance with the Health Protocol Guidelines issued by the Inter-Agency Task Force for
Emerging Infectious Disease (IATF) and to protect its workforce and its clients from the spread
of COVID-19 virus, the Agency suspended its group/communal activities for rehabilitation of
clients. Use of communication technology and social media was utilized in the conduct of
investigation and supervision functions. In view of this, Probation and Parole Officers are
provided with subsidies in the form of Cellphone Load allowance. In addition to procurement of
protective supplies such as face mask, face shield, alcohol, disinfectant, door mats, and others,
Pneumonia vaccine was given for free to offcials and employees. Employees were allowed to
use the Offce's Dormitory as sleeping quarters to limit their exposure to the public in reporting to
office. The Office complied with the Bayanihan Programs of the government.
Recommended for ISO 9001: 2015 Certification
The TUV Nord, a 3rd party certifying body, recommended for the Agency maintenance of ISO
9001:2015 Certificate, being ISO 9001:2015 certified, and having passed its 2nd surveiiiance
audit.
DAP Scholarship for ISO 9001:2015 Expansion
The PPA is one of the beneficiaries of the Government Quality Management Program (GQMP)
of the Development Academy of the Philippines (DAP). The DAP provided free technical
assistance to the Agency for the expansion of QMS.
Certifiable to ISO 9001:2015 Standards to the Central Office, 16 Regional Offices and 21 field
offices nationwide. Series of Webinars were conducted and concluded in December 22, 2020.
Memorandum of Agreement with University of the Philippines
In December, the Agency signed a Memorandum of Agreement (MOA) with the University of the
Philippines for the conduct of research entitled "Impact Assessment of the Rehabilitation
Program of the PPA". The research proper will start in the 1st Quarter of 2021.
Update on the Single Carpeta System
The Agency thru the Case Management and Records Division has formulated the
Implementation Guide and Private Impact Assessment after undergoing the needed workshop
by all implementing agencies of the Single Carpeta System (SS). Aside from this, all PPA
personnel involved in the project participated in the different technical trainings and application
workshops vital to the efficient implementation of the project.
