On Sunday, June 12, 2022, the defendant, Donovan William Rojas (DOB 7/26/95), did commit the
offense of fleeing and eluding a law enforcement officer. This was in violation of 316.1935(3), F.S. He
did so by refusing to stop and willfully fleeing and attempting to elude a law enforcement officer in an
authorized law enforcement patrol vehicle with agency insignia and jurisdictional markings prominently
displayed on the vehicle and with siren and emergency lights activated, and during the course of this
fleeing he drove at high speed and in any manner which demonstrated a wanton disregard for the

On Sunday, June 12, 2022, the defendant, Donovan William Rojas (DOB 7/26/95), did commit the
offense of driving under the influence of drugs and/or alcohol in violation of 316.193(1), F.S. He did so
by operating a motor vehicle on a roadway in this state while under the influence of alcohol and/or any
chemical substance(s) to the extent he could not safely operate a motor vehicle.

On Sunday, June 12, 2022 at approximately 3:57 AM, I was on duty in full uniform as a Monroe County
Sheriff’s deputy in my marked patrol vehicle parked facing northbound in a well-lit area of the
northbound shoulder of mile marker 101 of Overseas Hwy, Key Largo, Monroe County, FL 33037 when
I observed in my side view mirror a white Cadillac 300 traveling northbound (bearing FL registration
plate KWZY03) and approaching my position at what I visually estimated to be grossly in excess of the
posted 45 MPH speed limit. I activated my in-car radar unit (Applied Concepts Stalker DSR 2X S/N
KC207447/KR047564), and it emitted a steady audible Doppler tone consistent with the digital readout
of 108 MPH. There were no other vehicles within my radar cone.

My patrol vehicle was conspicuously marked with all Monroe County Sheriff’s Office insignia and was
equipped with an overhead emergency light bar attached to the roof. Despite my vehicle being in a
well-lit area and clearly visible and parked on the immediate road shoulder, the Cadillac’s brake lights
did not activate nor did it slow as it passed my position.

I immediately activated all my emergency lights (including my red/blue overhead light bar, a red/blue
light bar on each of the foot rails, a red/blue dash light, red/blue grill lights, red/blue lights in the
headlight housings, and flashing headlights) and siren, and the vehicle accelerated rapidly. The vehicle
was approximately one-eighth to one-quarter mile ahead of me, but I maintained visual contact with it
throughout the ensuing pursuit as the vehicle failed to slow or yield to my emergency lights and siren.

I broadcast a radio transmission on the main patrol channel, advising any units north of mile marker
101 to be on the look out for the vehicle. Sgt. Orlando Alvarez and Dep. Anderson Harrill were parked
on the northbound side of mile marker 102 as the Cadillac was approaching them. They each activated
their own emergency lights and siren before the vehicle passed their position at 111 MPH according to
my radar readout. The vehicle continued northbound unabated, showing no attempt to brake, stop, or
slow in response to their attempt at effecting a traffic stop on it. Sgt. Alvarez and Dep. Harrill were both
in vehicles which displayed the same conspicuous configuration of agency markings as my vehicle, and
they both were equipped with similar internal and external emergency lights and siren as mine.

I continued northbound in pursuit of the Cadillac as it came upon approximately 3 cars within close
proximity of each other as the three vehicles traveled northbound as well. The Cadillac began to weave
side to side, in and out of the left travel lane. Its driving became more and more erratic as it appeared

to attempt to pass a vehicle which was in the left lane by driving into the center grassy median but
could not continue into the median because of standing trees. The Cadillac then suddenly switched
lanes to the right and sharply and seemingly uncontrollably cut dangerously close between two vehicles
which were in the left and right lane. It then accelerated rapidly to over 100 MPH in the left lane still
weaving side to side.

I was still behind the Cadillac and had my emergency lights and siren still activated, but the Cadillac did
not stop and continued northbound. It eventually slowed to approximately 60 MPH but did not stop. It
eventually pulled over into a left turn bay at the bottom of mile marker 105. It stopped but then inched
forward without going into park. Sgt. Alvarez and I were immediately behind the vehicle and ordered
the driver out of the car. He stumbled and staggered out of the car and appeared unsteady on his feet.
He had difficulty following simple commands such as where to face or where to go.

I placed him in handcuffs, and he had an overpowering odor of an unknown alcoholic beverage
emanating on his breath. He had red, bloodshot, glassy eyes, his speech was slurred and mumbled,
and his cheeks were flushed.

I later identified the driver and sole occupant of the Cadillac by his Florida driver license as Donovan
William Rojas (DOB 7/26/95), and he informed me he was currently a law enforcement officer. The
Cadillac was his agency-assigned unmarked vehicle.

At some point after Rojas passed Sgt. Alvarez and Dep. Harrill, Rojas activated some emergency lights
inside his vehicle. There were none visibly activated in the rear of the vehicle, but there was a red/blue
light attached to his passenger side visor and strobing. The Cadillac had no emergency lights activated
when it passed my initial position, and Sgt. Alvarez informed me the Cadillac had none activated at the
time it passed Sgt. Alvarez’ position.

I placed Rojas under arrest at 3:59 AM and in the rear of my patrol vehicle, advising him of the Miranda
warnings as printed by my agency. Rojas stated he refused to speak with me. I asked if he would be
willing to perform the Standardized Field Sobriety Exercises (SFSEs), and he refused.

Based on my training and the totality of events – Rojas’ being in actual physical control of the white
Cadillac 300, his exceedingly dangerous and erratic driving pattern as he attempted to flee, his
speeding in excess of 111 MPH (nearly 3 times the posted speed limit), his physical appearance and
speech pattern, the strong odor of an unknown alcoholic beverage on his breath, and his refusal to
perform SFSEs - I believed sufficient probable cause existed to conclude Rojas was under the
influence of either alcohol and/or chemical substance(s) which impaired his normal faculties to safely
operate a motor vehicle.

Sgt. Alvarez remained on scene in order to arrange the disposition of Rojas’ weapons, vehicle, and
other agency equipment.

I transported Rojas to the PK DUI Room to conduct the breath test, and we arrived there at
approximately 4:27 AM. I began the twenty minute observation period at 4:29 AM (according to the
intoxilyzer internal clock) after confirming Rojas had no foreign substances or objects in his mouth.
Rojas immediately stated he was “not going to blow”.

As a certified breath test operator (FDLE Certificate No. 354382), I asked Rojas to submit to a breath
test to determine its alcohol content, and he refused, saying “no” and “I refuse”.

I read Rojas the Florida implied consent warning as defined in 316.1939, F.S. (as revised in 2021) and
as printed in the document “State of Florida Implied Consent Warnings” as revised on 10/26/21. I
informed him his driver license would be suspended for a period of 12 months for a first time refusal to
submit to a lawful test of his breath or 18 months if he had a prior suspension, or if he had been
previously fined under 327.35215, F.S. for refusal to submit to a lawful test of his breath, urine, or
blood. I informed Rojas, if he had a prior refusal to submit to a lawful test of his breath, urine, or blood,
or if he had been previously fined under 327.35215, F.S., this would constitute a separate
misdemeanor charge. I further informed him his refusal would be admissible into evidence in any
criminal proceeding. Rojas acknowledged understanding of this.

Rojas asked for his union attorney in order to decide as to whether to provide a breath sample or not. I
explained to Rojas that his right to an attorney did not attach to his contractual obligation to submit to
any sobriety test required by law. I explained to Rojas that he was a licensed driver in Florida, having
already consented to the test, and thus not entitled to secure the advice of an attorney at this time.

Using the Intoxilyzer 8000 (S/N 80-006471), I again asked Rojas to submit to the breath test when the
instrument prompted him to provide a sample, and again Rojas refused to provide a sample, saying
“no”.

Rojas never provided a breath sample. I noted this as a refusal on the Breath Alcohol Test Affidavit as
well as the Affidavit of Refusal to Submit to Breath and/or Urine Test.

I then transported Rojas to the Plantation Key Detention Center without further incident.

I issued Rojas Florida uniform DUI citation 8998-XBM for driving under the influence of alcohol and/or
drugs in violation of 316.193(1), F.S., which citation he signed acknowledging his impending court date

enforcement at high speed and with wanton disregard for persons and property in violation of
316.1935(3), F.S., which citation he signed acknowledging his impending court date of 6/28/22 at 9 AM
before Judge Garcia at the Plantation Key Courthouse.

I issued Rojas a written traffic warning for speeding.

The foregoing all occurred in Monroe County, FL and was captured on my agency-issued body-worn

On June 12, 2022 at approximately 0357 hours Deputy Torres issued a Be On The Lookout (BOLO) for
a reckless vehicle driving northbound on SR5 at approximately the 101 mile marker.

Deputy Torres had the White Chrysler 300 bearing FL# KWZY03 failing to yield to his attempted traffic
stop and stated the fleeing vehicle had reached speeds of 108 MPH.

I was stationary on SR5 at the 102 mile marker on the northbound side with Sgt. Alvarez.

I was on duty in full uniform as a Monroe County Sheriff’s deputy in my marked patrol vehicle. I am a
speed measurement certified officer and I visually estimated the Chrysler to be going well above the
posted 45 MPH posted speed zone as it passed me northbound.

I activated my emergency red and blue lights and sirens on my issued patrol car with all Monroe
County Sheriff’s Office insignia and pulled onto SR5 behind Sgt. Alvarez attempting to stop the
Chrysler.

Offense Description
61-1 TRAFFIC OFFENSE: DUI

The Chrysler did not yield to both my lights and sirens or Sgt. Alvarez's.

Deputy Torres was primary on the pursuit of the Chrysler which eventually stopped at the left turn lane
in front of Key Largo School 104801 Overseas Hwy, Key Largo, FL 33037. A felony stop was initiated
by Deputy Torres, Sgt. Alvarez, and myself. The driver and sole occupant of the vehicle later identified
as, Donovan W Rojas 07/26/1995 was detained.

As Rojas stepped out of the vehicle he screamed "Im a Cop! Im a Miami Dade Cop!"

Inside of the vehicle I observed Two Glock Firearms, a Miami Dade Police ID, a Shield Badge, Blue
and Red lights attached to the passenger visor, A police tactical vest with a Axon body worn camera, a
laptop, and multiple other law enforcement equipment.

This concludes my involvement in this case.

My BWC and Incar were on during all events.

All events occurred in Monroe County.

On 6/12/22 at 3:57AM, I, Deputy Matthews, was advised by Deputy Torres on the radio of a white
Cadillac actively fleeing from him at a high rate of speed at the 102mm northbound on US1. I was
advised the vehicle was traveling speeds more then 100+ mph, and actively changing lanes.

I was responding as emergency backup to Deputy Torres location at the 105mm when he advised the
vehicle was stopped, and said the driver might run on foot.

I arrived on scene, and provided scene safety while Sgt Alvarez and Deputy Torres continued their
investigation. I observed a white Chrysler 300,and was told by Sgt. Alvarez to inventory the vehicle due
to the suspect being a active Miami Dade Police Officer. I located three prescription bottles in the
center console of the vehicle. I located two service weapons, one Glock 26, and one Glock 17, a
ballistic shield, a Police tactical vest with a BWC, a laptop, and a Harris radio. There was multiple
Miami Dade Police issued gear in the trunk off the vehicle as well. I took photos of the serial numbers

Sergeant Alvarez later informed me he made the decision not to tow the vehicle, instead he had
contacted MDPD to arrange someone from their agency to pick the vehicle up.

I stood by on scene til Miami Dade Police personal arrived on scene. Ending my involvement with this
case.

This incident was recorded on my agency issued body worn camera TLJ00180 and in-car camera
QIA00254.

On Sunday June 12, 2022 at approximately 0357 hours, Traffic Enforcement Deputy Torres
aired a Be On The Lookout (BOLO) for a reckless vehicle driving northbound on US-1 at approximate
the one-hundred and one mile marker. Deputy Torres aired via radio that the White Chrysler 300
bearing FL# KWZY03 was failing to yield to his lights and sirens and the vehicle was going in excess of
one-hundred and eight mile marker.

I was stationary on US-1 at the one-hundred and two mile marker on the northbound side facing
southbound. Deputy Harrill was parked next to me. I observed the vehicle in question traveling

Offense Description
61-1 TRAFFIC OFFENSE: DUI

northbound at a high rate of speed. I visually estimated the vehicle to be traveling one-hundred and five
miles per hour. The posted speed limit in said zone is forty-five miles per hour. I activated my in-car
multi directional radar unit and acquired a steady audio Doppler tone consistent with the digital readout
of one-hundred and seven miles per hour. The radar unit and model I was using is approved by the
department of highway safety and motor vehicles. The radar unit I was used is a Applied Concepts
Stalker DSR 2x S/N #DP009128 which was operating within normal parameters and had been tested
prior and after taking law enforcement action and had been bench tested within the six months of this
incident.

Prior to the vehicle passing my location, I turned on my emergency lights and sirens so the
violator could see me. As soon as my lights were activated, I observed the vehicle continue to
accelerate reaching speeds in excess of one-hundred and eleven miles per hour. While I was
attempting to keep up, Deputy Torres took lead in the pursuit and I was the secondary unit. However
due to the high speeds of the suspect vehicle, I was not able to keep up with them.

Deputy Torres then aired that the vehicle was slowing down and eventually came to a stop in the
left turn bay in front of Key Largo School located at 104801 Overseas Hwy, Key Largo, FL 33037. A
felony stop was conducted by Deputy Torres, Deputy Harrill and myself. The driver and sole occupant
of the vehicle later identified as, Donovan W. Rojas 07/26/1995 was detained in handcuffs. When Rojas
exited his vehicle, he stated that he was a Miami Dade Cop.

After he was detained, I cleared the vehicle to make sure there were no other occupants inside
of the white Chrysler 300. When I opened both the passenger side doors, I observed a Glock firearm in
a holster, a ballistic shield, Miami Dade Police Badge with Rojas' department identification card, tactical
vest that read "Police" with a Axon body worn camera attached to it, a Panasonic laptop computer and
other law enforcement equipment. The vehicle had a rear deck light activated (red and blue lights), but
was not fixed to the rear window and was facing down. The front passenger visor had a set of visor
lights activated (red and blue lights), but the visor was in the upward position. It should be noted when
the Chrysler sped past my location I did not see any of these lights activated at the time. Rojas was
placed under arrest for fleeing and eluding and DUI.

After confirming that Rojas was in fact a off-duty Miami Dade Police Officer, I made necessary
notifications to Captain S. Bryan. I also notified the Miami Dade Police Department of the incident.
MDPD Internal Affairs Sergeant Yasmina Smith contacted me via phone and informed me she was
going to take arrangements to take possession of the agency undercover car along with all of the
department issued equipment.

This concludes my involvement in this case. All events occurred in Monroe County, Florida.
