Re: Commonwealth v. Kevin Enrique Valle, CR 36825-CR 36829

Dear Judge Fleming,

I have reviewed Judge Plowman’s Order in the case of Commonwealth v. Kevin Enrique
Valle, CR 36825-CR 36829 whereby the Court disqualified the Commonwealth’s Attorney for
Loudoun County, Buta Biberaj, and her entire office and appointed the Commonwealth’s
Attorney for Fauquier County to prosecute these cases.

It is clear from the Order that the Court has rightfully lost confidence in Ms. Biberaj, her
deputies and her office’s ability and willingness to effectively seek justice in this matter. This is
a situation of first impression for most in the legal community. Considering this unprecedented
development, I wanted to offer to the Court the services of the Office of the Attorney General to
either prosecute these cases or assist the Fauquier County Commonwealth’s Attorney’s Office in
that prosecution.

As the Court is no doubt is aware, pursuant to §2.2-511 of the Code of Virginia, the
Governor has the authority to direct the Office of the Attorney General to institute or conduct
criminal prosecutions in the circuit courts of the Commonwealth. Should the Court designate the
Office of the Attorney General to either prosecute or assist the Commonwealth’s Attorney for
Fauquier County in such a prosecution, we would proceed in that manner.

My office has reached out the Commonwealth’s Attorney of Fauquier County to offer our
assistance as well.

Please know that my office stands at the ready to ensure that the victims of these serious
crimes receive justice, and that the perpetrator is held accountable thereby ensuring that the
citizens of Virginia feel safe in their homes.
