‫التي أقرها‬،‫يتعلق موضوع هذه الدراسة بفكرة السلطات االستثنائية لرئيس الجمهورية‬
‫ مخوال بذلك لرئيس الجمهورية صالحيات‬،‫المؤسس الدستوري الجزائري في دساتيره المتعاقبة‬
‫ والحالة االستثنائية أو‬،‫غير عادية متمثلة في تقرير و إعالن حالتي الحصار او الطوارئ‬
‫ وهذا بعد استشارة بعض المؤسسات الدستورية التي يكون رأيها غير ملزما‬،‫حالة الحرب‬
‫ويكون لجوء رئيس الجمهورية لهذه السلطات بحسب جسامة وخطورة األزمة التي تتعرض‬،‫له‬
‫فتمكنه بذلك من اتخاذ االجراءات الالزمة لمواجهتها ودرء المخاطر المحدقة‬،‫وتمر بها البالد‬
‫إلى جانب ذلك فإن الظروف غيرالعادية تخول لرئيس السلطة التنفيذية صالحيات‬،‫بها‬
‫و أخرى قضائية كحق العفو الرئاسي والوضع في‬، ‫تشريعية بممارسة التشريع اإلستثنائي‬
‫ يجمع فيها‬، ‫وانشاء المحاكم الخاصة‬،‫ باالضافة الى إخطار المحاكم العسكرية‬، ‫مراكز األمن‬
.‫وهذا ما يعتبر خروجا عن مبدأ الفصل بين السلطات‬،‫كل السلطات بين يديه‬
Abstract
The subject of this study rebites to the idea of the exceptional
powers of the President of the Republic, which was approved by the
Algerian constitutional founder in his successive constitutions, thus
authorizing the President of the Republic has extraordinary powers
represented to determine and declare the two states of siege or
emergency, the exceptional state or the state of war, and this is after
consulting some constitutional institutions whose opinion is not binding
on him, and the president of the republic’s resort to these powers is
according to the gravity and seriousness of the crisis that the country is
facing, thus enables him to take the necessary measures to confront then
and prevent the risks threatening it.in addition extraordinary
circmstances confer on ther chief executrise powers to legislate by
exercising extraordinary legislation , And ther judicial ones, such as the
right of the presidential pardon and the situation in security centers, in
addition to notifying the military courts, and the establishment of
special courts, in which all the authorities are combined in his hands,
and this is considered a departure from the principle of separation of
powers.
