What is the 1987

Constitution of the Republic


of the Philippines?

PREAMBLE
PREAMBLE
We, the sovereign Filipino people, imploring
the aid of Almighty God, in order to build a just
and humane society, and establish a
Government that shall embody our ideals and
aspirations, promote the common good,
conserve and develop our patrimony, and
secure to ourselves and our posterity, the
blessings of independence and democracy
under the rule of law and a regime of truth,
justice, freedom, love, equality, and peace, do
ordain and promulgate this constitution.
PHILIPPINES
The Philippines is a democratic and
republican State. Sovereignty resides in
the people and all government authority
emanated from them.

About the Government
The Philippines is a republic with a presidential form
of government wherein power is equally divided
among its three branches:
executive, legislative, and judicial.
The government seeks to act in the best interests of
its citizens through this system of check and balance.

One basic corollary in a presidential system of


government is the principle of separation of
powers wherein legislation belongs to Congress,
execution to the Executive, and settlement of
legal controversies to the Judiciary.
LEGISLATIVE BRANCH is in charge of making laws. It is
made of the congress and several Government
agencies.
Congress has two parts:
1. House of Representative – the lower house house
of the Congress of the Philippines. Members are
officially styled as representative (kinatawan) and
informally called Congressmen/Congresswomen
and are elected for 3 yrs. They also has the power
to impeach certain officials.
2. The Senate – upper of the house of the bicameral
legislature of the Philippines. Senate composed of
24 Senators and the only body that concur with
treaties and can try impeachment cases.
Executive Branch is headed by the President
who function as both head of state and the
head of Government. The President is the
Commander- in Chief of the Armed forces of
the Philippines. Elected by popular vote to a
term of six years. He/She can appoints(and
may dismiss) cabinet members whom he/she
presides.

Vice-President is first line to succession should


the president resign, be impeached or die in
the office.
Judicial power - rests with the Supreme
Court and the lower court, as established
by the law. Its duty is to settle actual
controversies involving rights which are
legally demandable and enforceable.

The Judiciary enjoys fiscal autonomy. Its


appropriation may not be reduced by the
Legislature below the appropriated
amount the previous year.
