A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF DORAVILLE CALLING


FOR THE NOVEMBER MUNICIPAL SPECIAL ELECTION FOR THE CITY OF DORAVILLE
OFFICE OF CITY COUNCIL MEMBER – DISTRICT 1, TO FILL THE UNEXPIRED TERM OF
REBEKAH COHEN MORRIS; FIXING AND PUBLISHING THE QUALIFYING FEES; AND
DESIGNATING THE QUALIFYING PERIOD; TO PROVIDE FOR SEVERABILITY; TO
PROVIDE FOR AN EFFECTIVE DATE AND OTHER LAWFUL PURPOSES.

WHEREAS, pursuant to Section 2.02 of the Doraville City Charter, the governing body of City of
Doraville shall consist of six (6) Council Members and a Mayor and shall so remain, as hereinafter provided;
and

WHEREAS, pursuant to Section 5.01 of the Doraville City Charter, the regular election for the office of
Mayor and the offices of councilmen, or for councilmen as the case may be, shall be held the Tuesday next
following the first Monday in November, which is Tuesday, November 8, 2022 General Election;

WHEREAS, pursuant to O.C.G.A. § 21-2-131(a), the governing authority of any county or municipality,
not later than February 1 of any year in which a general election is to be held, shall fix and publish a
qualifying fee for each county or municipal office to be filled in the upcoming election; and

WHEREAS, pursuant to O.C.G.A. § 21-2-131(a), such fee shall be 3 percent of the total gross salary of
the office paid in the preceding calendar year including all supplements authorized by law if a salaried
office, and the salary of City Council Members is $14,400 so the qualifying fee is $432.

NOW, THEREFORE, BE IT RESOLVED the Mayor and Council of the City of Doraville, Georgia that:

Section 1. The 2022 Municipal General Election for Offices of Council Member District 1 is hereby
called for Tuesday, November 8, 2022. The Clerk is instructed to publish a notice calling
for the election.

Section 2. The City Clerk will serve as the Election Qualifying Officer for the City and will receive
Notice of Candidacy and Affidavits during the Election Qualifying Period.

Section 3: The Qualifying Fees for the City of Doraville Nonpartisan Municipal Council Member
Election is fixed at $432.00 and shall be published in accordance with state law.

Section 4. Qualifying shall take place at Doraville City Hall, 3725 Park Avenue, Doraville, Georgia
30340. The qualifying period is hereby designated as:

Monday, August 8, 2022: 8:30 a.m. – 4:30 p.m.


Tuesday, August 9, 2022: 8:30 a.m. – 4:30 p.m.
Wednesday, August 10, 2022: 8:30 a.m. – 4:30 p.m.

Section 6. In the event no candidate receives a majority of the votes cast at the 2022 Municipal
General Election, a Runoff Election shall be held Tuesday, December 6, 2022, between the
candidates receiving the two highest number of votes.

Section 7. Effective Date. This resolution shall be effective immediately upon its adoption.

CITY OF DORAVILLE RESOLUTION NO. 2022-_____

RESOLUTION TO AUTHORIZE AND PROVIDE FOR THE CALLING OF A SPECIAL


(REFERENDUM) ELECTION TO DETERMINE THE APPROVAL OR REJECTION OF A
LOCAL HOMESTEAD EXEMPTION FROM CITY OF DORAVILLE AD VALOREM
TAXES; TO PROVIDE FOR THE PUBLICATION AND NOTICE OF THE ELECTION;
AND FOR OTHER PURPOSES

WHEREAS, Senate Bill 622 (the “Act”), a local law passed by the General Assembly of the
State of Georgia during the 2022 legislative session and signed into law on April 25, 2022, which is
attached hereto as Exhibit “A”, provides for a homestead exemption from City of Doraville ad
valorem taxes for municipal purposesin the amount of $10,000.00 of the assessed value of that
homestead plus an amount that provides the dollar equivalent of a two-and-a-half (2.5) mil reduction
of the millage rate applicable to the homestead property with respect to ad valorem taxes for
municipal purposes for the taxable year, in in lieu of the current homestead exemption in the amount
of $25,000; and

WHEREAS, in accordance with Art. VII, Section II, Paragraph 2 of the Georgia
Constitution, the new homestead exemption granted by the Act is conditioned upon approval by a
majority of the qualified electors residing within the limits of the City of Doraville voting in a
referendum thereon; and

WHEREAS, the Act further provides that the City of Doraville shall call and conduct an
election no later than the November 2022 general election, for the purpose of submitting the Act to
the electors of the City of Doraville for approval or rejection; and

WHEREAS, the Mayor and Council of the City of Doraville desire to call a special election
to be held in conjunction with the state-wide general election on November 8, 2022, in order for the
qualified electors of the City to determine whether the Act providing for the new homestead
exemption from City of Alpharetta ad valorem taxes for municipal purposes shall be approved or
rejected.

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the City of


Doraville, Georgia that:

Section 1: The Special Election for the purpose of submitting the Act to the qualified electors of
the City of Doraville for approval or rejection shall be held on November 8, 2022, in
conjunction with the state-wide General Election, and the Election Superintendent for
the City of Doraville is hereby ordered to issue the call for said Special Election in
accordance with Title 21 of the Official Code of Georgia and all other applicable
laws; and

Section 2: The ballots to be used in said Special Election shall have written or printed thereon
the following words:

the $25,000 homestead exemption from City of Doraville ad
( ) NO valorem taxes for municipal purposes so as to change the
exemption to $10,000.00 of the assessed value of that
homestead plus an amount that provides the dollar equivalent
of a two-and-a-half (2.5) mil reduction of the millage rate
applicable to the homestead property with respect to ad valorem
taxes for municipal purposes for the taxable year ?”

Section 3: The Election Superintendent of the City of Doraville is hereby authorized and
directed to directed to execute all necessary documents and perform such other acts
necessary to call said Special Election; and

Section 4: This resolution shall be effective immediately upon its adoption.
