12 EXPLANATORY NOTE

14 WHEREAS, the implementation of Comprehensive Land Use Plans would require the enactment
15 of regulatory measures to translate its planning goals and objectives into reality. A Zoning Ordinance is
16 one such regulatory measure which is an important tool for the implementation of the Comprehensive
17 Land Use Plan;

19 WHEREAS, the Local Government Code authorizes local government units to enact zoning
20 ordinances subject to and in accordance with existing laws;
21
22 WHEREAS, the Housing and Land Use Regulatory Board has rendered the technical assistance
23 which is within their mandate to assist and coordinate the activities of the local government units in the
24 preparation of comprehensive land use and zoning plans:

33 ARTICLE I
34 TITLE OF THE ORDINANCE

36 Section 1. Title of the Ordinance. This ordinance shall be known as the Comprehensive
37 Zoning Ordinance for the City of Baguio and shall hereinafter be referred to as the “Ordinance”.

41 AUTHORITY AND PURPOSE

43 Section 2. Authority. This Ordinance is enacted pursuant to the provisions of the Local
44 Government Code of 1991 (Republic Act No. 7160) Sections 458 a.2 (7-9) and 447 a.2 (7-9) dated 10
45 October 1991 authorizing the City through the Sangguniang Panlungsod to adopt its Zoning Ordinance
46 subject to the provisions of existing laws and in conformity with Executive Order No. 72.

49 Section 3. Purposes. This Ordinance is enacted for the following purposes:

51 a. Guide, control, and regulate future growth and development of Baguio City in accordance with its
52 Comprehensive Land Use Plan;

54 b. Protect the character and stability of residential, commercial, industrial, institutional, watersheds,
55 open space and other functional areas including heritage buildings/sites within the locality and
56 promote the orderly and beneficial development of the same;

58 c. Promote and protect the health, safety, peace, comfort, convenience and general welfare of the
59 inhabitants in the locality;
60
61 d. Provide adequate light, air, privacy and convenience to access to property;
62
63 e. Prevent undue concentration of population and congestion of properties;
64
65 f. Regulate the location and use of land and height of buildings in such manner so as to obviate the
66 danger to public safety caused by undue interference with existing or prospective traffic movements
67 on such streets and thoroughfares;
68
69 g. Preserve and protect the unique environment, ecosystem and cultural heritage of the city;

71 h. Ensure sustainable development.

74 Section 4. Zoning Principle. This Comprehensive Zoning Ordinance is based on the approved
75 Comprehensive Land Use Plan of Baguio City prepared by its City Planning and Development Office and
76 adopted by the Sangguniang Panlungsod (City Council).

80 DEFINITION OF TERMS

82 The definition of technical terms used in this Zoning Ordinance shall carry the same meaning
83 given to them in already approved codes and regulations, such as but not limited to the National
84 Building Code, Water Code, Philippine Environmental Code and other Implementing Rules and
85 Regulations promulgated by the Housing and Land Use Regulatory Board (HLURB). The words, terms and
86 phrases as used in this Ordinance shall be understood to have the meaning correspondingly indicated in
87 Appendix “A”.

93 Section 5. Division Into Zones or Districts. To effectively carry out the provisions of this
94 Ordinance, the City is hereby divided into the following land use zones:

96 a. Low Density Residential Zone (R-1)
97 b. Medium Density Residential Zone (R-2)
98 c. High Density Residential Zone (R-3)
99 d. Low Density Commercial Zone (C-1)

119 Section 6. Zoning Map. There is hereby adopted as an integral part of this Ordinance, an
120 official zoning map, drawn to the scale of 1:50,000 meters, duly prepared by the City Planning and
121 Development Office, wherein the designation, location and boundaries of the districts/zones herein
122 established are shown in Map 1.

124 In case of loss, damage, destruction and/or extreme difficulty in the interpretation of the official
125 zoning map, the Sangguniang Panlungsod may, by resolution, adopt a new official zoning map which
126 likewise shall be in accordance with the development plan of the community; provided, that all prior
127 maps or any significant parts thereof left shall be preserved together with all available records
128 pertaining to their adoption and/or amendment.

131 Section 7. Zone Boundaries. The areas appearing in Appendix “B” hereof constitute the
132 Zoning Districts of the City of Baguio with the specific locations and boundaries of each zone so
133 delineated. The textual description of the zone boundaries shall prevail over that of the Official Zoning
134 Maps.

137 Section 8. Interpretation of Zone Boundaries. In the interpretation of the zone boundaries
138 fixed for any of the zones shown in the Zoning Map, the following rules shall apply:

140 A. Where zone boundaries are so indicated that they approximately follow the center of streets or
141 highways, street lines or highway right-of-way lines shall be construed to be boundaries;
142
143 B. Where zone boundaries are so indicated that they approximately follow the lot lines, such lot lines
144 shall be construed to be boundaries;
145
146 C. Where zone boundaries are so indicated that they are approximately parallel to the center lines or
147 right-of-way lines of streets and highways, such zone boundaries shall be construed as being parallel
148 thereto and at such distance therefrom as indicated on the zoning map. If no distance is given, such
149 dimension shall be determined by the use of the scale shown in said zoning map;

151 D. Where the boundary of a zone follows a stream, lake, or other bodies of water, said boundary lines
152 shall be deemed to be at the limit of the political jurisdiction of the community unless otherwise
153 indicated;

155 E. Boundaries indicated as approximately following the center lines of streams, rivers, canals, lakes, or
156 other bodies of water shall be construed to follow such center lines. Boundaries indicated as parallel
157 to, or extension of indicated features not specifically indicated in the zoning map shall be
158 determined by the scale of the map;

160 F. Where a boundary line divides a lot or crosses unsubdivided property, the location of such boundary
161 shall be as indicated in the zoning map using the scale appearing on such maps;

163 G. Where a lot of one ownership, as of record at the effective date of this Ordinance, is divided by a
164 district boundary line, the lot shall be construed to be within the district where the major portion of
165 the lot is located. In case that the lot is bisected by the boundary line, it shall fall in the district
166 where the principal use falls;

168 H. Where a district boundary is indicated as one-lot-deep, said depth shall be construed to be average
169 lot depth of the lots involved within each particular city block. Where, however, any lot has a depth
170 greater than said average, the remaining portion of said lot shall be construed as covered by the
171 one-lot deep zoning district if the remaining portion has an area less than fifty percent (50%) of the
172 total area of the entire lot. If the remaining portion has an area equivalent to fifty percent or more
173 of the total area of the lot, then the average lot depth shall apply to the lot which shall become a lot
174 divided and covered by two or more different zoning districts, as the case may be;

176 I. Where a zoning boundary line is indicated in the zoning map, one block deep or a fraction thereof,
177 such boundary line shall be scaled or determined by the Zoning Officer.

180 ARTICLE V
181 ZONE REGULATIONS

183 Section 9. General Provisions. The following zones shall be principally used as follows:

185 A. Low Density Residential Zone (R-1). An R-1 shall be used principally for housing/dwelling purposes so
186 as to maintain the peace and quiet of the area within the zone with a low density of 20 dwelling
187 units and below per hectare;
188
189 B. Medium Density Residential Zone (R-2). An R-2 shall be for housing/dwelling purposes of medium
190 density of 21 to 65 dwelling units per hectare;
191
192 C. High Density Residential Zone (R-3). An R-3 shall be for housing/dwelling purposes of high density of
193 66 or more dwelling units;

195 D. Low Density Commercial Zone (C-1). A C-1 shall principally be for trade, services and business
196 activities ordinarily referred to as the Central Business District (CBD);
197
198 E. Medium Density Commercial Zone (C-2). A C-2 shall be for quasi-trade business activities and
199 service industries performing complementary/supplementary functions to the CBD;

201 F. High Density Commercial Zone (C-3). A C-3 shall be for regional shopping centers which are regional
202 in scope or where market activities generate traffic and require utilities and services that extend
203 beyond local boundaries and requires metropolitan level development planning and
204 implementation;

206 G. General Institutional Zone (GIZ). GIZ shall principally be for general types of institutional
207 establishments;

209 H. Parks and Recreation Zone (PRZ). A PRZ shall be for areas designed for diversion/amusements and
210 for the maintenance of ecological balance of the community;
211
212 I. Water Zone (WZ). The WZ are bodies of water which include rivers, creeks, streams, lakes, water
213 reservoir, etc.;

215 J. Planned Unit Development Zone (PUDZ). A PUD shall refer to land development scheme where
216 project site is comprehensively planned as an entity via unitary site plan which permits flexibility in
217 planning/design, building siting, complementarity of building types and land uses, usable open

218 spaces and the preservation of significant natural land features. The Camp John Hay Special
219 Economic Zone and the Baguio Export Processing Zone are included in this zone;

221 A. Utilities Zone (UZ). This shall be for towers and antennaes, subject to approval of
222 Civil Aviation Authority of the Philippines (CAAP), Cell Sites, subject to approval of the National
223 Telecommunications Commission (NTC), TV/radio relay stations, public parking spaces/loading and
224 unloading facilities, Public and Private Terminals/Garages/Storages, Storage tanks, buildings for
225 storing gasoline, acetylene, LPG, calcium, carbides, oxygen, hydrogen, and the like, solid waste
226 disposal and sewage treatment plant.

228 B. Cemeteries/Memorial Parks. These shall be for public and private areas for burying
229 the dead;

231 C. Airport Zone. This shall be for the Loakan Airport and support facilities;
232
233 D. Forest Zone (FZ). This shall be for areas primarily used for forest purposes. The FZ is
234 further categorized as the Watershed Zone, Protected Forest Zone, and the Open Forest Zone which
235 shall be utilized for tree parks, and soil conservation and related activities depending on soil
236 suitability of specific areas;

238 E. Roads Zone. This shall be for the provision of right-of-ways for roads and streets;
239
240 F. Slaughterhouse Zone. This shall be for the city slaughterhouse;
241
242 G. Heritage Zone. This shall include building/s or sites or a cluster of buildings;
243
244 H. Ecological Park/Solid Waste Processing Center. This area shall allow solid waste processing i.e. the
245 ERS operation.

248 Section 10. Permitted Uses. The uses indicated below are not exhaustive nor all-inclusive.
249 The Local Zoning Board of Adjustment and Appeals (LZBAA) shall, subject to the requirements of this
250 Section, allow other uses not enumerated hereunder provided that they are compatible with the uses
251 expressly allowed. Allowance of further uses shall be based on the intrinsic qualities of the land and the
252 socio-economic potential of the area with due regard to the maintenance of the essential qualities of
253 the zone.

255 Specific uses/activities of lesser density within a particular zone (R-1) may be allowed within the
256 zone of higher density (R-2, R-3) but not vice-versa, nor in another zone and its subdivisions except for
257 uses expressly allowed in said zones, such that the cumulative effect of zoning shall be intra-zonal and
258 not inter-zonal.

274 4. Home occupation for the practice of one's profession or for engaging in an in-house business
275 such as dressmaking, tailoring, baking, eatery, running a sari-sari store and the like, provided
276 that:

278 a. The number of persons engaged in such business or industry shall not exceed five,
279 inclusive of the owner;
280 b. There shall be no change in the outside appearance of the building or premises;
281 c. No home occupation shall be conducted in any customary accessory uses cited
282 above;
283 d. No traffic shall be generated by such home occupation in greater volume than
284 would normally be expected in a residential neighborhood and any need for parking
285 generated by the conduct of such home occupation shall be met off the street and in a place
286 other than in a required front yard;
287 e. No equipment or process shall be used in such home occupation which creates
288 noise, vibration, glare, fumes, odors or electrical interference detectable to the normal
289 senses and visual or audible interference in any radio or television receivers or causes
290 fluctuation in line voltage off the premises.

292 5. Home industry classified as micro small medium enterprises, provided that:

294 a. Such home industry shall not occupy more than thirty percent (30%) of the
295 floor area of the dwelling unit. There shall be no change or alteration in the outside
296 appearance of the dwelling unit and shall not be hazard/nuisance;
297 b. Allotted capitalization shall not exceed the capitalization as set by the DTI;
298 c. Shall consider same provisions as enumerated in 4 above.

300 6. Recreational facilities for the exclusive use of the members of the family residing
301 within premises such as:

334 located not less than 500 meters from nearest existing school offering similar course and are
335 equipped with adequate parking or as provided in the local zoning ordinance;
336 b. Boarding houses with no more than eight (8) boarders;
337 c. Neighborhood convenience stores selling miscellaneous items, provided that such stores
338 shall not exceed 10% of the gross floor area (GFA) of the dwelling unit and provided that no
339 liquor shall be allowed for sale;
340 d. Processing, refilling and retailing of bottled drinking water provided that clearances from
341 local health department and certification of adequate supply from the water supply
342 concessionaire shall be secured.

1378 F. At the hearing, any party may appear in person, or be represented by agent/s. All interested parties

1415 C. An idle/vacant structure may not be used for non-conforming activity.
1416 D. That any non-conforming structure, or structures under one ownership which has been damaged
1417 may be reconstructed and used as before provided that such reconstruction is not more than fifty
1418 percent (50%) of the replacement cost. That should such non-conforming portion of structure be
1419 destroyed by any means to an extent of more than fifty percent (50%) of its replacement cost at the
1420 time of destruction, it shall be reconstructed except in conformity with the provisions of this
1421 Ordinance.
1422 E. That no such non-conforming use may be moved to displace any conforming use.
1423 F. That no such non-conforming structure may be enlarged or altered in a way which increases its non-
1424 conformity, but any structure or portion thereof may be altered to decrease its non-conformity.
1425 G. That should such structure be moved for any reason to whatever distance, it shall thereafter
1426 conform to the regulation of the district in which it is moved or relocated.
1427 H. Existing businesses of Junk Shops/motor Vehicle Repair Shops/Vehicle Tire shops/Welding
1428 shops/Smoke emission testing centers that cannot comply with the requirements such as provision
1429 of work area shall be given one (1) year to relocate from its present location.

1432 Section 30. Responsibility for Administration and Enforcement. This Ordinance shall
1433 be enforced and administered by the Local Chief Executive through the Zoning Officer who shall be
1434 designated by the former in accordance with existing rules and regulations on the subject.

1437 Section 31. Powers and Functions of a Zoning Officer. Pursuant to the provisions of
1438 E.O. 72 implementing R.A. 7160 in relation to Sec. 5, Paragraph a and d, and Section 7 of Executive Order
1439 No. 648 dated February 1981, the Zoning Officer shall perform the following functions, duties and
1440 responsibilities.

1450 b. Recommend to the local zoning board of adjustment and appeals (LZBAA) the grant or
1451 denial of applications for variances and exemptions and the issuance of Certificate of Non-
1452 Conformance for non-conforming projects lawfully existing at the time of the adoption of
1453 the zoning Ordinance, including clearances for repairs/renovations on non-conforming uses
1454 consistent with the guidelines thereof.

1456 2. Monitor on-going/existing projects within their respective jurisdictions and issue notices of
1457 violation and show cause order to owners, developers, or managers of projects that are violative
1458 of Zoning Ordinance specifically on the zoning and land use and, if necessary, pursuant to sec. 3
1459 of E.O.72 and Sec. 2 of E.O. 71 refer subsequent action thereon to the HLURB.
1460 3. Coordinate with the City Legal Officer for other legal actions/remedies relative to the foregoing.

1475 provision of the zoning ordinance or of any clearance or permits issued pursuant thereto shall be filed

1636 Section 40. Amendments to the Zoning Ordinance. Changes in the Zoning Ordinance as a
1637 result of the review by the Local Zoning Review Committee shall be treated as an amendment, provided
1638 that any amendment to the Zoning Ordinance or provisions thereof shall be carried out through a
1639 Resolution of three-fourths vote of the Sangguniang Panlungsod. Said amendments shall take effect only
1640 after approval and authentication by HLURB.

1643 Section 41. Violation and Penalty. Any person who violates any of the provisions of this
1644 Ordinance, shall upon conviction, be punished by a fine not exceeding P5,000.00 or an imprisonment for
1645 a period not exceeding one (1) year or both at the discretion of the court. In case of violation by a
1646 corporation, partnership or association the penalty shall be imposed upon the erring officers thereof.
1647 Owners of existing structures, businesses or buildings that continue to violate or operate in violation of
1648 the provisions of this ordinance shall be penalized 100% of the corresponding locational clearance fee
1649 every month it continues to exist or operate.

1652 Section 42. Suppletory Effect of Other Laws and Decrees. The provisions of this Ordinance
1653 shall be without prejudice to the application of other laws, presidential decrees, letter of instructions
1654 and other executive or administrative orders vesting national agencies with jurisdiction over specific
1655 land areas, which shall remain in force and effect, provided that land uses decisions of the national
1656 agencies concerned shall be consistent with the Comprehensive Land Use Plan of the City.

1659 Section 43. Separability Clause. Should any section or provision of this Ordinance be
1660 declared by the Courts to be unconstitutional or invalid, such decision shall not affect the validity of the
1661 Ordinance as a whole or any part thereof other than the part so declared to be unconstitutional or
1662 invalid.

1665 Section 44. Repealing Clause. All Ordinances, rules or regulations in conflict with the
1666 provisions of this Ordinance are hereby repealed, provided that the rights that are vested upon the
1667 effectivity of this Ordinance shall not be impaired.
