PUBLIC NOTICE
SMP No. 18/2019
Bihar Electricity Regulatory Commission, empowered to make regulations
under section 181 (za) read with section 57 (1), 57 (2) and 86 (1) (i) of the
Electricity Act 2003 (36 of 2003), has initiated a Suo-Motu Proceeding No:-
…../2019 to make Bihar Electricity Regulatory Commission (Standards of
Performance of Intra-State Transmission Licensees) Regulations, 2019.
The draft regulation along with consultative paper is uploaded on the
commission’s website. The same is also available in the office of the
commission for perusal. Interested persons/organizations may download the
copy from the commission’s website https://berc.co.in/publice-notice and may
also obtain a copy of the draft Regulation and consultative paper from the
commission’s office on any working day between 10.00 A. M to 6.00 P.M Free
of cost.
Commission invites comments/suggestions/objections from to general
public and all stakeholders on the draft Bihar Electricity Regulatory
Commission (Standards of Performance of Intra-State Transmission Licensees)
Regulations, 2019 latest by 13.08.2019 addressed to the Secretary, Bihar
Electricity Regulatory Commission, Vidyut Bhawan-II, J. L. Nehru Marg,
Patna-800021.
The commission shall hold public hearing in the commission’s office at
11.00 AM on 20.08.2019.

DRAFT REGULATION
In exercise of the powers conferred under Section 181 (za) read with section 57
(1), 57 (2) and 86 (1) (i) of the Electricity Act 2003, the Bihar State Electricity
Regulatory Commission hereby makes the following Regulations:-
CHAPTER 1
PRELIMINARY

(c) “Commission” means the Bihar Electricity Regulatory
Commission referred to in sub- section (1) of section 82 of the Act.

Notes: (1) Tower collapse shall not be counted for the purpose of
calculation of monthly availability of AC transmission line and
HVDC bipole line.

7. Methodology for compensation: - An affected person who has
suffered a loss on account of non-adherence to the Standard of
Performance by any intra-State transmission licensee may make an
appropriate application to the Commission for award of
compensation:

MISCELLANEOUS

Provided that the Intra-State Transmission Licensee shall not be
discharged from its liability on account of its failure to maintain the
Standards of Performance under these regulations if such failure
can be attributed to the negligence or deficiency or lack of
preventive maintenance of the intra-state transmission system or
failure to take reasonable precaution which has resulted in loss
to the affected person.
