BROAD SCOPE OF WORK Carrying out of Bored Cast in Situ (BCIS) piling works of different diameters as per the approved construction methodology, scope matrix & tech specifications for High-Speed Rail Project (package C-4) from Zaroli village at Maharashtra-Gujarat Border (IMAHSR 156.600 KM) to Vadodara (MAHSR 393.700 KM) with materials, Plant & Machinery, tools & tackles, consumables, and labour complete. 2. APPROXIMATE SCOPE Total number of piles 300 Nos (Approximate) Total boring scope 9000 Meter (Approximate) ‘The sub-contractor scope of work shall be reduced or increased based on their job performance during execution. 3. SCOPE MATRIX ‘A. SUB-CONTRACTOR SCOPE © Mobilization of suitable and sufficient Plants & Machineries required for construction of 1200/1500 mm diameter RCC Bored Cast in situ piles of required depth as per approved drawings/technical specification following good industry practices. The Plant & Machinery mobilized shall include the following but not limited to Hydraulic Rotary Rigs suitable for ordinary hall relevant accessories, service cranes, JCBs, Hydra Cranes, Generators, Tanks, pumps, etc. with all required machineries etc., experienced (highly skilled / skilled/ semi-skilled / unskilled) manpower with all necessary tools & tackles, consumables required for successful execution of job. © Making all arrangement for piling with Polymer or suitable driling fluid. Polymer to be sourced from the LTHCIC approved vendors, (© Construction of 1200/1500 mm diameter RCC bored cast in situ piles in all kinds of strata as per the approved drawings using Rotary Rig. © Providing, maintenance and replacing of cutting tools as and when required for smooth execution shall be maintained throughout the project duration. ©The sub-contractor shall take care of the stabilization of bore hole by arranging temporary casing up to the required depth and using polymer. © Cutting, bending, tying of reinforcement steel including Binding wire, fixing of couplers, spacers and necessary welding of spacer rings and laps as per the approved drawings/s, providing cover blocks and lowering the fabricated cage in the boreholes. ‘© Welding machines, electrodes and cables required to carry out welding works at site shall be arranged by the sub-contractor at their own cost © Pouring of concrete in the pile using tremie and hopper as per drawing/s and specifications including, overflow of the contaminated concrete. © Disposal of piling muck shall be arranged by the sub-contractor. In case of failure of pile due to violation in technical specifications by the sub-contractor, the total cost Implication for additional piles, and pile cap, etc, is to be borne by the Sub-contractor. © The sub-contractor will ensure that proper safety precautions are being taken as per LTHCIC’s established ‘Occupations Health, Safety and Environment Management system. © High Speed Diesel (HSD) for Plant & machinery shall be arranged by the sub-contractor at his own cost. ©The sub-contractor equipment’ shall be not demobilized from site without written permission from LTHCIC’s Project Manager. (© Shifting of Cross Hole Sonic Tubes and end caps from LTHCIC nearest precast yard to piling location to be arranged by the sub-contractor. © Fabrication of temporary MS liners with all tools & tackles and Plant & Machinery and consumables and labour complete. * GI Binding wire confirming to 15-280 (from the LTCHCIC approved vendors) for piling works shall be ‘arranged by the sub-contractor at their own cost. *© Cover Blocks (from the LTCHCIC approved vendors) required for piling works shall be arranged by the sub- contractor at their own cost, * Following all technical specifications and safety guidelines mentioned in SHE manual of NHSRCL. © Any local issues evolved because of sub-contractor shall be resolved by the sub-contractor on their own cost. © The sub-contractor shall make his own arrangement for the staff and labor conveyance as per the project, ~ requirement, © Demobilization of all manpower, Plant & Machinery, equipment, tools & tackles, site office and clearing the areas used by the sub-contractor (Pre-Cast Yards area and pile locations} etc. upon completion of work. B. LTHCIC SCOPE LTHCIC shall provide Bore hole data/test results of the areas where piling is proposed. Utility identification and removal / relocation of the same if they are failing with the pile location. Land for Sub-contractors stores and P & M workshop, febrication yard & Cage binding yard shall be provided by LTHCIC either at nearest precast yard or within the ROW as available, Ready-mix concrete of approved grades at pile location. Threaded reinforcement shall be provided at cage binding yard Rebar Couplers at nearest precast yard. Fabricated Cross Hole Sonic Tubes of 50 NB, 150 NB pipes and end caps as per specifications, Construction water source by LTHCIC, however transportation of water with tank shall be arranged by the sub-contractor at his own cost. MOBILISATION PERIOD Sub-contractor must start mobilization of required P&M, Materials, Consumable, and tools & tackles immediately after receipt of LOVNTP/Work Order from LTHCIC. Piling works should be started within 15 days from the date of LOW/NTP/Work Order. 4 MEASUREMENT: A. Pile Boring: Pile boring length for measurement and subsequent billing shall be considered from pile cut of level to Pile termination level, hence no empty boring of any form shall be payable unless otherwise mentioned in the contract or certified by Engineer in Charge of case specific basis. However, in case actual concrete quantity consumed is less than the theoretical concrete quantity, payment for bore length shall be made as per the theoretical calculation of pile bore depth arrived based on the actual concrete quantity consumed, (On Encountering of Hard Rock strata, sub-contractor shall take prior certification from Engineer in Charge before proceeding further and maintain proper bore hole records. Bore hole for piles executed in the month and duly certified by E1C shall be submitted by sub-contractor along with monthly RA bills. B, Concrete: ‘Theoretical Concrete consumption shall be calculated from Pile termination level to 1.00 meter above cut of level ‘as mentioned in the drawings. The Lower of actual concrete consumed and quantity arrived based on the theoretical formula shall be considered for payment and reconciliation purpose. 5 COMPLETION SCHEDULE Time is the essence of the contract and same to be completed as per schedule. No. 979, Chennai - 600 088, DIA claim whatsoever as the result of such action. tt shall be clearly understood that LTHCIC will not entertain any claim from Sub-contractor for any idle time compensation, Subcontractor Should not sublet part or whole of the job awarded to him to any other agency unless it is approved by LTHCIC. 6 MOBILISATION ADVANCE No Mobilization Advance shall be paid under this subcontract. 7 PRICE * Prices/Rates agreed shall include costs of mobilization, demobilization, workmen, Plant & Machinery with ‘operator and POL, consumables, temporary works, tools & tackles, supervision, Insurance and everything, necessary for due performance of work under this sub-contract. * The Quoted price should be firm and fixed up to 06 months from the date of scheduled completion dates ‘as mentioned in the completion schedule. 8 INCENTIVES Further to the rates/prices mentioned in the price schedule, to motivate sub-contractor to achieve maximum umber of piles, LTHCIC shall pay the incentives at the following rates. Sub-contractor must provide monthly reconciliation for the same along with Running bill ‘A. Rebar Wastage: (Reinforcement steel issued by LTHCIC) ~ (Theoretical reinforcement for piling works)- (Physical stock available at stock yard) ‘On completion of the work or termination of the Contract, all surpluses of the materials supplied by LTHCIC including scrap shall be returned by the sub-contractor to LTHCIC duly delivered at the place inside LTHCIC’s precast yard as may be directed by the Engineer In Charge (EIC), at the cost of the sub-contractor. Wastage for reinforcement steel shall be calculated as per the approved Bar bending Schedule. All scraps/Wastage generated as per the approved BBS during construction activities must be returned to LTHCIC. Shortfall in return of scrap quantity shall also be debited at the landed price plus 05% Over head plus GST as applicable. Rebar Couplers ‘Wastage/Shortfall quantity for Rebar Coupler shall be calculated as below. Rebar Coupler wastage/shortfall (Nos): (number of Rebar Couplers issued by LTHCIC) ~ (theoretical ‘consumption of Rebar Couplers as per the approved BBS) (On completion of the work or termination of the Contract, all surpluses of the materials supplied by LTHCIC shall be returned by the sub-contractor to LTHCIC duly delivered at the place inside LTHCIC’s precast yard ‘as may be directed by the Engineer In Charge (EIC), at the cost of the sub-contractor. Sonic Tubes Shortfall/Wastage for Sonic Tubes: (Length of fabricated Sonic Tubes issued by LTHCIC) ~ (theoretical consumption of Sonic Tubes) - (length of Sonic Tubes returned by the sub-contractor) On completion of the work or termination of the Contract, all surpluses of the materials supplied by LTHCIC shall be returned by the sub-contractor to LTHCIC duly delivered at the place inside LTHCIC’s precast yard as may be directed by the Engineer In Charge (EIC), at the cost of the sub-contractor. Separate reconciliation for 50 MM & 150 MM diameter sonic tubes shall be done. Allowable wastage for sonic tubes is ZERO Percentage. Cut lengths are to be returned to LTHCIC if not usable. Any shortfall quantities in Sonic Tubes shall be arrived through above formula shall be debited at the landed price plus 05 % Over Head plus GST as applicable. 12 DEFECTS LIABILITY PERIOD (DLP) ‘Sub-contractor shall be responsible for all the defects and deficiencies pertaining to their work till the expiry of Defect Liability period of 12 months from the date of successful completion of entire scope of works assigned to the sub-contractor. ‘Within the terms of the DLP / warranty the sub-contractor shall be liable for repair / rectification of any defect / deficiency arising out of poor construction practices and poor workmanship. Wherever itis established that a defectin components occurred by a faulty construction /poor workmanship, upon detection of such defects, the sub-contractor shall immediately take appropriate and efficient measures to fix it at its own cost by repair or replacement as may be approved by UTHCIC within 15 days. in the event the sub-contractor falls to repair or rectify such defect or deficiency within 15 days, LTHCIC shall get the same repaired, rectified or remedied at the sub contractor's cost. The cost for such repair or rectification along with 20% overhead shall be recovered from the sub contractor's any money due from LTHCIC including encashment of PBG. The Defect Liability Period shall be deemed to be extended till the identified defects have been remedied. 13 PERFORMANCE GUARANTEE 7 _ Sub-contractor shall submit Performance bank guarantee for 2.5 % of total value of contract value (Excluding ST) valid tll completion of entire scope of work and defect (those arising due to negligence on the part of the Sub-contractor) liability period of 12 months from date of completion. PBG shall be submitted by Sub- contractor in LTHCIC format within 10 days after receipt of LOI or work-order whichever is earlier. The Bank Guarantee should be strictly according to LTHCIC format. * — Subcontractor shall mention Purchase Order/ Work Order no. with date in Bank Guarantee. * To speed up the processing of payment, subcontractor shall get Bank Guarantee Confirmation from subcontractor’s banker as per the below procedure, i, While making the 8G application, Vendors to inform their Bank to send BG confirmation only through IFN 760 (Guarantee} vide SFMS to our Bank. ii. IFN 760 (Guarantee) should contain the following details: BG No, BG Amount, BG Type, date of issuance, Expiry date, Name of BG Applicant & Beneficiary’s name and address. The Bank Guarantee shall be valid up to the completion of defects Liability period and with a claim period of SIX months. The Bank Guarantee shall be extended for a further period if the Subcontractor is awarded additional works / granted extension of time for the work already awarded and in special cases as required by the Client and with no additional cost on LTHCIC. In case the contract value exceeds beyond 20% of the original subcontract value, the sub-contractor shall have to submit additional performance bank guarantee, 14 PAYMENT TERMS 14.4 Payment towards running bills shall be made on monthly basis based on joint measurement between subcontractor representative and LTHCIC site in Charge, Payable within 15 days from the date of bill certification by LTHCIC. 14.5. Invoice shall be submitted by the sub-contractor on or before 7® of succeeding month for all works with reconciliation of all the materials issued by LTHCIC executed in the previous month and LTHCIC shall take or cause to be taken the requisite measurement for the purpose of having the same verified. 14.6. All such intermediate (R.A. Bills) Payments shall be regarded as payments by way of "ON Account” against the final payment only and not as payments for work actually done and completed and shall not preclude the right of LTHCIC from getting bad, unsound and imperfect or unskilled work to be removed and reconstructed by the sub-contractor or considered as an admission of the due performance of the contract. or any part thereof in any respect or the accruing of any claim nor shall it conclude, determine or affect in any way the power of LTHCIC under these conditions or any of them as to the final settlement and adjustment of the payment or otherwise, or in any other way vary or affect the sub-contract. 14.7. Reconciliations of free issued materials is necessary and the same shall submitted along with every R.A. Bill without which the R.A. Bill shall not processed for the payment. The sub-contractor is required to reconcile the materials based on the theoretical norms. 14.8 Supply items shall be weighed at LTHCIC’s own weigh bridges. Both the parties shall deploy their representatives and mutually record/ document the requisite details in agreed format or as per the direction of the Engineer in-Charge. The weighment slips shall be produced by the Sub-Contractor along with subsequent RA Bill at the month end for reconciliation purpose and RA Bill certification, failing which the requisite amount shall be put on hold. 14.9 The sub-contractor shall not demand, nor be entitled to receive payment for the work or any portion thereof except, in the manner set forth in this sub-contract and only after LTHCIC shall have given a certificate for such payment. For final payment, when the work covered by this sub-contract has been completed, Sub-Contractor shall prepare a final abstract showing the total amount of work done and its value under and according to the terms of this sub-contract. Sub-Contractor shall attach copies of LTHCIC’s completion certificates with its final abstract. 14.10 From the total value thus arrived, all previous payments shall be deducted, and all deductions made in accordance with the provisions of this sub-contract and the remaining shall be paid by LTHCIC to Sub- Contractor within three months of the date of submission of Sub-Contractor’s Final Bill. Retention money shall be released to the Sub-contractor 03 Months after satisfactory completion of the total scope of work assigned without any interest, subject to the following conditions: ‘© On production of no dues certificate issued from LTHCIC store, time office, and accounts and planning. department. ‘© Sub-contractor furnishing to LTHCIC an unconditional undertaking that he has no outstanding dues pending with LTHCIC with respect to work carried out by him. © The Sub-contractor shall produce documents in proof that, he has discharged all his staff, workmen, suppliers, and statutory authorities ina manner as required. ‘© Upon submission of duly signed final reconciliation statement for free issue materials. 16 LIQUIDATED DAMAGES LTHCIC Project Manager and Sub-contractor shall mutually agree the construction work program and fix the ‘monthly target achievements. The Sub-contractor shall use and continue to use their best endeavors to avoid any delay in work execution. if the delay in the completion of the whole works or a portion of the works, due to the Sub-contractor’s failure or fault, LTHCIC reserves the rights to recover liquidated damages as given below. i, _ Interim LD: If any shortfall in the progress in the first 15 days of the month as per the monthly programme, the vendor needs to increase the resources (rigs, etc.) to make up by end of the month. if the shortfall continues and if actual progress is less than the no. of piles as per the programme committed due to the reasons of the vendor, LD shall be imposed at 1% of the total order value per week in delay. Actual shortfall in no. of piles in the respective month shall be considered for calculating the no. of days lost and accordingly LD shall be imposed. Any such other Insurance as may be required by the statutory bodies and local laws in operation shall be the responsibilty of the Sub-Contractor. Maintain and arrange for the provisions of the above insurance in such terms and of such duration and of such limits as shall be acceptable during the performance of the Vendor 's obligations under the contract within 30 days from the start of work, failing which no RA bill payment shall be made, 19 PROVIDENT FUND ‘The Sub-contractor will be required to cover all their workmen engaged by them under provident fund from the commencement of the work. The Sub-contractor shall have to submit the challan of payment made towards P.F. for their workmen and staff to LTHCIC's Accounts department every month or the same shall be deducted from Sub-contractor RA bill as per PF norms of Government. 20 WATCH & WARD FOR MATERIAL ‘The Sub-contractor’s materials & equipment mobilized at site should be registered at LTHCIC store before starting the job. The Sub-contractor shall guard its own resources and materials handed over by LTHCIC from any theft, damage, pilferage etc. and LTHCIC shall not entertain any issues on account this. 21 POWER, WATER & AREA LIGHTING: Construction water source shall be arranged by LTHCIC, whereas transportation of water shall be arranged by ‘the sub-contractor at his own cost. Construction power at one point for office/store shall be provided by LTHCIC, Power for regular construction activities shall be arranged by the sub-contractor at his own cost. 22. PLANT & MACHINERY © A detailed Schedule of mobilization/ deployment of Plant & Machinery submitted by the Sub-Contractor along with the offer will form a part of the agreement/subcontract and the same shall be adhered strictly, However, the additional Plant & Machinery shall be deployed if the Engineer finds it necessary to catch up with the work schedule or quality of works at no extra cost to LTHCIC, ‘* Major plants & machineries to be owned by the Sub-contractor. No. 379 Chennai - 600 088, INDIA 23 RISK PURCHASE In the event Sub-contractor fails to execute the order as per the provisions of this contract including adherence to the delivery/time of completion indicated therein, LTHCIC reserves the right to cancel the order in part or full without any compensation and purchase/execute such cancelled items from alternative sources. Any extra cost incurred by us on such procurement/services shall be recovered by us together with administrative charges @ 20% of the extra cost; either by way of deduction from your pending bills with LTHIC and/or by means of separate remittance from you within 15 days or recelpt by you of our debit note/notes. 24 ‘TERMINATION OF CONTRACT LTHCIC shall be entitled to terminate the subcontract if the Sub-contractor: © Work progress is consistently found to be below the accepted programme, & if the quality of work being ‘executed by the Sub-contractor falls below the expected standards and specifications laid down, © Abandons the Works or otherwise plainly demonstrates the intention not to continue performance of his obligations under the subcontract, © Do not mobilize the equipment in time, the equipment fails to perform satisfactorily, or if the neglect the Engineer In-Charge instruction, In any of these events or circumstances, the LTHCIC may, upon giving 15 days’ notice to the Sub-contractor, terminate the contract and expel the Sub-contractor fram the Site, The LTHCIC’s decision to terminate the contract shall not prejudice to any other rights of the LTHCIC, under the contract or otherwise, The Sub-contractor shall then leave the Site and deliver any required Goods, all Sub-contractor Documents, and other design documents made by or for him, to the Engineer. However, the Sub-contractor shall use his best efforts to comply immediately with any reasonable instructions included in the notice (i) for the assignment of any contract, and (i) for the protection of life or property or for the safety of the Works. After termination, the LTHCIC may:complete the Works and/or arrange for any other entities to do so. The LTHCIC and these entities may then use any Goods, Sub-contractor 's Docurnents and other design documents made by or on behalf of the Sub-contractor. ‘The LTHCIC shall then give notice that the Sub-contractor 's Equipment and Temporary Works will be released to the Sub-contractor at or near the Site. The Sub-contractor shall promptly arrange their removal, at the risk and cost of the Sub-contractor. However, if by this time the Sub-contractor has failed to make a payment due to the LTHCIC, these items may be sold by the LTHCIC to recover this payment. Any balance of the proceeds shail then be paid to the Sub-contractor. If your progress is consistently found to be below the accepted programme, & if the quality of work being ‘executed by you falls below the expected standards and specifications laid down by us, in such cases, in the interest of timely completion of the project & maintain the igh quality of work, we reserve the right to delete any part of the scope of work, or, the entire balance work to be taken away from you & get such works ‘executed by other agencies, at your risk & costs.
