COMPROMISE AGREEMENT

This Compromise Agreement is made and entered into in the City of

Manila, Philippines by and between:
ROSARIO P. FERNANDEZ, of legal age, Filipino, married, and with
residence at 793-B Maceda St., Barangay 570, Sampaloc, Manila, herein
referred to as “PRIVATE COMPLAINANT”
ENRIQUE T. HERNANDEZ, of legal age, Filipino, married, and with
residence at 793-B Maceda St., Barangay 570, Sampaloc, Manila, herein
referred to as “ACCUSED”

1. WHEREAS, the private complainant filed a complaint against the

accused for violation of Section 5(a) of Republic Act No. 9262 or the
“Anti-Violence Against Women and Their Children Act of 2004”
before the City Prosecutors Office of Manila, and the corresponding
information was filed before the Regional Trial Court of Manila,
Branch 48.

2. WHEREAS, Private complainant and the accused have agreed to

amicably settle the indemnification of consequential damages of the
above-entitled criminal case, particularly, the actual damages to be
recovered.

3. The terms and conditions of the Compromise Agreement shall be as

follows:

a) The accused admits its civil liability in the above-entitled case in

the amount of Two Hundred Thousand Pesos (P200,000);
b) In its desire to settle the case with private complainant, the
accused has proposed to settle the case as follows:

i. The accused has paid P50,000.00 as partial payment for the

civil liability.
ii. Upon the signing of the Compromise Agreement, the accused
agrees to pay the aforementioned amount.
iii. After the signing of the Compromise Agreement, the accused
shall pay the amount of P25,000 monthly, until its civil
liability is fully satisfied.
iv. After the civil liability has been paid, the private complainant
shall waive its claim for damages in the above-entitled case.

4. The parties are required to observe and comply with the terms and
condition of the Compromise Agreement as stated above.

5. If the accused fail to comply with the terms and conditions of this
Compromise Agreement, the accused shall be liable for the actual

 damages and other consequential damages which the private
complainant may recover in the above-entitled case.

IN WTINESS WHEREOF, the parties hereto have signed these presents

on this 13th day of April, 2022 in the City of Manila, Philippines.
