AN ORDER REORGANIZING THE BARANGAY ANTI-DRUG ABUSE COUNCIL


(BADAC) AND CREATION OF COMMITTEE ON OPERATIONS AND COMMITTEE
ON ADVOCACY AND THEIR ROLE IN DRUG CLEARING OPERATIONS

WHEREAS , drug-related incidents have been constantly present in our country


and resulted in multiple crime incidents despite efforts of the PNP and other law enforcement
agencies of the government ;

WHEREAS , pursuant to Republic Act No. 7160 , otherwise known as the Local
Government Code of 1991 , the government at the level of the barangy is tasked to promote
the general welfare of its constituents through the maintainance of peace and order situation
thereat through the enforcement of national and local laws;

WHEREAS , the increasing use of illegal drugs has considerably contributed to the
incidence of heinous crimes , hence , this problem has to be addressed and much more
effectively to help ensure community peace and harmony;

WHEREAS , DILG issued Memorandum Circular No. 2015-63 dated June 16 ,


2015 emphasizing the principal responsibilities of barangay officials in support of overall
government efforts to address peace and order , particularly curb illegal drugs and other
substances;

NOW , THEREFORE , I, CONRAD P. LIM , Punong Barangay , Barangay 33


, City of Cagayan de Oro , by virtue of the powers vested upon me by law , do hereby
revitalize the following :

SECTION 1. ORGANIZATION OF BARANGAY ANTI-DRUG ABUSE


COUNCIL (BADAC).

The Barangay Anti-Drug Abuse Council is hereby organized.


SECTION 1.1 COMPOSITION. The Barangay Anti-Drug Abuse Council shall be
composed of the following :

SECTION 1.2 ROLES AND RESPONSIBILITIES OF THE COUNCIL:


The Barangay Anti-Drug Abuse Council shall perform the following roles
and responsibilities:

1. Plan , strategize, implement and evaluate drug abuse prevention programs


in the barangay through the conduct of regular meetings at least once a
mont and call for special meetings whenever necessary;
2. Organized and orient the BADAC Auxilliary Team (BAT) to compose an
ideal number of 25 members per 2,000 population of the barangay
representing streets, puroks, subdivision or sitios on their roles and
functions and in formulating plan of action to address the problem;
3. Equip the Barangay Tanods and BAT on their roles and functions in the
campaign against street- level illegal drug trade through seminars and
trainings;
4. Coordinate and collaborate with other institution implementing programs
and projects on drug abuse preventionat the barangay level;
5. Conduct Information,Education Campaign (IEC) on illegal drug demand
reduction;
6. Strengthen family ties in the barangay;
7. Determine, maintain, gather and update data information;
8. Identify drug affected house clusters, work place , streets , puroks and
sitios;
9. Conduct of inventory of drug personalities;
10. Refer suspected drug users to the CADAC and other institutions for
counseling and rehabilitation;
11. Refer drug users and dependents who voluntarily surrender to appropriate
officer;
12. Monitor periodically those undertaking Community Based Drug
Treatment and Rehabilitation (CBDTR) thru random drug testing to patients
who exhibit indication of using dangerous drugs;
13. Empower the community in reporting drug related cases;
14. Extend assistance to law enforcement agencies during the conduct of anti-
drug operation;
15. Create a favorable policy environment;
16. Set quarterly targets to reduce the level of affection and ultimately achieve
drug cleared status and maintain the status of drug cleared and unaffected
barangays through ADAC Plan of Action and submit a monthly report to
CADAC copy furnished the DILG City Office;
17. Monitor disposition and progress of drug-related cases filed;
18. Organize House cluster and designated Cluster Leaders;
19. Perform other related functions.

SECTION 2. CREATION OF COMMITTEE ON OPERATIONS :

The Committee on Operation shall be composed of the following :

SECTION 2.1 ROLES AND RESPONSIBILITIES:

1. Prepare and maintain a confidential list of suspected users, pushers,


financiers and/or protectors of illegal drug trade found in the LGUs
area of jurisdiction to be submitted to the Municipal Anti-Drug Abuse
Council copy furnished the PNP Anti-illegal Drugs Special Operations
Task Force (AIDSOTF); and

2. Establish Rehabilitation/referral desk and process applications for


rehabilitation of drug dependents.

Pre-Operations :

 Identifications of drug affected house clusters, work place, streets,


puroks and sitios where manufacture, delivery, sale or use of illegal
drugs are being conducted and to report the same immediately to the
PNP or the PDEA;
 Conduct administration searches of suspected drug dens/laboratories;
 Conduct briefings, meetings prior to the launching of operation to
ensure positive results and safety of the operating teams and the
community.

During Operations:

 Ensure safety of the community and regularity of the operations


 Any elected barangay official present during the operations to witness
the inventory of seized drugs/paraphernalia;
 Extend such other necessary assistance to the PDEA and PNP
authorities in each operation against illegal drugs including but not
limited to the preservation of evidence and protection of witnesses and
suspects against unlawful acts;

Post Operation :

 The elected barangay official present during the operations shall


execute an affidavit and act as witness in court hearings in the
prosecution of drug cases;
 Submit reports of drug clearing operations conducted, if any, to the
MADAC copy furnish the DILG Municipal Field Office.

For operations conducted/initiated by the PNP/PDEA, an elected barangay


official should be involved immediately after the operation and be present to
stand as witnesses and subjects.
SECTION 3. CREATION OF COMMITTEE ON ADVOCACY :

The Committee on Advocacy shall be composed of the following:

SECTION 3.1 ROLES AND RESPONSIBILITIES :

1. Coordinate and collaborate with other institutions in the barangay , if any


(1.e.,BPAT/Tanod);
2. Conduct consultative meetings with organizations in the barangay, such as
the PTA, Youth Groups, Boy and Girl Scouts, religious organizations,
senior citizens, Homeowners Association, neighborhood associations,
puroks and tricycle Operators and Drivers Association (TODA) and other
organizations existing in the community;
3. Strengthen the family by promoting values, parental care and guidance
that will prevent children from attempting to and/or use prohibited drugs;
4. Strengthen the linkages of the Barangay Officials with the community,
higher LGUs local Police and PDEA on anti-illegal drug
campaign.
5. Conduct necessary seminars for the community on the dangers on illegal
drugs in coordination with the PNP;
6. Empower the community in reporting drug related case through and
award/commendation system, and
7. Identify and implement sustainable livelihood projects as a reintegration
program to former drug pushers and drug addicts.

SECTION 4. MEETINGS AND QUORUM.

The BADAC shall convene one week after the approval of this Executive
Oder to discuss the ensuing activities of the body. After the First organizational meeting ,
the body shall meet at least once every quarter or anytime it felt necessary to discuss
issues and concerns relative to its preparations against calamities and disaster. A majority of
all its members shall constitute a quorum.
SECTION 5. EFFECTIVITY.

This Executive Order shall take effect immediately.
