1. DURATION OF EMPLOYMENT

Your contract will begin on ____________ 2014 and terminate on_____________ 2014.

2. LOCATION
ProLink Direct is an employer trading at 2nd Floor, The Business Place, Cape Town
8000. Your employment during this time period will be held in all areas within Cape
Town. This contract is subject to the duration of the contract with ProLink Direct and if
for whatever reason the contract is terminated prior to the expected end date that date
will be regarded as the termination date.

3. POSITION
You are appointed to the position of Direct Sales Consultant and will report to your
appointed TEAM LEADER. Your specific duties and responsibilities will be given and
shown to you. Apart from these duties, you may also be required to perform other
general tasks as might be requested of you from time to time by the Manager.

Refer to Annexure A for relevant Duties and Responsibilities.

4. HOURS OF WORK

ProLink Direct is a 5 (Five) day week operation which works on 1 shift system. You are
required to work 40 hours per week (5 days).
4.1 Agents must start work @ 8:30am sharp
4.2 You are entitled to two 15 minutes tea break and a 30 minute lunch break.

5 OVERTIME

5.1 You may be required to work overtime from time to time and this will not be paid
for as this will allow you to reach your targets when or if you fall short.
5.2 All overtime is to be authorized prior to the commencement of the work.
6 WAGES / SALARIES

6.1 Your salary will be payable to you on the 7th (seventh) day of each month.
6.2 Successful sales per month will be remunerated by means of a structure of R50.00
(Fifty) per Successful sale.
6.3 A Basic of R3000.00 (Three Thousand) will be payable for sales achieved over
and above 40 (forty) sales successfully debited per month.
6.4 A “Sale” is deemed as successful only if the clients bank successfully pays the
initial (first) debit amount without the payment, being reversed.

7 Targets

-The employee understands and agrees that targets are set out and must be achieved on
a weekly and monthly basis. Failure to achieve these targets at any stipulated point in
time will lead to reverting back to probationary period subject to dismissal based on
targets of the employee. (Following performance management process (counselling)

-Where applicable, (for Direct Sales Agents) the targets are as follows;

20 (twenty) Successful Sales per week


100 (One Hundred) Successful Sales per Month

Successful debits are of outmost important to the well being and future of the company
and agents must obtain at least 40 (Forty) “successful” debits per month.

Agents are required to make a daily target of 10(ten) sales per day.

All agents must in their probation period of 7(Seven) days reach a target of 10 Successful
sales before this contract becomes into effect.
8 DEDUCTIONS

The following deductions will apply: UIF; PAYE (if applicable), or any other agreed to
statutory deductions.
9 ANNUAL LEAVE

a. You will be entitled to annual leave at a rate of 1.25 days per month of
completed service. Further details will be documented in the Leave
Policy .The regulations and expectations provided for in the BCEA 1997 apply.

b. Annual leave will be paid at your normal rate of pay.

c. Leave encashment is not allowed for annual leave.

d. Leave arrangements should be done in advance as per the Company policies


and procedures. The granting of leave is at the discretion of management and
should be done in consultation for a time, which has been agreed between the
two parties.

10 SICK LEAVE

a. You are entitled to 1day sick leave for every 23 days worked. It is a specific
condition of this contract that the employer must be phoned before 9:00am on
any day which sick leave is taken

b. You will not be paid if you have been absent from work for more than 2
consecutive days or on more than 2 occasions during an eight-week period
and, do not produce a medical certificate stating that you were unable to work
for the duration of your absence due to sickness or injury.

11 FAMILY RESPONSIBILITY LEAVE


a. Family responsibility leave will not apply to employees who have been
employed for less than 3 months and who work less than 4 days per week.

b. You will be granted a maximum of 4 days leave, in whole or in part. Family


responsibility leave will be granted, on request, and on reasonable proof being
provided of one of the following events:

- Your child is sick

- The death of your spouse or life partner

- The death of your parent, adoptive parent, grandparent, adoptive


grandparent, child, adoptive child, grandchild or sibling
12 DEDUCTIONS TO REIMBURSE EMPLOYER
The employer’s right to make a deduction from an employee’s salary/wage as
reimbursement for loss or damage, is hereby expressly agreed to but only if:

- The loss, fine or damage occurred in the course of employment and was due to
the fault of the employee;

- The employer has followed a fair procedure and has given you a reasonable
opportunity to show why the deductions should not be made;

- The total amount of the debt does not exceed the actual amount of the loss or
damage

- The total amount of the deductions does not exceed 25% of your wage/salary

13 HEALTH & SAFETY


Health, Safety, Fire precautions and Accident investigation must be practiced at all
times. Employees must notify their superiors of any hazards or if the employee
becomes aware of any unsafe or defective equipment or any dangerous method of
work or Location Required to Practice Direct Sales. Employees must observe all
safety rules displayed in relation to work. Employees must report all accidents
immediately.

14 CONFIDENTIALITY
You shall keep confidential and not disclose, whether in the company’s continued
employment or not, any of the company’s trade secrets, know-how, methods,
processes, customer lists, market information, financial information and/or any other
confidential information to any third party, unless required to do so in the discharge of
a duty or when required to do so by law.

The party terminating the contract must do so in writing.

15 COMPANY POLICIES AND PROCEDURES


Other than conditions of service detailed in this document, you will be subject to the
conditions of service laid down in the company policies and procedures as amended
from time to time.
16 GENERAL

Over and above any of the conditions of employment set out specifically in this
contract, your conditions of employment are subject to relevant conditions of
employment specified in:

- Any relevant legislation or subordinate legislation

- Any relevant wage-regulating measure

- Any internal, negotiated procedures or agreements committed to writing and


signed by all the parties thereto
This contract constitutes the full agreement between the parties, is binding on both
parties, and can only be altered by written agreement, signed by both parties. No
relaxation on any of the clauses of this contract shall have affected the right of either
party to act in terms of the contract.

17 FRAUD
Agents doing fraudulent sales put ProLink Direct’ staff and the future of the
company in jeopardy and will be dealt with in a harsh but professional manner.

For your and ProLink Direct’ sake, please DO NOT MAKE FRAUDULENT SALES.
