The vehicle continued south on College AVE SE toward Dickinson AVE SE. I was able to catch up to the vehicle near this location. The driver
saw my fully marked GRPD cruiser and failed to stop at the stop sign. The driver almost collided with another vehicle and had to drive on the
west side walk of College AVE SE south of Dickinson ST SE to avoid a collision.
I began to get closer to the vehicle as it was still driving south on the west side walk of College. The driver later identified as
jumped out of the vehicle as it was still moving. began to run south on College AVE SE. The vehicle continued to be in motion and
collided into the school at College and Dickinson; see report 21-050757 for additional information.
I yelled out my window at , "Stop Police". continued to run south through a backyard at the south east corner of Griggs ST SE and
Godwin AVE SE. I pursued on foot south on Godwin AVE SE from Griggs ST SE. was given more commands to stop, but did not
comply. I was able to catch up to at the north east corner of Godwin AVE SE and Storrs ST SE. I tackled causing both him and I

Due to ' strength I was not able to gain control of him. Therefore, I used my department issued taser to deploy a cartridge in the middle
of his back from approximately a foot away from . I used the taser to apply pressure to his right calf to make a third point of contact for
approximately 5 seconds. immediately flipped over onto his back.
was given several verbal commands to lay on his stomach. would not comply. I activated my taser again for approximately 3
seconds while applying pressure to ' right calf. complied and I was able to take him into custody.
Officers Johnson and Howard arrived to the scene. They searched . See their follow up reports for additional information.
I read his Miranda rights. understood his rights and agreed to speak with me. stated that he does not have a job and denied
having cocaine. stated that he had approximately $9,000 in cash on his person. would not provide any other information.
Sgt. Konynenbelt responded to the scene. During the incident, my body camera had fallen into the storm drain. Sgt. Konynenbelt was able to
recover my body camera and the two bags of white powdery substances. One bag was approximately the size of a racquetball and the other
was the size of a grape. The grape sized bag was tinted brown from being in the waste water.
I observed Sgt. Konynenbelt test these substances using TruNarc TN 4884. The grape sized bag test inconclusive while the racquetball sized
bag tested as acetaminophen; test #5512 at 1632 hours. The Trunarc passed calibration before and after the test. These substances were
submitted to PMU as evidence.
City works responded to assist with recovering the money that was in the storm drain. The money was banded together in the drain. The
banded money had 89 100 dollar bills totaling $8900. had another $3,142 on his person. had a total of $12,042. This money
was submitted to PMU.
was lodged at KCCF for PWID cocaine, PWID imitation, R&O, DWLS, and for failing to stop and ID at a traffic crash. ' bag, wallet,
watch, and necklace were submitted to PMU as evidence. The listed vehicle was towed via Merl's req. 133529; see follow up reports for
additional information.

As I was on scene OFficer Schurr advised the suspect was taken into custody at Godwin Ave Se and Storrs ST Se and he lost vision of the
suspect at the corner of Griggs St Se and Godwin Ave Se around the residence on the south east corner.
Upon my arrival OFficer Schurr requested my k9 partner perform an article search for any items ditched during the foot pursuit that contained
human odor. Kilo who is nationally certified in locating items that containing human odor was given the search command.
Kilo searched the area from the start of the foot pursuit until the suspect was capture. Kilo did not alert to anything along the way. We cleared
without further incident.
Once the scene was secured I went back to locate the vehicle which had crashed into the east side of Dickinson Elementary when the driver
jumped out.
The keys were in the vehicle and the VIN Dispatch attempted a phone call there
and the resident advised that no one by that name lived there.
The building had damage and the vehicle stopped on top of the ground mounted sign for the school.
FSU was called and CST Clemens processed the evidence. There were two cell phones on the sidewalk that were dropped by the suspect
when he ran from the car.
Inside the car on the center console was a cloth baggy with a pool cue size baggy of white powder, about an ounce size baggy of white
powder and a small baggy of brown powder. There were also bags of marijuana and a 16 oz bottle of Promethazine Oral solution.
Sgt. Konynenbelt field tested the powder substances with the Trunarc device which passed the self test.
Results:
I stood by until Merl's arrived and the vehicle was towed as evidence with a hold for Vice. Wrecker 133529.
See 21-050757 for the crash report. GRPS Security was also notified of the damage. They advised that there may be video of the incident.

On 8/18/2021 at approximately 15:45 hours, I was working in the area of Hall St/Division Ave SE when I
overheard Officer Schurr on F1 say that he had a b/m subject wearing blue jeans and a white t-shirt
fleeing on foot in the area of Godwin/Griggs SE. Officer Schurr advised that the subject was running
south from that location. I activated my red/blue lights and siren on my unmarked black dodge ram and
responded emergency to that location. Officer Schurr updated that he was fighting with the subject. It
should be noted that I was also wearing an outer carrier vest that is clearly marked “Police”. During my
travels to his location, Officer Schurr did not provide an update and I believed that he in fact was in a
physical fight with the suspect.
I traveled south on Division from Hall St, and then east on Griggs. I turned south on Madison and
traveled to Storrs St SE. I observed Officer Schurr on the ground near the intersection of Godwin/Storrs
SE. Officer Lahuis was with him and the subject was on the ground near a storm drain on the northeast
corner of the intersection. I asked Officer Schurr if he was injured in anyway and he stated that he was
not. I requested AMR non-emergency for the suspect as Officer Schurr discharged his ECD into the
subjects back. Other units responded and assisted with search and securing the subject. Officer Schurr
advised that the subject had tossed suspected narcotics into the drain during the struggle, and Officer
Schurr believed his body camera also went into the drain during the struggle.
I looked into the storm drain and could see two clear plastic baggies that contained and unknown white
substance inside of them. I also noted a large sum of U.S currency was also in the water. Officers later
observed Officer Schurr’s body camera submerged in the water as well. 311 was contacted to respond
to assist with removing the items from the drain. I used a piece of equipment provided by City workers
and was able to retrieve Officer Schurr’s body camera. It was removed and appeared to still be
recording.
I remained on scene and assisted with a back track with K9 Officer Thompson and his partner. Nothing
was located during the back track. The suspected narcotics were removed from the storm drain along
with the large sum of U.S currency. I witnessed Officer Schurr count the money removed from the storm
drain. It was 89 $100 dollar bills. All evidence was secured by Officer Schurr on scene.
I contacted Lt. Siver and confirmed that a hold was placed on the vehicle (2009 GMC Yukon plate # G5674636) wrecker number of 133529.
As I arrived in the area, Officer Schurr had already tased the subject, , and taken him into custody. I took over maintaining
control of who was still lying on the ground on top of a sewage drain. The probes from the taser were into the subject's mid back.
Ro's maintained control of the subject and searched him while he was still lying on the ground, making sure did not lie on his back
to prevent the probes from going into his skin any further. After the search of person I removed the probes as trained. The
cartridges and probes were placed into an evidence envelope and given to Sergeant Konynenbelt.
During a search of person I located a large amount of cash in his left pant pocket, which was later seized. Officer Schurr counted
the money first, and then I counted it noting the total amount being $3,142.00.
I assisted with checking the area for any discarded items (drugs, guns, cell phone, etc.) but did not locate anything. I knocked on the door of
as they had cameras but the resident mentioned the memory is always full and it does not store footage.
On 8/20/21, I recounted the money after it had dried. I counted 90 $100 bills or $9,000. I changed the amount in WebView, banded the
money and resealed the envelope.

Det. Preston recovered the suspected controlled substances from PMU and field tested them. Below are the following results:
-Approx. 10 grams of grape sized substance located in sewer drain was positive for fentanyl
-Approx 11 grams of heroin recovered from inside vehicle tested positive for heroin
-Approx. 77 grams recovered from inside vehicle tested positive for fentanyl
-Approx. 1 ounce of cocaine taken from inside of vehicle tested positive for cocaine.
The first 3 items were done by Det. Preston and the last item was tested by Sgt. Konynenbelt.

INFORMATION:
While on patrol, Officers heard a GRPD officer requesting assistance in the area of Nelson and Griggs on a stop
after they had a subject run. Officers heard the officer then request more cars advising that they had been involved
in a shooting. PSO Nagtzaam, and Duran and I responded in a tow man unit. Duran and I responded emergent to
the south of the incident location and positioned our vehicle on Griggs east of Nelson. While en route, we heard
that GRPD had taken another into custody and had begun CPR on a subject down.
OFFICER ACTIONS:
I responded and with Officer Duran to the location where the subject was down and performed CPR in rotation
with other officers on scene. While performing CPR, I observed a taser that was turned on next to the subject
down that appeared to have been deployed. The subject appeared to have a GSW to the head. After the medical
scene was TOT GRFD and paramedics, PSO Duran and I checked with GRPD if they needed any further
assistance. We were advised to standby and were eventually cleared to leave the scene.

informed me that on 3/5/2022, at around 1600 hours, she was at Autozone located at 2920 Eastern Ave and accidentally left her ID, a
credit card, and two debit cards on the front counter. She said that someone must've stolen her items from the counter because on 3/6/2022,
she received a notification from MetaBank, that $25 was attempted to be taken out of her account via CashApp. This attempt was made with
her debit card ending in 8356. Then there was a confirmation notification that $350 was successfully taken out of her bank account also
through CashApp. She said that the $350 was taken out in two chunks, not all at once. This was made through her other card ending with
8855. No money was taken from her credit card. stated that she was confused how this could have happened through CashApp
because she does not have a CashApp account at all. She stated that she contacted her bank and they said they may be able to try and get
her a refund if she makes a report.
The bank statements showing the fraudulent withdrawals will be attached to this report.
I provided her with the report number and advised her to follow up with her bank.

Sgt. Dionne, who had also responded, advised me Ofc. Martin was Ofc. Schurr's companion officer and he was able to get a public safety
statement.
At that time I directed units to create a perimeter and to tape of the areas at Nelson and Orville, Griggs and Silver, Griggs at Newark, and
Nelson and Elliott. Ofcs. Newton and Sanders then conducted a canvas of the neighboring houses for witnesses or security cameral footage.
Ofc. Grandy remained with the suspect.
I advised Lt. Bush of the incident and he advised he was contacting the appropriate unit commanders.
I was advised of a two cameras which were mounted to neighboring houses and I advised Det. Weston who had arrived onscene.
While MSP was onscene I checked with all the perimeter units and made the appropriate adjustments as they were needed.
Ofc. Lahuis then transported Ofc. Schurr's patrol vehicle to HQ. He was followed by MSP and Ofc. Sanders.
I stayed onscene until MSP was finished and notified GRPD personnel they could clear.
Sgt. Johnston stayed at the scene until Merl's completed towing the suspect vehicle and GRFD finished a wash down.

Sgt. Tim Johnston was first on scene and I arrived shortly after that with several other Officers. I covered on the car until we were ready to
clear it. Other Officers were covering the suspect.
Officer Schurr advised that the suspect was down and he was ok. A second subject in the car was secured and we cleared the car.
The suspect was on the ground in front of . He was not moving and still had Officer Shurr's ECD and body cam next to him.

Once the scene was secured medical units took over. The suspect was pronounced dead. TOD was 08:33 hours per Dr. Clark at Butterworth
Hospital.
immediately stated "your Officer, he did all the right shit." "He did everything he could do to deescalate the situation."
stated that he was upstairs and saw that there was a traffic stop outside. He stated that the Officer was at the driver's side of the car
and told the suspect "I'm arresting you."
stated that went downstairs and saw the Officer wrestling with the suspect in front of . stated that he yelled to the
suspect to stop. He stated that he also yelled to the passenger of the car to tell his friend to relax.
The suspect continued to fight with Officer Schurr. The suspect's flip flops were in front of house and he stated that the Officer
tackled him there first and then he ran south.
initially thought the the flip flop was the Officers radio until the walked out there and saw it was a shoe.
Officer Schurr had called out on the radio that the suspect's has his ECD(Taser). I asked if he saw the suspect with the Officer's
Taser and he stated "yeah he took the Officers Taser!"
I asked where the other occupant of the car was during this. He stated that he was standing inside the open passenger door of the
car.
I asked again if he saw the suspect take the Officer Taser. stated that the Officer deployed the Taser but it didn't work and the
two were still tussling and the suspect tried to take the Taser.
stated that he ran upstairs to get his phone when he heard a loud pop. I asked him if he saw the suspect point the Taser at the Officer
and he stated " No they were tussling and he took it away." stated again the the Officer did the correct thing.
I advised that MSP investigators were on the way an they would need to speak with him.

I then spoke with the resident of who goes by his middle name
stated that he was in the house when he got a motion alert on his Ring camera. stated that he didn't by the subscription for the
Ring so it doesn't save any video.
stated that he looked outside and saw the Officer struggling with the suspect. He stated that the Officer Tasered the suspect once and
went back inside to get his phone.
stated "I think he Tasered him again. stated that a moment later he heard a gunshot and saw the suspect drop. He stated that the
Officer walked back to the car and handcuffed the other occupant.
I asked if he saw the Officer shoot the suspect. He stated that he couldn't see who had a gun because the Officer and suspect were
scuffling, but he heard a shot and saw the suspect hit the ground.
was also advised that MSP investigators would be there to speak with him.
I remained on scene at Nelson and Griggs until MSP investigators were done. I then drove Officer Schurr's car back to the GRPD motor pool
where it was secured. The AED from this cruiser was taken as evidence by MSP.

I arrived on scene and worked with the resident, to share the video that was captured of the officer involved shooting. has
Xfinity at the address which provides home security that includes an exterior mounted camera and doorbell cameras. accesses the
surveillance video via her cellular phone.
Using her phone, and the Xfinity App, I was able to share several videos video text message to my department issued cell phone. The Xfinity
application would only allow the sharing of videos in clips that were about 2 minutes in duration. I shared a total of 17 clips from two different
cameras.
I asked if she would allow me access to her account via my laptop because I believed the mobile version of the application was now
allowing her to share longer clips. did not feel comfortable logging into her account on my laptop. She tried to access her account on
her tablet but was unsuccessful.
While on scene, I made contact with Captain Bylsma who was debriefing the Michigan State Police investigators who were conducting the
investigation into the shooting. Sergeant Turbergen provided me with his business card so that I could share the videos to him as soon as
possible. I sent each of he 17 videos to him via text message.
When I returned to the Grand Rapids Police Department, I uploaded the videos to Evidence.com where they were stored under this report
number.

Upon arrival the initial scene was secured. R/O was directed by Sgt Calati to canvas the houses on the west side of Nelson Ave, between
Griggs St and Orville St. At 0828 hours R/O began the canvas.
and heard one gun shot but were in bed on the back side of the house. Both ran to the front and looked
outside. They said they saw several police officers giving commands and a subject in a white sweatshirt being arrested. Then they went up
to the subject on the ground.
- No one home
- said he heard yelling and then heard one gun shot. said when he went to the front window he saw one subject
down on the ground and a group of police officers moving towards him.
said she was sleeping, as was everyone else in her house. did not see or hear anything. has a
Ring Doorbell and the camera captured video of the traffic stop and full incident. This information was relayed to Sgt. Calati and then to Det.
Weston.
- said him and his wife did not see or hear anything.

- did not see or hear anything. He does have an operating Ring Doorbell.

On arrival, Sgt. Calati and Sgt. Johnston were already on scene, securing witnesses and protecting the scene. I then met with Officer Schurr
who was sitting inside of a police cruiser. I checked Officers Schurr's physical welfare and confirmed that he was not injured.
I then obtained a public safety statement from Officer Schurr for the purpose of obtaining specific information needed to assist in the
investigation, safety of the public and preservation of evidence.
Following the public safety statement, I assigned Officer Patrick Martin as Officer Schurr's companion Officer and then requested that medical
respond to check Officer Schurr's vitals. After being medically cleared at the scene, I directed Both Officer Martin and Ofc Schurr to respond
to the training unit at HQ.
I then remained on scene until MSP cleared the scene following their investigation.

At approximately 8:11 a.m. I heard Officer C. Schurr working unit 1915 call over the air that he was initiating a traffic stop in the area of
Nelson Ave SE and Griggs St. SE. Briefly after this Officer Schurr notified units via radio that he had one flee from the vehicle running North.
At this time Officer Mott and I began to head to the area to assist with the apprehending the suspect.
As Officer Mott and I were in route to Officer Schurr's location Officer Schurr notified units via radio that he had been involved in an officer
involved shooting. Officer Mott and I then arrived on scene and I observed Officer Schurr positioned North of Griggs on Nelson, Officer
Schurr was on the East side of Nelson. It appeared that Officer Schurr was still holding cover on a black male who was lying face down in a
front yard Northeast of Officer Schurrs location. At this time I positioned myself behind cover next to Officer Schurr and held lethal cover on
the described suspect in the yard. The suspect was located in the front yard of a house located approximately three to four houses North of
Griggs on the East side of the street. The suspect was in the front yard of a yellow colored house and was laying North of a driveway. The
suspect's feet were facing Southwest (towards Nelson) and the suspect's head was facing Northeast (towards the described yellow house).
Suspect was a black male, approximately 25-35, approximately 200 lbs, braided black hair, medium complexion, grayish jeans.
As I was holding cover on the suspect I was notified by Officer Mott and Sgt. Johnson that there was an additional suspect involved with the
investigation. Officer Mott and Sgt. Johnson announced that they were addressing a passenger involved with the suspect vehicle. Officer
Mott and Sgt. Johnson announced that the suspect was in custody and briefly after additional officers were able to secure the vehicle, which
was clear of additional suspects.
Once the suspect vehicle was announced clear Sgt. Calati, Sgt. Johnson, Officer J. Sanders, and I approached the suspect to provide
medical aide. As we approached, the suspect was laying face down in the yard and appeared to have a gunshot wound to the rear of his
head. Announcements were made to the suspect to display his hands and the suspect did not move, his right arm was positioned under his
body and was not visible. The suspect was addressed and positioned face up, the suspect at this time was unresponsive and CPR was
immediately initiated by officers. At this time I provided cover for the officers providing medical aide as a result of not knowing if there were
additional outstanding suspects involved in this investigation. CPR was continuously performed by Officers, Fire and EMS and a defibrillator
was attached to the suspect as well. As medical treatment was being provided I did not observe the suspect display any signs of life and he
was later pronounced as being deceased. Two new medical tarps/blankets were used to cover the suspect and additional evidence, which
was a Taser, body worn camera, and what appeared to be blood on the dirt, that was positioned directly South of the suspect.
It appeared that prior to positioning the suspect face up that he was laying on top of or directly next to the Taser and body worn camera. It
also appeared that the described Taser had been discharged and I observed Taser wires and a Taser probe near the suspect.
When the suspect was pronounced deceased I was relieved from the suspect's location and assisted Officer Mott with removing the other
involved suspect, from our police car and placing him in Officer Partak's police car. I observed Officer Mott search
and released the wallet and phone to Officer Pratak. No additional action taken.
I remained on scene until the scene was declared secure and Officer Mott and I were relieved by Sgt. J. Dionne.
There did appear to be a black male, approximately 30 years old, recording the incident from inside of the yellow house.
Weather conditions: sleet (medium-heavy down pour), approximately 35 degrees, cloudy. Fahrenheit.
On Monday, April 4, 2022, at 0811 hours Officer Grace and I were a two-man unit under callsign 1625. We were assigned to the south
service area operating marked police cruiser 3474. I was the driver while Officer Grace was the passenger. While patrolling the area of 1100
Bemis we heard radio traffic from Officer Schurr conducting a traffic stop near Nelson and Griggs St SE.
A short time later we heard Office Schurr state he had a subject running Northbound on Nelson just north of Griggs St SE. At this time, I
activated my emergency lights and sirens near Bemis St SE and Eastern Ave SE. While enroute to the area of Nelson Ave SE and Griggs St
SE, dispatch raised Officer Schurr multiple times with no response.

Officer Schurr came back over the air stating he needed units and he had been involved in a shooting. Officer Grace and I arrived on scene
as well as Sgt. Johnston at the intersection and immediately approached from South of Officer Schurr’s location. I observed Officer Schurr to
the left of a parked vehicle. At this time, Officer Grace provided lethal coverage on a suspect laying face down to the East of the street. The
subject was approximately 10 yards East of the curb in a front lawn. The suspect was oriented in a north-south direction with his feet to the
south. I was unable to see the suspect’s hands from my position. I, along wit Sgt. Johnston, began to address another male who was
standing next to the open passenger side door of a car in the middle of the street.
I transitioned to hands free and place the unknown male into handcuffs and immediately conducted a pat search of his person with nothing
illegal found.
I proceeded back to my vehicle on Griggs St SE and placed the male, later identified as , in the back of my patrol vehicle.
While walking back to the patrol car I asked if there was anybody else with him or any weapons to which he replied no. stated his
wallet was in his pants and I removed his wallet and phone from his person and placed it in the front of the vehicle. I noticed his phone was
on camera mode however, it did not appear to be recording. I placed ’s phone on airplane mode. asked several times “Is my
friend alright?” I told I did not know anything and that I was sitting with him. At no time did I question or read his
constitutional rights.
I informed Sgt Dionne that I had the in my cruiser. Sgt Dionne instructed me to sit in the vehicle and to not question or read the Miranda
rights to the .
The decision was made to have Officer Partak transport to the police station for further questioning. I removed from the back of
my vehicle and walked him to Officer Partak’s vehicle. Prior to placing him in the back of Officer I checked spacing and double locked the
handcuffs. was searched once more and placed in Officer Partak’s vehicle.
At this time, I returned to my vehicle prior to Sgt. Dionne instructing myself and Officer Grace to clear from the scene. We proceeded to HQ
and placed our body worn cameras on the docking station for the video to upload.
This statement is to the best of my recollection without having reviewed body worn video.
At approximately 08:11 hours on 04/04/22, I responded with other officers to Nelson Ave SE & Griggs St SE.
I initially heard Ofc. Christopher Schurr broadcast over the radio that he was making a traffic stop at that location, followed shortly after by an
update that a subject was running NB. I began driving emergency to the scene at that time.
I heard Ofc. Schurr broadcast a request for additional officers before advising over the radio that he had been involved in a shooting. Ofc.
Schurr advised over the radio that he was okay, but the suspect was down.
ACTIONS ON SCENE
As I arrived on scene, I was directed to Nelson Ave SE & Orville St SE to block any SB traffic. I blocked the street with my patrol vehicle and
initially ran to the scene to determine if any assistance was needed there.
As I approached, I observed multiple officers turning the suspect over onto his back, preparing an AED, and beginning CPR. The suspect's
eyes were open and motionless and there was frothy blood coming from his nose and mouth. I did not see any obvious movement or other
signs of life.
Due to the number of officers already rendering aid, I returned to my patrol vehicle to secure the perimeter and ensure that Fire and EMS
could access the scene from Orville. I assisted with taping off the street and remained posted at Nelson & Orville for the remainder of the
incident.
Nothing further.
When I arrived on scene there was already several Officers up at the immediate scene who advised that there were no outstanding suspects.
I assisted in putting up crime scene tape at nearby cross streets to secure the scene for investigation purposes.

I arrived on scene and was directed by Sgt. Dionne to help with the canvass of the area. I knocked at and was advised by a
neighbor that the residents weren't home. I noticed a ring camera installed on the door, but it was facing towards Griggs St, and most
likely wouldn't have captured the area of the scene.
I spoke with the resident at who told me she heard one gun shot but nothing else. I spoke with the resident of
who did not hear or see anything. I made contact with the resident at who told me her young daughter reported hearing one
gun shot but nothing else.
Finally, I spoke with the resident of told me he heard one distinct gun shot this morning, but didn't
see or hear anything else. I asked about cameras and pointed out a camera that was mounted on the north side of his house. The
camera angle points north along Nelson Ave and appeared to be pointed in the direction of the scene. said he would review his
footage to see if it captured anything. He also noted that the videos store for at least a month and he'd be willing to share whatever he had
with detectives if needed.
Once my portion of the canvass was complete, I was instructed by Sgt. Calati to relocate to the north end of the perimeter. I assisted with
blocking the intersection of Nelson Ave and Orville St until advised by Cpt. Bylsma that we could clear.
Upon arrival, I blocked the roadway at Griggs St SE & Newark Ave SE with my cruiser.
I strung evidence tape along the west side of Nelson Ave SE, from Griggs St SE to Orville Ave SE. I was then tasked with providing scene
security to protect evidence. Once I was relieved of my post by additional officers and MSP, I held a perimeter position at Griggs St SE and
Newark Ave SE.
Upon arrival, I found Ofc. Schurr standing a short distance away from the scene with Sgt. Dione. I was assigned to be Ofc. Schurr's
compation officer and had him sit in my cruiser. The weather outside was terrible; cold, rain/snow and wind.
Ofc. Schurr's uniform pants had dirt and mud on them, along with his duty belt and hands. His ECD was missing from its holster. Ofc. Schurr
was out of breath and coughing, as one does after hard physical exertion in the cold. He asked for water, but I had only a very small amount
in a bottle I already drank from. I retrieved his water bottle from his cruiser so he could have a drink.
I stood by with Ofc. Schurr until LIFE Ambulance arrived to check on him. After medics cleared him, we went downtown to meet staff at the
GRPD training unit. I collected Ofc. Schurr's outer clothing, boots and body armor in paper bags at Forensics' request. Body armor was too
big to fit in a bag but was left with the other clothing.
Ofc. Reinink drove Ofc. Schurr's vehicle home and I picked Ofc. Reinink up to bring him back to GRPD Headquarters.
INFORMATION:
At approximately 0823 hours I self dispatched to Nelson and Griggs SE after hearing that an officer had been involved in a shooting.
I arrived and was directed to block the intersection at Griggs and Silver SE which was accomplished using crime scene tape and my cruiser.
I was then directed for traffic control at the intersection of Griggs and Nelson. I was summoned to by a female who asked
what was going on. I asked her if her or anyone inside had seen the incident. She replied that no one had. I continued to provide traffic
control - ingress / egress to the scene.

SN13430576 I requested submit to a PBT and he agreed. His BrAC registered .186.
I advised we would provide him a ride anywhere he wanted to go and he refused numerous times and just wanted to leave. Ofc.
Partak and I escorted him to the lobby and he left on foot.

I responded to HQ and opened the large classroom in my office. A short time later Officer Schurr and Ofc P. Martin came into the office
along with Officer Reinink as his Union representative.
I conferred with Lt Forner reference conducting a round count of Officer Schurr but we needed Forensics to photograph / process Ofc
Schurr's uniform and gun belt prior to that. Once that was completed Ofc Schurr was allowed to shower and change over into his street
clothes. We then conducted a round count in the Training Unit armory outside my office. Lt Forner was present along with a MSP D/Sgt. Ray
Sowa. Ofc Schurr was also present. I emptied each spare magazine and each contained 17 rounds. I cleared the chamer of his issued Glock
17 Handgun, Serial number BMWR151 and emptied the magazine in it. There were 17 rounds total between the round in the chamber and
the magazine. There were 51 total rounds counted.
After I conducted the count I left the armory and Forensics left with the evidence to be tagged. See other's reports for more information.
On 04-04-22 at 0810 hours I responded to the area of Griggs/Nelson in reference an Officer Involved shooting.
Once on scene myself, Ofc. LaHuis and Sgt Johnston cleared the vehicle related to the traffic stop. After clearing the vehicle I immediately
grabbed an AED to provide life saving measures.
I applied the AED pads on the subject. The AED did not advise a shock. Myself and Sgt. Johnston performed CPR on the subject until we
were relived by GRFD.
Once the scene was secured, Sgt Calati directed me to canvass the immediate area. I canvassed the following dwellings :

Detective Roszkowski was then contacted and asked to respond to the scene. Roszkowski has some additional training and expertise in
video systems. Roskowski was able to obtain a couple video clips of the incident from
Detective Johnson and I stayed on scene until Detectives from MSP arrived on scene. The video clips were forwarded by Roskowski to the
MSP Detectives and we briefed them on the circumstances surrounding the incident as we understood them. I was also advised that Officer
Schurr's body camera was still activated on the ground near the decedent. This information was also relayed to MSP Investigators.
Johnson and I then were instructed to return to GRPD Headquarters and assist with getting two of the MSP detectives to the Major Case
Team Interview area so they can speak with a witness.
While at my desk and after hearing an officer ask for additional officers, he then advised he was involved in a shooting (OIS) and the suspect
was down. Det. Weston and I responded to assist the scene, which was in the 1700 block of Nelson (just north of Griggs St SE.) The area
was cordoned off from Orville to Griggs on Nelson, securing the entire block. We were advised that per GRPD policy the Michigan State
Police would be responding to handle the investigation.
Upon arrival we were briefed by Sgt. Calati and were advised the suspect was not transported and he was still on scene. We walked up the
middle of Nelson and observed a body underneath a yellow blanket lying on the south lawn of with his feet partially on
the driveway of
Det. Weston and I were advised there was a surveillance camera at the southwest corner house (Nelson/Griggs). We contacted
who lives at and he confirmed he’d checked his cameras which are all motion activated, but nothing was located,
other than when all the officers were arriving on scene. See Det. Allen’s report for his initial contact. I asked if he’d heard anything, and
said he was in bed when he heard a loud gun shot, which is also what he’d told Ofc. Allen.
Det. Weston and I then began to check for additional cameras in the area. A camera was detected at and as we were
walking toward the front door Ofc. Newton advised that he’d just spoken to a female named who advised her camera did capture the
incident. A male opened the front door and we asked if was there, and she then came to the front door. I was able to view the camera
footage on her phone and she then tried to email it to Det. Weston, but the file was too big, so we had Det. Roszkowski respond so she could
obtain the file properly.
Once MSP arrived on scene and were briefed, Det. Weston and I cleared and we escorted two MSP detectives from the scene to the motor
pool, and then up to the Major Case Team iinterview room where the front seat passenger was waiting to be interviewed.
We stood by during the interview but nothing more was needed from us.

I contacted MCT Detectives Weston and Johnson who were already preparing to respond after hearing the same radio traffic. I directed both
to respond to the scene and advised that I would also be en route.
I responded directly to the scene and found that a solid perimeter had been established and that the scene itself had been secured. I met
with Sgt. Tim Johnston who briefed me on the incident. Sgt. Johnston advised that he obtained a public safety statement from Officer Schurr,
assigned Officer Martin as a companion Officer, and that both had been cleared from the scene and were en route to the Training Unit. Sgt.
Johnston also advised that a passenger from the suspect vehicle was taken into custody and was being transported to HQ.
Detectives Johnson and Weston were tasked with assisting with the neighborhood canvass and reported back that they located a resident
with a ring camera that captured much of the incident. I asked that they contact Det. Katie Roszkowski and have her respond to the scene to
assist with video retrieval.
I met with DC Rifenberg who was on scene. DC Rifenberg advised MSP had been contacted and their OIS investigators were en route to the
scene. MSP Detectives arrived on scene and I met with D/Sgt. Aaron Tubergen who advised he would be the investigator in charge. I
briefed D/Sgt. Tubergen on the incident, did a walk through of the scene, and advised him of video being retrieved from a nearby home. I
also advised D/Sgt. Tubergen that the passenger from the suspect vehicle had been detained and was transported to HQ for eventual
interview. D/Sgt. Tubergen tasked two MSP Detectives with responding to HQ to interview the passenger and I tasked Detectives Weston
and Johnson with returning to HQ to assist as needed.
I remained on scene for the duration and was the point of contact for MSP as the scene was processed. Once notified by D/Sgt. Tubergen
that the on scene investigation was complete and MSP was clearing I cleared all GRPD personnel and ensured that all perimeter tape was
removed.

The defendant was charged with: Count 1: Operating While Intoxicated Third Offense and Count 2: Drove
While License Suspended/Revoked/Denied/Never Applied.
The defendant was arrested for the instant offense on 03/29/2021. He satisfied a $500 PR bond and was released
the same date.
On 02/24/2022, the defendant plead guilty to Count 1: Operating While Intoxicated Third Offense. In exchange,
count two is to be dismissed at sentencing. Additional details of the plea agreement were not provided. Count 1
is a felony punishable by $500-$5,000; and either 1 to 5 years, or probation with 30 days to 1 year in jail, at
least 48 hours to be served consecutively, and 60 to 180 days community service; rehabilitative program(s);
costs of prosecution; reimburse government for emergency response and expenses for prosecuting
defendant; vehicle immobilization mandatory if the two prior offenses are within 10 years of the current
offense or one of the prior offenses is within 7 years of the current offense.
Following the plea hearing on 02/24/2022, the defendant reported in person to the Allegan County Circuit Court
Probation Office, accompanied by his attorney, Anthony Greene. The defendant provided the following address
and phone number: (Kent County) , no e-mail address
provided. The defendant was also given a PSI packet to fill out with specific instructions to return the packet by
a certain date, typically seven days from the date of receipt. This packet was never returned to our office.
On 03/25/2022, this agent attempted to reach this defendant by phone at the number he provided. There was no
answer, but there was a voice mail message, indicating the phone belonged to this defendant. A message was
left requesting a return phone call, one was not received.
On 03/29/2022, this agent attempted to reach the defendant a second time by phone. Another message was left
requesting a return phone call, one was not received.
On 03/30/2022 at approximately 1128 hours, this agent contacted Attorney Anthony Greene. Attorney Greene
advised this agent that he was present when the defendant reported to the Probation Office. He indicated that he
spoke with the defendant about the PSI packet and offered to assist the defendant with filling it out, however,
the defendant never contacted him requesting assistance. He further explained that the defendant has difficulty
understanding English, so he was not sure all of what he understood regarding this obligation. Attorney Greene
advised he would make attempts to reach the defendant today and get back with this agent. I advised Attorney
Greene that a PSI Case Report would be completed, detailing the lack of contact. If the non-compliance is due

to a language barrier, I advised Attorney Greene that I would have no objection to this sentence being
adjourned.
This agent did speak with the clerical who met with the defendant and provided the PSI packet and instructions,
she felt the defendant understood what she was explaining to him. I did also reach out to PA James Bergman, as
the defendant is currently on Probation through ICOTS in Kent County. Agent Bergman has supervised the
defendant since May 2021. Agent Bergman advised, "He can be difficult to understand sometimes, but he
appears to comprehend when spoken to."
This agent did check with the Allegan County Jail and the defendant has not been incarcerated in the jail since
his original arrest. The defendant does appear to have some open cases in Kent County. This agent did check
the Kent County Jail online inmate lookup on 03/30/2022, this person was not currently in their custody. A
check of Vinelink did not reflect the defendant was currently in custody in a jail within Michigan.
On 03/30/2022 at approximately 1328 hours, this agent received a phone call from the defendant. The defendant
stated he had some missed calls from this number and wanted to know who this was and why I was calling. I
asked the defendant if he had listened to any of my messages, he stated he did not. I advised him who I was and
the purpose for my call. We then discussed the PSI packet, which the defendant claims he filled out and mailed
back to the probation office last week. I asked the defendant how many stamps he put on the envelope, he stated
one. I advised him that per the instructions given to him by clerical, both verbally and in writing, that he needed
more than one stamp or it would not be delivered. I also asked him if he had spoken to his attorney on this date,
he stated he had not. I advised the defendant he needed to contact his attorney, because at this point there was
not sufficient time to complete the PSI. I advised the defendant he would still need to appear for sentencing, as
scheduled on 04/04/2022.
If the defendant does appear for sentencing, defer to court regarding revocation of bond pending the completion
of a PSI interview. During my interactions with the defendant, he appeared polite and willing to cooperate. The
defendant also appeared to understand what I was saying and responded to me appropriately. If the defendant
does not appear for sentencing, it is recommended that his bond be revoked and a bench warrant be issued.

04/07/2022 Other Message sent to Illinois........On 4/5/22 the defendant was pulled over for having a bad plate on his
vehicle. He was escorted out of the vehicle and then fled on foot. The officer gave chase and
caught the defendant. A 2-3 minute fight ensued and the defendant was able to take the officer's
taser. The officer than pulled his service weapon and shot the defendant. The defendant died on
scene. The passenger in the vehicle was highly intoxicated and labs on the defendant are not back
yet. Michigan State Police are conducting the investigation. Michigan will submit a case closure in
the up coming days. The attachment includes the original news article and the update where the

04/05/2022 TXF, Received call from MDOC/GRPD Embedded agent advising that the Probationer (P) was involved
TXT, in an officer involved shooting, in the area of Griggs and Nelson, in which the P was fatally shot.
TXT, Initial information received is that GRPD pulled over a vehicle driven by the P and occupied by a
Case Staffing, front seat passenger, due to an improper plate. Upon stopping the vehicle, the male passenger
CC-LE exited the vehicle and took off running. At some point the P got a hold of the officers taser at
which point the office drew his firearm and fatally shot the P. The passenger was reported to have
been heavily intoxicated. It is unknown at this time if the P was intoxicated. He is serving for OWI
and has a pending OWI 3rd charge. MSP is conducting the investigation and the report may not be
ready for a couple days. The P is an ICOTS probationer from Illinois. Supervising agent is on

Good Morning,
We received word from attorney Green requesting an adjournment for the sentencing for People v
Patrick Lyoya (21-24500-FH) for Monday due to not completing his PSI. It is my understanding that
Mr. Lyoya mailed in his PSI packet but it was not received by probation. The Court will be
adjourning this sentencing out to May 2, 2022 to allow for more time for Mr. Lyoya to complete his
PSI packet and provide it to the probation department.

03/30/2022 TXF Txf- Defendant. He asked who was calling, stating he had received some missed calls from my
number. I asked him if he had listened to my voice mail messages, and he stated he had not, just
seen the missed calls and was calling to see who this was. I identified myself and advised him I
was calling to schedule a PSI interview, but due to the no contact there was no time. Discussed his
PSI packet. He stated he mailed it to us, last week maybe. I advised him we did not receive it and
asked him if he put more than one stamp on it when mailing. The mailing instructions given to him
advise more than one stamp is needed for postage. He stated he only used one stamp. I asked him
if he spoke with his attorney today, he stated he had not. I advised him to contact his attorney
regarding his sentencing hearing. I informed him that he could not be sentenced without the PSI
and it was too late to do it now. Told him he was still required to appear for sentencing, as
scheduled, on 04/04/22. He stated he understood. I did not feel the defendant was having difficulty

03/30/2022 TXT, Txt- Defendant's Attorney, Anthony Greene. Advised him that the defendant has not complied with
CC-SN the PSI process for his upcoming sentencing hearing. Attorney Greene advised that he was with
the defendant when he reported to the office following his plea. I advised Attorney Greene, at that
time, he was given a packet to fill out with instructions to return it, and he never did. The defendant
has also not responded to my phone calls and requests for a return phone call. Attorney Greene
suggested that there may be a langauge barrier, stating that the defendant does not understand
English as well as he thinks. He stated he would attempt to get a hold of his client and get back to
this agent. I advised Attorney Greene I would be preparing a PSI Case Report to the court

Disposition of Evidence:
Evidence items L5 and L6 were placed in secure storage upon return to the lab. Two probes that were
unearthed from the ground near the decedent and the connected wire were disconnected from the taser (L5)
and turned over to D/Sgt. Aaron Tubergen at the scene on April 4, 2022, at 1:32pm.

Possible bodily fluids or other potential sources of DNA were collected at the crime scene. Please submit
known/reference DNA samples from the victim, suspect and/or other relevant parties.

Latent print evidence was collected at the crime scene. Please submit known finger and palm impressions from

Item L6 (9mm Luger caliber fired cartridge case) is identified as having been fired by item 2 (Glock pistol).
Item 4A (fired metal jacketed bullet) is inconclusive as having been fired by item 2. These items share
agreement of class characteristics but lack sufficient agreement of the individual characteristics observed within
the land impressions.
Item 4A is consistent with being a .38 class fired metal jacketed bullet displaying Glock Marksman Barrel
(GMB) rifling specifications of six lands and grooves with a right twist. Physical characteristics and rifling
specifications of item 4A are most consistent with bullets fired by 9mm Luger caliber firearms produced by
Glock. However, no suspected firearm should be overlooked.
Item 4B consists of three small metallic fragments and are consistent with being made of lead. These items
cannot be further classified and are not suitable for comparison purposes.
Test shots from item 2 and item L6 do not meet the MSP Forensic Science Division protocol for entry into the
National Integrated Ballistic Information Network (NIBIN) database. Test shots from item 2 will be returned to
the submitting agency.
The following descriptions are meant to provide context to the levels of opinions reached in this report.
• Identification: This is the strongest statement of association that can be expressed. An identification is
made to a degree of practical certainty when there is agreement of all discernible class characteristics
and sufficient agreement of the individual characteristics of toolmarks. When sufficient agreement
exists, in part, this means the likelihood of another tool producing the same marks is so remote it is
considered a practical impossibility.
• Elimination: This is the strongest statement of non-association that can be expressed. An elimination
is made when it is physically impossible (i.e., there is a clear, demonstrable incompatibility in class
characteristics) for the items to have been marked by the same tool/fired in the same firearm.
• Unsuitable: An item is considered unsuitable for comparison when it does not bear any class,
subclass, and/or individual toolmarks of value for microscopic comparison.

Upon arrival I spoke with in her apartment. She was crying and would continually hold her face and
head, which she said hurt from Patrick assaulting her. stated that tonight, her and Patrick were in the
parking lot of the apartment complex outside of her vehicle. She said that Patrick started an argument with her
because he wanted to take the bedsheets she had just purchased, but she did not want him to have them. During the
