An Act Legalizing Marijuana For Personal Use and Providing Penalties in Violation Thereof
Section 17. Denial of license. The state licensing authority may, for good cause,
deny approval of a license application. Upon denial of a license application, the
state licensing authority shall inform the applicant of the basis for denial and the
right to appeal the denial in a hearing.
Section 18. Personal use of marijuana.
1. Person 21 years of age or older. A person 21 years of age or older may:
A. Use, possess or transport marijuana accessories and up to 20 grams of
prepared marijuana;
B. Purchase up to 20 grams of retail marijuana and marijuana accessories
from a retail marijuana store; and
Section 19. Use. A person may consume marijuana in a nonpublic place
including a private residence.
A. The prohibitions and limitations on smoking tobacco products in
specified areas.
B. A person who smokes marijuana in a public place other than as governed
commits a civil violation for which a fine of not more than Php 5,000.00
may be adjudged.
C. This subsection may not be construed to shield any adult from criminal
prosecution.
D. This subsection may not be construed to allow any adult to possess or
consume marijuana on government property.
Section 20. Separability Clause. Should any provision (s) of this act be declared
invalid or unconstitutional by a court of competent jurisdiction, the same shall not
affect the validity of the other provisions not so declared;
Section 21. Repealing Clause. Any act, rules and regulations or part thereof which
are inconsistent or in conflict with the herein act are hereby repealed, amended or
modified accordingly;
Section 22. Effectivity. This act shall take effect one (1) month after its approval
and publication.
