Contract of Employment

To:

Effective this date, ________________ you are hereby appointed as _____________________ of


Heavens Best Entertainment assigned at ____________________________________________.
You shall be paid actual work rendered. Special, legal/regular and overtime services shall be paid
accordingly if and when the company so required you to perform services on such occasions.

It is hereby understood that your appointment is on temporary status of _____________, during which
period the company may terminate your services for any cause without liability to the agency
whatsoever. It is also understood that you will abide by all the policies, rules and regulations of the
company.

Your basic hourly rate will be _________________________________________ (PHP ___________) of


which shall be subjected to the mandatory Withholding Tax, SSS, Pag-ibig, Philhealth contribution and
payable every ______ day of the month covering the payroll period from ____________ day of the
succeeding month, and _________ day of the month for payroll period __________________.
Heavens Best Entertainment shall deduct from its Project employees its corresponding mandated
benefits and shall remit the same with its corresponding employers share respectively.

Heavens Best Entertainment shall deduct P_______ as Placement Fee; the fee shall cover the following:

 Documentation
 I.D. with lace
 DTR/Forms
 Group Insurance

Employees shall be covered with a Group Personal Accident Insurance where an amount of
________________________ shall be collected as insurance premium during one’s contract of
employment. Employees who cease to be employed with Heavens Best Entertainment on or before the
expiry date of employment contract ceases to be covered for the said accident insurance. When the
employment contract is extended or when the employee gets a new contract with another client, a
premium payment of ______________ shall be collected to hold them covered with an accident
insurance for another employment term.
ADMINISTRATION OF SALARIES AND BENEFITS

A. Procedure

You will be required to submit 2 time sheets and a time card for each pay period, duly signed by
the designated Coordinator or the duly authorized representative of Heavens Best
Entertainment which shall be the basis for payment of your services. The time sheet should be
properly accomplished and submitted every _____________ day of the current month.

B. Policies

i. Only those time sheets and time cards approved and signed by the immediate
supervisors will be included for payment in the payroll summary.
ii. Failure to comply with the above schedule shall cause a delay in the release of one’s
salary.
iii. Salaries shall be distributed through _______________
iv. Payroll release shall be on the preceding Friday when the schedule falls on a Saturday
v. Payroll release shall be on the preceding Monday when the schedule falls on a Sunday.
vi. Payroll release shall be pre-announced when the schedule falls on a holiday.

You will be paid all other amounts due as mandated by the applicable Labor Standards Law.

C. Shcedule of Salary Adjustments

i. First Scheduled Salary


- Placement fee
- Madated Contributions (SSS, Tax, Philhealth and Pagh-ibig)
- First 5 days of employee’s covered cut-off period.
ii. Second Scheduled Salary
- Continuation of the 10-days policy adjustment

Note: An adjustment period of 10 days which will be collected in the first two (2) payroll; 5 days each
payroll, this will help employees with their savings and future expenses that may occur during your
employment. The full amount, or your total contribution to the fund, or the balance thereof will be
refunded to you upon cessation of your employment subject to the following conditions: 1) Submission
of a) properly accomplished clearance from Accountability Form b) signing of a quit claim and release
form issuance by Heavens Best Entertainment, and 2) payment to Heavens Best Entertainment by the
Principal of the last bill where you are still included.

Heavens Best Entertainment may deduct and retain from your compensation the value of the
Principal’s property that may be broken, destroyed or lost through your negligence or carelessness, and
the amount of any indebtedness owed by you to the Principal. By affixing your signature to this
agreement, thus, you specifically authorized the Principal to deduct and retain whatever amount is
established to be due to the Principal by reason of your negligence or carelessness.
It is understood that all records and documents of Heavens Best Entertainment and all information
pertaining to its business affairs are confidential and, therefore, disclosure or reproduction of such
records, documents and information may not be made without appropriate written authority from
either of the two. All such records, documents and information in your possession shall be immediately
turned over to Heavens Best Entertainment upon termination of this contract without need of any
demand or at any time thereafter. Use or disclosure to any person or entity of any such records,
documents or information concerning the business or affairs of the company, whether or not there is
any benefit to you, to Heavens Best Entertainment or whether or not the same results in damage to
you, to Heavens Best Entertainment constitutes a violation of this employment contract and is a ground
for termination of your employment with us. Violation of this agreement is punishable by law.

You are expected to devote your time and energy towards the performance of the duties and
responsibilities assigned to you, which may be changed at any time and from time to time. You are
expected to refrain from engaging directly or indirectly in any activity or business transaction for
yourself for any other person, whether or not for remuneration, direct or indirect, contingent or
otherwise, that may in anyway compete with any operation of the company or that which may result in
a conflict of interest or otherwise adversely affect the proper discharge of your duties with, and
responsibilities to the Principal. In case of a violation of this undertaking, Heavens Best Entertainment is
free to dispense your services at any time at its discretion without any obligation on its part.

You may resign from your employment after submitting a written notice at least 30 days before you
leave.

As an employee of Heavens Best Entertainment, you declare that you are voluntarily entering into this
contract of employment and that there is no inducements, promises, terms, conditions and/or
obligations made or entered into other than those therein contained.

Important: All applicants who are lined up or have been hired for any casual or project-based
employment accomplish the following:

2. Employees (causal or project-based) shall be enrolled with SSS, Pag-ibig and Philhealth.
3. Employees shall be covered with a Group Personal Accident Insurance where an amount of
________________________ shall be collected as insurance premium during one’s contract of
employment. Employees who cease to be employed with Heavens Best Entertainment on or
before the expiry date of employment contract ceases to be covered for the said accident
insurance. When the employment contract is extended or when the employee gets a new
contract with another client, a premium payment of ______________ shall be collected to hold
them covered with an accident insurance for another employment term.

4. Schedule of Deductions
a. First Scheduled Salary

II. Employee’s payment for SSS & Pag-ibig loans

d. For warehour and production-based employees

5. Employees shall deposit with the Company an amount not exceeding _______________ to be
known as Salary fund, via salary deduction of _______ every end of the month as stated above
until the amount of _________ is completed. This amount shall be utilized to answer for or to
pay whatever obligation, financial or otherwise that, the employee may incur by reason of this
employment/assignment. Said amount of the balance thereof, after paying any accountability,
will be refunded to the employees upon termination of his contract, provided the following
requirements are fulfilled.
a. Submission of properly accomplished “Clearance for Accountability Form” as signed and
approved by the client-company
b. Signing of “Quitclaim and Release form”
c. Payment by the client-company of the payroll bill where the concerned employee was last
included.
d. Surrender of company ID and other accountabilities that may be requested for submission
before the salary refund is released including 13 th month pay.
e. When the company ID is lost, the employee shall pay penalty of _________ plus duly
notarized affidavit of loss.
6. All cash amounts that may be due to any employee must be collected 60 days from the date of
supposed released. Otherwise said amount will be forfeited.
