2. How can industrial designs be protected?


Under current intellectual property laws, industrial designs may potentially be protected
through design patents, trade dress, and copyright.

3. What is the legal definition of intellectual property?


Intellectual property refers to creations of the mind. It can be an invention (patent / utility
Model), a design (industrial design), a brand name (trademark, or a literary and artistic
Works (copyright)).
Intellectual Property are intangible rights protecting the products of human intelligence
and creation, such as copyrightable works, patented inventions, Trademarks, and trade
secrets.

It is important for anyone to protect his or her ideas. For entrepreneurs, it is essential to
safeguard this investment. Intellectual property rights (IPR) can be used to protect the
technology, brand name, design and creativity behind the concept. It gives the creator
sole ownership of the concept, in a similar way to owning physical property like a house
or car. Owners can control the use of their intellectual property to gain financial reward.

There are intangible rights of intellectual property such as copyrightable works, patented
inventions, Trademarks, and trade secrets.

Copyrights protect original works of authorship, such as paintings, photographs, musical
compositions, sound recordings, computer programs, books, blog posts, movies,
architectural works, and plays. There are some things that are not “creative,” like titles,
names, short phrases, and slogans; familiar symbols or designs; lettering or coloring;
and mere listings of ingredients or contents. Copyrights protect expression and never
ideas, procedures, methods, systems, processes, concepts, principles, or discoveries.

It protects and secure the exclusive rights of scientists, inventors, artists and other
gifted citizens to their intellectual property and creations, particularly when beneficial to
the people.

Patents
An invention patent is a government-issued grant, bestowing an exclusive right to an
inventor over a product or process that provides any technical solution to a problem in
any field of human activity which is new, inventive, and industrially applicable.
Trademarks
A trademark is a word, a group of words, sign, symbol, logo or a combination thereof
that identifies and differentiates the source of the goods or services of one entity from
those of others.
Copyrights
Copyright is the legal protection extended to the owner of the rights in an original work.
“Original work” refers to intellectual creation in the literary, scientific and artistic domain.
Trade secrets
Trade secrets refer to specific, private information that is important to a business
because it gives the business a competitive advantage in its marketplace. If a trade
secret is acquired by another company, it could harm the original holder.

Examples of intellectual property rights include, patents, domain names, industrial
design, confidential information, inventions, moral rights, database rights, logos,
trademarks, design rights, business or trade names, etc.

10. How can intellectual property be protected in the Philippines?


Intellectual property such as copyright, trademark, patent, utility model, industrial design
are protected in the Philippines. The governing law is Republic Act No. 8942, otherwise
known as the Intellectual Property Code of the Philippines.

11. What is the importance of intellectual property?


Intellectual property protection is critical for fostering innovation. Without intellectual
property protection, businesses and individuals would not reap the full benefits of their
inventions and would focus less on research and development. Similarly, artists would
not be fully compensated for their works, and cultural vitality would suffer as a result.
