BARANGAY SAN ANTONIO I
WHEREAS, it is the policy of the State to value the dignity of every human person and guarantee
full respect for human rights. It is likewise the policy of the State to recognize the role of women in
nation-building and ensure the fundamental equality before the law of women and men. The State
also recognizes that both men and women must have equality, security and safety not only in
private, but also on the streets, public spaces, online, workplaces and educational and training
institutions.
WHEREAS, since 1995, sexual harassment in the Philippines has been specifically prohibited
under RA 7877, otherwise known as the “Anti-Sexual Harassment Act of 1995”. However, the
definition of sexual harassment under this law was limited and covered only the acts committed in
work, education, and training-related environments. Further, it does not penalize the acts of sexual
harassment committed in many other spaces such as the streets, in restaurants and malls, public
utility vehicles (PUV) and other public spaces.

human rights. It is likewise the policy of the state to recognize the role of women in nation-
building and ensure the fundamental equality before the law of women and men. The State also
recognized that both men and women must have equality, security and safety not only in private
spaces but also in public spaces.
WHEREAS, the passage of RA 11313, otherwise known as the Safe Spaces Act (SSA) expands the
law on sexual harassment in the country to cover all of its forms including verbal and physical.
Further, it seeks to secure all persons regardless of sex, sexual orientation and gender identity
expression, from all kinds of gender-based violence and discrimination such as sexual harassment,
not only in private spaces but also in public spaces.
WHEREAS, the Department of the Interior and Local Government and Philippine Commission on
Women Joint Memorandum Circular No. 2020-01 dated December 7, 2020 provide the guideline
son the localization of the Safe Spaces Act and its IRR particularly the provisions of the CGSH in
streets and public spaces.
NOW, THEREFORE, I, ARNULFO S. SAQUILAYAN., Punong Barangay of Barangay San Antonio I,
Noveleta, Cavite, do hereby order:

Section 2. Functions of the BASH-TF. The BASH-TF shall have the following functions:
2.1 Craft an ordinance in line with provision stated in RA 11313, to prevent the occurrence of and
efficiently respond to Gender-Based Sexual Harassment (GBSH) in streets and public spaces;
2.2 Designated public spaces regardless of ownership and nature as safe spaces against GBSH;
2.4 Develop and distribute Information and Education Campaign materials developed by the
municipality and other entities that raise awareness for the concerns GBSH in streets and public
spaces;
2.5 Create a mechanism for handling and documentation of complaints including those cases
covered by the Katarungang Pambarangay system;
2.6 Establish an Anti-Sexual Harassment (ASH) Referral Network to
strengthen the coordination among public and private service providers in
addressing the needs of victim-survivors of GBSH in streets and public space;
and
4.3 Immediately bring the perpetrators to the nearest police station for
appropriate action; and
4.4 Together with the Women and Children’s Desk of the PNP stations, keep a
ledger of perpetrators for the purpose of determining if the perpetrators is a
first-time, second-time or third-time offender.
7.1 Receive, document and respond to complaint and reports of GBSH in streets
and public spaces;
7.2 Facilitate the referral of cases and persons to the appropriate public and
private service providers for further assistance such as legal, medical,
psychosocial, safety, security and other services;
7.3 Record the number of cases of GBHS in streets and public spaces received
and referred to other
agencies and submit a quarterly report to the DILG City Field Office and the
GAD Office;
7.4 Keep case records confidential and secure and ensure that only
authorized personnel have access to these records;
9.2 Assess the nature of the assistance needed and facilitate the referral to
ASH Desk or to the appropriate service providers for legal, medical, psycho-
social, safety, security, and other assistance or services;
11.1 strengthen the coordination among public and private service providers
in addressing the needs of victim-survivors of gender-based sexual
harassment; and
11.2 provide legal, medical, psychosocial, safety, security, and other relevant
services.
