MEMORANDUM OF AGREEMENT

Agreement of Lease
This agreement made and entered in the by and between:

CELEDONIO S. ENCINA, of legal age, Filipino citizen, widower and residing at Blk. 1
Lot 9 / 844 Congresional South Road Barangay Fatima 1, Proper City of Dasmariñas,
Cavite referred to as LESSOR.

and

MARCO V. BICUA, of legal age, Filipino citizen and residing at Blk. 2 Lot 100 Brgy Sta.
Fe, Dasmariñas City, Cavite hereinafter referred to as LESSEE.

AGREEMENT:

1. This agreement shall be a period of six (6) months only from October 1, 2020
and shall end on April 1, 2021 and renewable thereafter as may be agreed upon
by both LESSOR and LESSEE.

2. Monthly rate shall be Ten Thousand Pesos (Php 10,000.00) payable every 18th
of the month without needed of demand.

3. Upon commencement of this agreement shall pay the amount of Thirty


Thousand Pesos (Php 30,000.00) representing Two (2) months deposits and
One (1) month advance. The said deposit shall not be refunded to the LESSEE
but may be applied to the unpaid rentals or costs whatever damage that may be
sustained by the premises caused by the LESSEE upon the expiration of the
lease.

Note: September 17, 2020 paid Php 10,000.00 as 1 month advance.


September 22, 2020 paid Php 10,000.00 as 1 month deposit.
September , 2020 paid Php 10,000.00 as 1 month deposit.

4. That the LESSEE shall pay in cash the monthly rentals of the premises.

5. The LESSEE shall at his own expenses shoulder the electric and water on the
leased premises ELECTRIC depends on the meter reading monthly.

Note: incase of Zero (0) billing thru meter deposit, the LESSEE shall pay to the
LESSOR whatever amount they are paying their monthly bill.

Water payment should be fixed at Two Hundred Pesos (Php 200.00) per
month.

Note: No Laundry will take place.

6. The LESSEE shall exclusively use the leased premises for commercial
purposes.

Note: as agreed by both parties:

a.) Only the husband and the wife will spend the night in the stall.
b.) No “tambays” inside the store limited to Four (4) persons only.

7. The LESSEE shall not make or cause to be made any improvement in the
premises without prior notice or written consent of the LESSOR, it being
understood that such improvement in the premises shall be at the sole expense
of the LESSEE and in case of such authorized alterations or improvements, the
same shall became the property of the LESSOR at the expiration of the lease.

8. The LESSEE shall not directly or indirectly sublease, assign or indirectly


sublease, assign or transfer his rights under this agreement to a third party or
parties without the consent in writing of the LESSOR.

9. The LESSEE hereby expressly acknowledges that the leas premises are in good
and tenantable condition and shall comply with all laws, ordinances and
regulations of the Barangay, Municipal, City or National Government as regards
the use, occupation and sanitation of the leased premises and failure to comply
shall be at the risk expense of the LESSEE.

Note: Maintain cleanliness everyday. Garbage should be fixed every night to be


picked-up in the morning by garbage collector.

Maintain silence at all times as agreed.

10. That in case of Two (2) months of non-payment of the rental herein stipulated
or violation of any condition of this agreement, the lease shall be considered
rescinded and the LESSOR shall have the right to demand that the LESSEE
vacate the premises.

11. Any and all violations of the condition of this agreement shall be subject the guilty
party the payment of damages, aside from costs of suit and attorney’s fees.
