Dear Ms. Mendoza: This office represents Raquel V. Najera and Raymond Mendoza, as Co-Trustees of the MENDOZA FAMILY TRUST, as Amended and Restated on February 24, 2006 ("Trust"). Please accept my sincere condolences on the death of your father. The trustees are now required to provide each beneficiary with a Notification by Trustee pursuant to California Probate Code 16061.7, as well as a complete copy of the Trust. I have enclosed both for your review. Please be advised that the Trust contains a "no contest clause" at Section 8.3. Therefore, no distributions from the Trust will be made to the beneficiaries until the contest period has expired. As you know, a few years ago, Roman gave you and each of his other children $11,000, which was intended to be part of your inheritance. Notwithstanding the fact that the Trust makes no mention of specific cash gifts to children, Raquel and Raymond believe it was also your father's intent that each of his children receive a cash gift in the amount of$14,000 at the time of his death; provided that, no one contests the Trust, which reflects your father's testamentary wishes. Therefore, if no one contests the Trust, Raquel and Raymond intend to pay you $14,000 from their share of the Trust. Should you have any questions or concerns, please do not hesitate to contact me.
