COUNTER-AFFIDAVIT

I, RAFAEL TULFO y TESHIBA, of legal age, Filipino citizen,

residing at 156 Lovely Meadows, Brgy. Tangway, Lipa City,
Batangas, after having duly sworn to in accordance with law do
hereby depose and say:

1. That I am the respondent in the above-captioned case for

slight physical injuries docketed as I.S. No. 2022-02-002
filed by one Robinhood Ferdinand Padilla y Cariño with the
Honorable Office of the City Prosecutor of Lipa, Batangas.
2. That on March 10, 2022, I received a Subpoena from the
Honorable Office of the City Prosecutor of Lipa directing me
to file a counter-affidavit for the above-mentioned case
number within ten (10) days from receipt thereof, hence this
submission.

3. That I admit the allegations in paragraph 3(a) regarding the

fact that the complainant, Robinhood, and I, were supposed
to meet in front of De La Salle Lipa Gate 2 for the purpose of
betting on a cockfight held on that same day.

4. That I admit the allegations in paragraph 3(b) except for the

fact that a heated argument ensued between Robinhood and
I.

5. That I admit that Robinhood categorically uttered the words

stated in paragraph 3(c). However, I was surprised when he
said these words after I borrowed money from him politely. I
said, “Pare, baka naman pwedeng makahiram ng limang
libo. Ibabalik ko rin agad.”

6. That after hearing those words involving my wife, I still asked

Robinhood politely and repeatedly if I can borrow money
from him. To my surprise, he suddenly threw his right fist
toward me but I was able to avoid it. Due to the heavy
rainfall, the ground was slippery and wet, resulting in him
losing his balance and thereafter hitting an old fence.
Attached is a sworn statement executed by the sole witness
dated March 9, 2022, corroborating this statement and
marked as Annex “A”.

7. That I vehemently deny the allegations in paragraphs 3(e)

and 3(i) regarding my alleged statement made before the
Barangay Lupon Hearing as it strongly contradicts the
complainant’s Annex D which states that there has been no
personal confrontation that transpired between the
complainant and I. As a matter of fact, there was no amicable
settlement to begin with as I was not able to receive any
notice of any conciliation proceedings thus, it is impossible
for me to make any admissions before the Lupon.
 8. That I am executing this affidavit to attest to the truth of the
foregoing statements and for any legal purpose it may serve.

AKO, si Marko Tahimik Bilyar, Pilipino, nasa wastong

gulang, hindi kasal, na naninirahan sa 67 Purok Katahaimikan, Lipa

City, Batangas, matapos manumpa ayon sa batas, ay nagsasaad ng

mga sumusunod:

1. Noong ika – 16 ng Pebrero 2022 ay pumunta sa Lipa Cockpit

Arena upang maglaro ng sabong.

2. Habang ako ay masayang nanonood at tumataya ay biglang

may sumigaw nang malakas. Napatingin ang lahat kay

Robinhood dahil sa pagkakasigaw nito. Kasunod ay

sinubukan niyang suntukin si Tulfo (respondent). Maswerteng

nakailag si Tulfo dahilan para matumba si Robinhood dahil sa

pagkawala ng balanse. Napakadulas din kase sa loob ng

sabungan dahil malakas ang ulan nung araw na iyon.

3. Nakita kong tumama ang kanang mukhang ni Robinhood sa

bakod sa kabila ng pagsubok nitong ituon ang kanang braso

at kamay.
 4. Nagmadali akong lumapit para tulungan si Robinhood sa

pagkakabagsak nito. Agad naman siyang nakatayo ngunit

masama pa din ang tingin nito kay Tulfo.

Nilagdaan ko ngayong ika-11 ng Marso sa Lungsod ng

Lipa.
