With référence and in response to the letter dated 23 June 2022 addressed to the Président of the
Security Council, and issued as a document of the Security Council under the symbol
S/2022/509,1 would like to state the following:
Unfortunately, as it was the case in his response to the letter addressed by H.E. the Permanent
Représentative of South Africa on behalf of the Frente POLISARIO, legitimate and exclusive
représentative of the People of Western Sahara, issued as a document of the Security Council
under the symbol S/2022/414, once again, the représentative of the occupying power in Western
Sahara has unsurprisingly missed the opportunity to respond to this letter and continued to
inappropriately making a direct and misleading allégations against my country accompanied with
unacceptable accusations. This letter is totally out of context, blatantly misleading, as it is always
the case whenever the author of the letter is comered by the undeniable facts and the irréfutable
realities on the situation in the occupied territory of Western Sahara.
This letter reflects also the biased ambitious expectations from someone who is expecting
answers to his incohérent and senseless letter. An expectation that can only émanâtes from the
perfect example of his desperate zealous and blinded tendency of shooting first, aiming later.
By his letter, the représentative of the occupying power in Western Sahara offers me the
opportunity to share with the distinguished members of the Security Council and the entire
international community some fondamental cléments on the historié and irréfutable reality of the
conflict in Western Sahara, which was and remains a matter of decolonization in accordance
with the relevant resolutions of the General Assembly and of the Security Council of the United
Nations, until granting to the people of Western Sahara the exercise of his inaliénable right to
self-determination.
In fact, the présent letter aims exclusively at addressing the real questions that the représentative
of the occupying power in Western Sahara is terrified to ask, but also unable of hearing about the
reality of the conflict in Western Sahara, which he tries in vain to distort or conceal, via false and
baseless allégations, hoping that, in fine, the time will end up bringing down the Sahrawi cause
in obsolescence. This représentative and his country are not aware that the Sahrawi people have
proven for almost 50 years their capacity of resilience and struggle by defeating ail attempts to
impose a fait accompli on them.

This is proof that any solution must provide for the free expression of Sahrawi people who has
the right to décide on its future through a référendum, such as ail peuples of the world.
The considération by the UN of the issue of Western Sahara dates back to 1963 when the
Territory was listed as a Non-Self-Governing Territory under Chaptcr X I of the UN Charter.
On 16 December 1965, the General Assembly adopted Resolution 2072 on what was then called
"Spanish Sahara", in which it recalled resolution 1514 (XV) and requested Spain to take ail
necessary measures to liberate the "Spanish Sahara from colonial domination".
By virtue of this resolution, Spain was also recognized as the "Administering power" of the
Territory with the subséquent obligations as set out in the article 73 [e] of the UN Charter.
Each and every resolution adopted by the General Assembly, since 1966, have a commun
denominator, which is the récognition of the inaliénable right of the people of Western Sahara to
self-determination, and the need for its implementation through a free and fair référendum on
self-determination in accordance with General Assembly resolutions 1514 (XV) and 1541 (XV),
that détail the principles and parameters that détermine the outcomes to which the decolonization
of a Non-Self-Governing Territory could lead. This position has ever since been reiterated every
year by the General Assembly.
In its Advisory opinion on Western Sahara, issued on 16 October 1975, the ICJ has very clearly
established that:
This status was also reaffirmed by the European Court of Justice in its latest verdicts related to
the illégal agreements between the European Union and Morocco which clearly stated that
Morocco and Western Sahara are two distinct and separate territories:

This is an international récognition by the UN and the high judicial authorities that Western
Sahara is not part of the Moroccan territory, which will also allow indubitably the people of
Western Sahara to seek compensation for the illégal exploitation of their natural resources.
It is fondamental to recall that in its resolutions 34/37 of 21 November 1979 and 35/19 of 11
November 1980, the General Assembly, whilst

The "Audiencia Nacional" of Spain, has also, in its décision of July 4, 2014, established that

Secretary General about the "Information from Non-Self-Governing Territories transmitted
under Article 73(e) of the Charter of the United Nations" Spain was consistently referred to as
the administering power of the Western Sahara.
Thèse are just few cléments which prove without any doubt that Morocco is an occupying power
in Western Sahara and has no administering prérogatives, let alone any sovereignty over the
occupied territory of Western Sahara.

Third: Who proposed and undertook the partition of the territory of the occupied Western
Sahara?
Hereinafter some irréfutable facts that the permanent représentative of the occupying power
could not deny, but he rather sought to hide it in a clumsy way:
On 14 November 1975, Spain signed a déclaration with Morocco and Mauritania on the
partition of Western Sahara. This "Déclaration of Principles between Spain, Morocco and
Mauritania on the Western Sahara" became commonly known as the Madrid Agreement.
The Madrid Agreement provoked a debate in the General Assembly in November 1975. As a
resuit of this debate two resolutions were passed, both on 10 December 1975. UN General
Assembly Resolutions 3458(A) dénies any relevance nor any légal effect to the Madrid
Agreement. UN General Assembly Resolution 345 8(B) took note ofthe tripartite Agreement but
did neither recognize it nor endorse it.
It is crystal clear that the UN General Assembly did neither approve nor endorse the Madrid
Agreement. Despite the clear and explicit position of the UN, the Treaty on borders between
Morocco and Mauritania on April 14th 1976 proceed to the partition and annexation of the
Western Sahara.
In an illusory attempt to falsely attribute statements to the late Président Abdelaziz Bouteflika,
the représentative of the Occupying power in Western Sahara has again uttered shameless lies
and alleged, with a completely brazen and out of context référence, that the former had proposed
the partition of Western Sahara.
I set the record straight here hy recalling the complète référence, which reflects only a pure
inference made hy the Personal Envoy of the Secretary General, which eehoes only his own
opinion and which leaves no room for misinterpretation, let alone to be attributed to the late
Président Bouteflika.

Fourth : Who are the two parties to the conflict of Western Sahara?
In the Security Council Resolutions 621, 658, 690, 1033 et 1056, the two parties to the conflict
of Western Sahara are identifiée! without any ambiguity nameiy : the Kingdom of Morocco and
the Frente Popular para la Liberacion de Saguia el-Hamra y de Rio de Oro (Frente POLISARIO)
to which the Security Council addressed its call through the landmark Resolution 690 related to
the establishment of the United Nations Mission for the Référendum in Western Sahara
(MINURSO): "Ca//5
According to the settlcment plan contained in the Secretary General Report "S/21360", the two
parties are clearly defined in paragraph 1
How one can he so ignorant to this extent, not to recognize the two parties, while they have
already signed an agreement?
I recall here that the Houston agreement was approved by the two parties, Morocco and Frente
POLISARIO, in their endeavor to organize the référendum in the Western Sahara. In the annex
III of the document S/1997/742, page 11,
Fifth: What is the mandate and the mission of the United Nations Mission for the
Référendum in Western Sahara (MINURSO)?
Once again, the représentative of the occupying power in Western Sahara is not only
outrageously lying, but also trying to deceive the attention of the members of the Security
Council on the mandate of the United Nations Mission for the Référendum in Western Sahara
(MINURSO).
It should be recalled that the MINURSO was established by Security Council Resolution 690 of
29 April 1991, in accordance with settlcment proposais accepted on 30 August 1988 by Morocco
and the Frente POLISARIO and, subsequently, endorsed by the Security Council.

It is sufficient to enclose hereinafter excerpts from the Document S/21360 of 18 June 1990,
approved by the Security Council Resolution 690, that established the MINURSO. This is so
éloquent to the extent that no other comments are necessary:
Quote:
XIII. Composition and tasks of the United Nations mission for the référendum in Western
Sahara:
77. (...)
A. Civilian Unit
78. The Civilian Unit, which is central to the opération, will comprise the office of the Spécial
Représentative and his support staff in ficlds such as administration, légal and législative matters,
questions relating to refugees and political detainees, information and public relations.
In addition, a major part of the Civilian Unit will be responsible for the organization and
conduct of the référendum.
B. Security Unit
79. The Security Unit will be made up of civil police. Their task will be:
(a) To ensure tranquility and maintain law and order in the vicinity of, and at, voter registration
offices and poUing stations, to ensure that no person is denied entry for the purposes of
registration or voting and, when specifically so ordered, to maintain order at other locations
where activities in cormection with the référendum, under MINURSO auspices or authority, are
taking place;
(b) To monitor the activities of the existing police forces so as to ensure that they are acting in
strict accordance with the settlcment proposais and the présent implementation plan, which are
intended to secure the organization of a free and fair référendum without military or
administrative constraints and to prevent any possibility of intimidation or interférence from any
quarter.
80. (...)
C. Military Unit
81. The tasks ofthe Military Unit will be: (a) To monitor the cease-fire; (b) To verify the agreed
réduction in troops; (c) To monitor the confinement of troops of both sides to agreed locations;
(d) To monitor the custody of certain arms and ammunition; (e) To provide security for the
return of Western Saharans from outside the Territory at designated crossing-points and at
UNHCR réception centers; (f) To assist the Security Unit, as required: (g) Depending on the
results of the référendum, to monitor the activities described in paragraph 75 above. (...) End
quote.

Unless the représentative of Morocco has another document on MINURSO, or he refers to
another imaginary Security Council, the mandate of MINURSO as renewed since its création to
date, is defined without any ambiguity.
Sixth- Why Morocco is still opposing the monitoring of the Human rights situation in
Western Sahara hy the MINURSO and hy other relevant UN mechanisms?
There is no need to elaborate cxtensively on this question. Mercly, the best way to verify ail past,
présent and ccrtainly future lies of Morocco regarding the Human Rights situation, is to extend
the mandate of the MINURSO to include the monitoring of the human rights situation, in the
occupied territory of Western Sahara and in the refugee Camps in Tindouf.
It is well-known that Morocco approaches the Security Council Members, on the eve of the
adoption of each resolution renewing the MINURSO mandate, to prevent any possibility to
enable this mission to monitor the Human rights situation.
In the paragraph 61 of Security Council Report "S/2021/843", it is clearly indicated that the
MINURSO
Further, Morocco not only prevents the MINURSO from human rights monitoring, it even
obstnict any other mandate from the U N Human rights bodies.
The paragraph 73 of the Security Council Report "S/2021/843" stated in this regard that:
I , also, remind the occupying power that the représentatives of UN agencies and NGOs are
regularly visiting the refugee camps, in addition to the fréquent visits of many international
délégations, and ail of them acknowledged in their reports that the camps run according to the
rules ofthe UNHCR.
The occupying power's responsibiiity for the flagrant and systematic violations of Human rights
in the occupied part of Westem Sahara is well documented and reported by the relevant Human
Rights mechanisms and mandate holders.
After ail, a country that brutally killed dozens of African migrants and asylum seekers, few days
ago, using firearms and torture under the watch of the international community and who
previously had, deliberately and recklessly, thrown his nationals, including children and women,
into the sea in a migratory blackmail, it is not surprising that this very same country continues to
perpetrate ail forms of atrocities against the people of Western Sahara in the occupied Territory.

Seventh: Who is hindering the peaceful settlement of the conflict?
The Occupying power in Western Sahara has abnegated its own commitments under the United
Nations and the then Organization of African Unity (OAU) Settlement Plan that was accepted by
both parties, the Kingdom of Morocco and the Frente POLISARIO, in 1988 and approved by the
UN Security Council in 1990 and 1991.
There have been too many hampered initiatives and missed opportunities to reach a just and
lasting solution that provides for the self-determination of the People of Western Sahara. To
name only a few:
- The UN-OAU settlement plan, formally accepted in 1991 by the Kingdom of Morocco
and the Frente POLISARIO, and endorsed by the UN Security Council, which provided
for the organization by the United Nations of a référendum in Western Sahara free from
ail administrative and military constraints; Then Houston negotiations in 1997; Then the
Baker peace plan in 2003;
The Moroccan unilatéral actions and deliberately created obstacles made it difficult, even
impossible, for the UN to hold the référendum of Western Sahara.
It is important to note, in this regard, that the late King Hassan I I of Morocco accepted
the holding a self-determination référendum in the Territory during the OAU Summit
held in Nairobi in 1981;
- On 27 September 1983, the King of Morocco I I stated before the 38th Session of the
General Assembly that:
- In August 1988, Morocco accepted the Settlement Plan. As may be recalled, the
fundamental objective of the plan was to organize a free and fair référendum on self-
determination so as to allow the people of Westem Sahara to
(paragraph 31, S/21360).
In September 1997, Morocco committed itseif once again to the référendum on self-
determination and to the options already agreed to by the two parties, nameiy
independence and intégration, when it signed the Houston Accords, negotiated by the two
parties under the auspices of former US Secretary of State, James Baker III.

roll established, it was expected to hold the référendum. However, Morocco suddenly
deciared its unwillingness to go forward with the Settlement Plan alleging arbitrarily that
it was un-implementable. (S/2002/178 of 19 February 2002, paragraph 48)
- In order to break the impasse created by Morocco, James Baker III put forward the Peace
Plan for Self-determination of the People of Western Sahara (S/2003/565, annex II), or
Baker Plan.
- In its resolution 1495 (2003) of 31 July 2003, the Security Council strongiy supported the
Baker Plan as
(OP2).
- The Frente POLISARIO officially accepted the plan in July 2003. In his report
(S/2003/1016) of 16 October 2003, the Secretary-General recalled that the
and urged
(paragraph 27).
To Baker's and everyone's surprise, Morocco irresponsibly rejected his plan under the
pretext that the référendum inciuded the option for independence.
In his report (S/2004/325) of 23 April 2004, the Secretary-General pointed out that
(paragraph 26).
In April 2004, Morocco went as far as to déclare its officiai rejection of any solution that
would not ensure, from the outset, its annexation of Western Sahara. It was then very
clear that Morocco was acting in bad faith in impiementing the Settlement Plan and
Houston Accords, whilst using ail deceiving tactics to mislead the Security Council and
the international community at large. Its rejection of the Settlement Plan, described
unanimously as a "fair and balanced approach", and its proposai of so-called autonomy
also show its lack of political will to résolve the conflict in a peaceful, just and lasting
manner in line with U N resolutions and doctrine relating to decolonization.
Eighth : Who bears the responsibiiity of breaching the cease-tïre and the escalation of the
conflict?
The Occupying power in Westem Sahara's breach ofthe 1991 ceasefire and Military Agreement
No. 1 of 1997-8, is by no means questionable.
It is an undeniable fact that the Moroccan occupying forces in Western Sahara, in flagrant
violation of the ceasefire and Military Agreement have moved, on 13 November 2020, into the
Buffer Strip of Guergeurat and attacked a group of Sahrawi civilians who were protesting
peacefully in Guerguerat in the Liberated Territory of Westem Sahara. The occupying power in

Western Sahara has even admitted that its forces had conducted an opération in the area on tha
same day.
Signed between MINURSO and the Frente POLISARIO on 24 December 1997 and between
MINURSO and Morocco on 22 January 1998, the Military Agreement No. 1 cstablishes a 5 km
wide Buffer Strip to the South and Last of the berm where the entry of the troops or equipment
of both parties, by ground or air, and the firing of weapons in or over this area, are prohibited at
ail times and are a violation of the ceasefire.
It has also to be recalled that it is an indisputable fact corroborated by MINURSO that, following
their incursion into the Buffer Strip, the Moroccan occupying forces in Western Sahara built a
new "sand wall", and laid new mines in violation of the Military Agreement No. 1.
The incursion by the Moroccan occupying armed forces in Western Sahara into the Buffer Strip
in Guerguerat on 13 November 2020 is, therefore and beyond any doubt, a violation of the 1991
ceasefire and the Military Agreement No. 1 of 1997-8.
It is, moreover, a flagrant violation ofthe Security Council resolutions including resolution 2548
(2020) which reaffirmed
and called on
and
(S/RLS/2548- OP 6).
I leave it to the appréciation of the distinguished Security Council members and the international
community to assess the serions conséquences of this blatant violation that are likely to
undermine seriously the prospects of re-launching the peace proeess.
Ninth: What is the real value of the unfair, colonial and nnreaiistic so-called autonomy
proposai?
It is striking how Morocco is still observing the colonial textbook in Westem Sahara. Indeed, and
against the course of History, the occupying power in Western Sahara is adamant to persist in its
déniai attitude attempting to impose the fait-accompli via its ephemeral political solution that it
proposes.
The content, foundations and aims of the so-called autonomy plan presented by the occupying
power in Western Sahara constitute a dangerous précèdent that threatens the very foundation of
the intemational legality and the Charter of the United Nations.
As confirmed by the Intemational Court of Justice in 1975 and the UN Légal Counsel in 2002,
the occupying power in Westem Sahara does not exercise any sovereignty or administering
power over Westem Sahara.
In fact, it is well established by the UN General Assembly relevant resolutions that Morocco's
présence in Western Sahara is a and called on Morocco to end its
occupation of the Territory.

Giving any crédit to the occupying power and to its so-called autonomy plan would therefore
mean that, for the fîrst time since the création of the UN, the international community would
legitimate the occupation and the annexation of a territory and the domination of its people by
force.
Moreover, the very idea of giving this proposai any considération would amount to
accommodating a rétrograde plan that runs counter to the well-established and well-known UN
decolonization doctrine.
The désire of the occupying power in Western Sahara to make its proposai for autonomy, not
only the starting point but also the only outcome of any negotiation is no more than a tentative to
revive and recycle the worn-out forms of colonization of the eras of the "mandates",
"trusteeships" and "protectorates". Those worn-out forms of colonialism have in common a
design of colonization combined with an "autonomy" or "self-rule" granted to local populations.
Ironically, thèse obsolète and outdated forms have, ail things being equal, offercd far more
opportunities to colonized peoplcs than this so-called autonomy plan purports to offer, in the
sensé that those outdated forms have somehow culminated in the self-determination of peoples,
including in the case of Morocco itseif, which was placed under French protectorate until 1956.
I should be grateful, Mr. Président, if you would arrange to circulate this letter to the members of
the Security Council and have it issued as an officiai document ofthe Security Council.

Excellence,
Malheureusement et comme ce fut le cas dans sa réponse à la lettre adressée par S.E. Mme la
représentante permanente de l'Afrique du Sud au nom du Front POLISARIO, représentant
légitime et exclusif du peuple du Sahara occidental, publiée en tant que document du Conseil de
sécurité sous la cote S/2022/ 414, le représentant de la puissance occupante au Sahara Occidental
a, encore une fois et sans surprise, raté l'occasion de répondre à cette lettre et a continué à faire,
de manière inappropriée, des allégations directes fallacieuses et mensongères contre mon pays,
accompagnées d'accusations inacceptables. Cette lettre est totalement hors contexte,
manifestement trompeuse, comme c'est toujours le cas à chaque fois que l'auteur est acculé par
les faits indéniables et les réalités irréfutables sur la situation dans le Territoire occupé du Sahara
Occidental.
Cette lettre reflète aussi les attentes ambitieuses biaisées de quelqu’un, qui espère des réponses à
sa lettre incohérente et insensée. Une espérance qui ne peut émaner que d'une parfaite
incarnation de sa tendance désespérée, zélée et aveugle à tirer d'abord et viser plus tard.
En réalité, la présente lettre vise exclusivement à répondre aux réelles questions que le
représentant de la puissance occupante au Sahara Occidental est terrifié à l'idée de les poser, mais
aussi incapable d'entendre parler de la réalité du conflit au Sahara Occidental qu’il tente
vainement, par des allégations fallacieuses et mensongères, de dévoyer ou d’occulter en espérant,
in fine, que l’usure du temps, finira par faire tomber la question Sahraouie en désuétude.

Ce représentant ainsi que son pays, n’ont pas conscience que le peuple sahraoui a prouvé depuis
presque 50 ans, ses capacités de résilience et de lutte en faisant échec à toutes les tentatives de lui
imposer le fait accompli. C’est bien la preuve que toute solution doit passer par l’expression libre
du peuple du Sahara occidental qui a le droit de se prononcer sur son avenir à travers un
référendum, à l’instar de tous les peuples du monde.
L'examen par l'ONU de la question du Sahara occidental remonte à 1963, lorsque le territoire a
été inscrit sur la liste des territoires à décoloniser au titre du Chapitre XI de la Charte de l'ONU.
Le 16 décembre 1965, l'Assemblée générale adopte la résolution 2072 sur ce qu'on appelait alors
le « Sahara espagnol », dans laquelle elle rappelle la résolution 1514 (XV) et demande à
l'Espagne de prendre toutes les mesures nécessaires pour libérer le « Sahara espagnol de la
domination coloniale ».
Toutes les résolutions adoptées par l'Assemblée générale, depuis 1966, ont un dénominateur
commun, qui est la reconnaissance du droit inaliénable du peuple du Sahara occidental à
l'autodétermination, et la nécessité de sa mise en œuvre par le biais d'un référendum libre et juste
sur l'autodétermination conformément aux résolutions 1514 (XV) et 1541 (XV) de l'Assemblée
générale, qui détaillent les principes et les paramètres qui déterminent les résultats auxquels
pourrait conduire la décolonisation d'un territoire. Cette position a, depuis, été réitérée chaque
année par l'Assemblée générale.
Dans son avis consultatif sur le Sahara occidental, rendu le 16 octobre 1975, la CIJ a très
clairement établi que : « Les éléments et informations qui lui sont présentés n'établissent aucun
lien de souveraineté territoriale entre le territoire du Sahara occidental et le Royaume du Maroc
ou la Mauritanienne. Ainsi, la Cour n'a pas trouvé de liens juridiques de nature à affecter
l'application de la résolution 1514 (XV) de l'Assemblée générale dans la décolonisation du
Sahara occidental et, en particulier, du principe de l'autodétermination par l'expression libre et
authentique de la volonté des peuples du Territoire ».
Ce statut a également été réaffirmé par la Cour européenne de justice dans ses derniers verdicts
relatifs aux accords illégaux entre l'Union européenne et le Maroc, qui énoncent clairement que
le Maroc et le Sahara Occidental sont deux territoires distincts et séparés :
- Verdict du 21 décembre 2016 : "Compte tenu du statut séparé et distinct accordé au territoire du
Sahara Occidental en vertu du principe de l'autodétermination, par rapport à celui de tout Etat, y
compris le Royaume du Maroc, les mots ''territoire du Royaume du Maroc'' figurant à l'article 94
de l'accord d'association ne saurait, comme le soutient la Commission et comme l'a relevé en
substance M. l'avocat général aux points 71 et 75 de ses conclusions, être interprété de manière à
inclure le Sahara occidental dans le champ d'application territorial de cet accord''.

- Verdict du 27 novembre 2018 : « La Cour indique donc que, compte tenu du fait que le
territoire du Sahara occidental ne fait pas partie du territoire du Royaume du Maroc, les eaux
adjacentes au territoire du Sahara occidental ne font pas partie de la zone de pêche marocaine
visée dans l'accord de pêche. » ;
Il s'agit d'une reconnaissance internationale par l'ONU et les hautes autorités judiciaires que le
Sahara Occidental ne fait pas partie du territoire marocain, ce qui permettra également, sans
doute, au peuple du Sahara Occidental de réclamer réparation pour l'exploitation illégale de ses
ressources naturelles.
Il est fondamental de rappeler que, dans ses résolutions 34/37 du 21 novembre 1979 et 35/19 du
11 novembre 1980, l'Assemblée générale, et tout en "réaffirmant le droit inaliénable du peuple
du Sahara occidental à l'autodétermination et à l'indépendance", est profondément "préoccupée
par l'aggravation de la situation découlant de l'occupation continue du Sahara Occidental par le
Maroc".
Aussi, par sa résolution 380 en date du 06 novembre 1975, adoptée à l'unanimité par ses Etats
membres, le Conseil de sécurité « déplore la tenue de la marche et demande au Maroc de retirer
immédiatement du Territoire du Sahara Occidental tous les participants à la marche ».
Par ailleurs, le Secrétaire général adjoint aux affaires juridiques, Conseiller juridique, M. Hans
Corell, a précisé très clairement, le 29 janvier 2002, que « l’Accord de Madrid [signé entre
l'Espagne, le Maroc et la Mauritanie le 14 novembre 1975] ne transfère pas la souveraineté sur le
Territoire, ni ne confère à aucun des signataires le statut de Puissance administrante ».
L'''Audiencia Nacional'' de l'Espagne, a également, dans sa décision du 4 juillet 2014, établi que
"l'Espagne (...) continue d'être la puissance administrante du Sahara Occidental et, à ce titre,
jusqu'à la fin de la période de décolonisation, elle a les obligations énoncées aux Articles 73 et
74 de la Charte des Nations Unies ».
De plus, le dernier rapport "A/76/63", comme c'était le cas dans chaque rapport annuel du
Secrétaire général de l'ONU sur les "Informations des territoires dont les populations ne

s'administrent pas, transmises en vertu de l'article 73 (e) de la Charte des Nations Unies Nations''
L'Espagne a toujours été désignée comme la puissance administrante du Sahara occidental.
Ce ne sont là que quelques éléments qui prouvent sans aucun doute que le Maroc est une
puissance occupante au Sahara Occidental et n'a aucune prérogative administrante, encore moins
une quelconque souveraineté sur le territoire occupé du Sahara Occidental.
Le 14 novembre 1975, l’Espagne a signé une déclaration avec le Maroc et la Mauritanie sur la
partition du Sahara occidental. Cette "Déclaration de principes entre l'Espagne, le Maroc et la
Mauritanie sur le Sahara occidental" est devenue communément appelée l'Accord de Madrid.
Il est parfaitement clair que l'Assemblée générale des Nations Unies n'a pas approuvé ou endossé
l'Accord de Madrid. Malgré la position claire et explicite de l'ONU, le traité sur les frontières
entre le Maroc et la Mauritanie du 14 avril 1976 procède à la partition et à l'annexion du Sahara
Occidental.
Dans une tentative illusoire d'attribuer faussement des déclarations au défunt président Abdelaziz
Bouteflika, le représentant de la puissance occupante au Sahara Occidental a encore proféré des
mensonges éhontés et à allégué, avec une référence complètement sans vergogne et hors
contexte, que le défunt président aurait proposé la partition du Sahara Occidental.
Je rétablis ici la vérité en rappelant la référence complète, qui ne reflète qu'une pure inférence
faite par l'Envoyé personnel du Secrétaire général, qui n'engage que sa personne et qui ne
laisse aucune place à l'interprétation erronée, encore moins l'attribuer au feu Président
Bouteflika.
Le paragraphe 2 du Rapport S/2002/178 devrait se lire comme suit : « Les 24 et 25 janvier 2002,
mon Envoyé personnel, James A. Baker III, s'est rendu au Maroc, où il a été reçu à deux reprises
par Sa Majesté le Roi Mohammed VI et de hauts fonctionnaires du gouvernement. La visite de
mon Envoyé personnel avait pour but d'informer les autorités marocaines du rejet par l'Algérie et
le Front POLISARIO du projet d'accord-cadre, comme lui avait été réitéré par le Président
algérien, Abdelaziz Bouteflika, lors de sa visite au James Baker Institute à Houston, Texas, le 2
novembre 2001, et que, de l'avis de mon Envoyé personnel, l'Algérie et le Front POLISARIO
seraient disposés à discuter ou à négocier une division du Territoire comme solution politique au
différend sur le Sahara occidental".

C'est la vérité sur un pays, qui s'est lancé dans l'annexion et la partition d'un territoire, et qui ose,
aujourd'hui, en revendiquer la souveraineté.
Dans les Résolutions 621, 658, 690, 1033 et 1056 du Conseil de Sécurité, les deux parties au
conflit du Sahara Occidental sont identifiées sans ambiguïté, à savoir : le Royaume du Maroc et
le Frente Popular para la Liberacion de Saguia el-Hamra y de Rio de Oro (Frente POLISARIO)
auxquels le Conseil de sécurité a adressé son appel par le biais de la résolution historique 690
relative à la création de la Mission des Nations Unies pour l'organisation du référendum au
Sahara occidental (MINURSO): « Appelle les deux parties à coopérer pleinement avec le
Secrétaire général dans la mise en œuvre de son plan tel que décrit dans son rapport du 18
juin et complété dans son rapport du 19 avril 1991 ».
En vertu du Plan de règlement contenu dans le rapport du Secrétaire général "S/21360", les deux
parties sont clairement définies au paragraphe 1 "Le 11 août 1988, le Secrétaire général des
Nations Unies et l'Envoyé spécial du Président de l'époque de l'Assemblée des chefs d'État et de
gouvernement de l'Organisation de l'unité africaine (OUA) a présenté, lors de réunions séparées,
aux parties au conflit au Sahara occidental, à savoir le Maroc et le Frente Popular para la
Liberacibn de Saguia el-Hamra y de Rio de Oro (Frente POLISARIO), un document ("les
propositions de règlement") contenant des propositions pour une solution juste et définitive de la
question du Sahara occidental conformément à la résolution 1514 (XV) de l'Assemblée générale
au moyen d'un cessez-le-feu et de la tenue d'un référendum sans contraintes militaires ou
administratives pour permettre au peuple du Sahara Occidental, dans l'exercice de son droit à
l'autodétermination, de choisir entre l'indépendance et l'intégration au Maroc ».
Comment peut-on être, à ce point, si ignorant pour ne pas reconnaître les deux parties,
alors qu'elles ont déjà signé un accord ?
Je rappelle ici que l'accord de Houston a été approuvé par les deux parties, le Maroc et le Front
POLISARIO, dans leur tentative d'organiser le référendum au Sahara occidental. Dans l'annexe
III du document S/1997/742, page 11, ''Le présent code de conduite formulé et publié par le
Représentant spécial du Secrétaire général après consultation des deux parties régit la conduite et
le comportement, pendant la campagne référendaire, des Parties et des personnes ou groupes de
personnes agréés par le Représentant spécial du Secrétaire général, soutenant l'une ou l'autre des
Parties participant au référendum''.
Cinquièmement : Quel est le mandat et la mission de la Mission des Nations Unies pour
l'organisation du référendum au Sahara occidental (MINURSO) ?

Il suffit de joindre, ci-après, des extraits du document S/21360 du 18 juin 1990 approuvé par la
résolution 690 du Conseil de sécurité, et portant création de la MINURSO. Ce document est
tellement éloquent au point où aucun autre commentaire n'est nécessaire :

A, Unité civile
78. L'unité civile, qui est au cœur de l'opération, comprendra le bureau du Représentant spécial et
son personnel d'appui dans des domaines tels que l'administration, les questions juridiques et
législatives, les questions relatives aux réfugiés et aux détenus politiques, l'information et les
relations publiques.
B. Unité de sécurité
79. L’Unité de sécurité sera composée d’agents de la police civile. Ses fonctions seront les
suivantes :
a) Maintenir le calme et faire régner l’ordre dans les centres d’établissement des listes électorales
et les bureaux de vote et à leurs abords ; veiller à ce que nul ne s’en voit refuser l’accès pour se
faire inscrire sur les listes électorales ou pour voter et, lorsqu’elle en reçoit expressément la
consigne, faire régner l’ordre dans d’autres endroits où se déroulent, sous les auspices ou la
responsabilité de la MINURSO, des activités liées au référendum.
b) Superviser les activités des forces de police existantes pour veiller à ce qu’elles agissent en
stricte conformité avec les Propositions de règlement et le présent plan de règlement, lesquels
visent à assurer l’organisation d’un référendum libre et régulier, sans contraintes militaires ou
administratives, et pour prévenir tout risque d’intimidation ou d’ingérence d’où qu’il vienne.

A moins que le représentant du Maroc possède un autre document sur la MINURSO, voire il se
réfère à un autre Conseil de sécurité imaginaire, le mandat de la MINURSO tel que renouvelé
depuis sa création et à ce jour, ne souffre d'aucune ambigüité.
Il n'est pas nécessaire de s'étendre longuement sur cette question. Simplement, la meilleure
manière de vérifier tous les mensonges passés, présents et certainement futurs du Maroc
concernant la situation des droits de l'homme, est d'étendre le mandat de la MINURSO pour
inclure le suivi de la situation des droits de l'homme, dans le territoire occupé du Sahara
Occidental et dans les camps de réfugiés de Tindouf.
Il est bien connu de tous que le Maroc se rapproche des membres du Conseil de sécurité, à la
veille de l'adoption de chaque résolution renouvelant le mandat de la MINURSO, pour empêcher
toute possibilité de permettre à cette mission de surveiller la situation des droits de l'homme.
De plus, non seulement le Maroc empêche la MINURSO de surveiller les droits de l'homme,
mais il fait même obstacle à tout autre mandat des organes des droits de l'homme de l'ONU.
Je rappelle également à la puissance occupante que les représentants des agences onusiennes et
des ONG visitent régulièrement les camps de réfugiés, en plus des visites fréquentes de
nombreuses délégations internationales, et qui tous ont reconnu dans leurs rapports que les
camps fonctionnent selon les règles du HCR.
Après tout, un pays qui a brutalement massacré des dizaines de migrants et demandeurs d'asile
africains, il y a quelques jours, en utilisant des armes à feu et la torture sous le regard de la
communauté internationale et qui avait auparavant, délibérément et imprudemment, jeté ses

ressortissants, y compris des enfants et les femmes, à la mer dans un chantage migratoire, il n'est
pas surprenant que ce même pays continue de perpétrer toutes les formes d'atrocités contre le
peuple du Sahara Occidental dans le territoire occupé.
La puissance occupante au Sahara occidental a renié ses propres engagements dans le cadre des
Nations unies et du plan de règlement de l'Organisation de l'unité africaine (OUA) de l'époque,
qui a été accepté en 1988 par les deux parties, le Royaume du Maroc et le Front POLISARIO, et
approuvé par le Conseil de sécurité des Nations Unies en 1990 et 1991.
Il y a eu trop d'initiatives entravées et d'occasions manquées pour parvenir à une solution juste et
durable qui garantit l'autodétermination du peuple du Sahara occidental. Pour n'en nommer que
quelques-unes :
Les actions unilatérales marocaines et les obstacles délibérément créés ont rendu difficile,
voire impossible, l'organisation par l'ONU du référendum sur le Sahara Occidental.
- Il est important de noter, à cet égard, que feu le Roi Hassan II du Maroc a accepté, lors du
Sommet de l'OUA tenu à Nairobi en 1981, la tenue d'un référendum d'autodétermination
dans le Territoire ;
- En août 1988, le Maroc a accepté le plan de règlement. Comme il est à rappeler, l'objectif
fondamental du plan était d'organiser un référendum libre et équitable sur
l'autodétermination afin de permettre au peuple du Sahara occidental de "choisir entre
l'indépendance et l'intégration au Maroc" (paragraphe 31, S/21360).

- À la suite des accords de Houston, la MINURSO a réussi à achever l'identification des
électeurs potentiels pour le référendum en janvier 2000. Sur les quelques 200 000 demandes
de participation au référendum, la plupart déposées par le Maroc, la MINURSO a conclu
que 86 386 étaient éligibles pour prendre part au vote. Après l’établissement de la liste
électorale établie, il était attendu d’organiser le référendum. Cependant et soudainement, le
Maroc ne s’est pas montré disposé à aller de l’avant avec le Plan de règlement alléguant
arbitrairement qu'il était inapplicable. (S/2002/178 du 19 février 2002, paragraphe 48).
- Afin de sortir de l'impasse créée par le Maroc, James Baker III a proposé le Plan pour
l'autodétermination du peuple du Sahara occidental (S/2003/565, annexe II), ou plan Baker.
- Le Front POLISARIO a officiellement accepté le plan en juillet 2003. Dans son rapport
(S/2003/1016) du 16 octobre 2003, le Secrétaire général a rappelé que « l'acceptation du
plan de paix par le Front POLISARIO offre maintenant une fenêtre d'opportunité pour
résoudre le différend de longue date », et a exhorté « Le Maroc doit saisir l'opportunité et
s'engager positivement dans le processus en acceptant et en mettant en œuvre le plan »
(paragraphe 27).
- En avril 2004, le Maroc est allé jusqu'à déclarer son rejet officiel de toute solution qui
n'assurerait pas, d'emblée, son annexion du Sahara Occidental. Il était alors très clair que le
Maroc agissait de mauvaise foi dans la mise en œuvre du plan de règlement et des accords
de Houston, tout en utilisant toutes les tactiques sournoises pour tromper le Conseil de
sécurité et la communauté internationale dans son ensemble. Son rejet du Plan de règlement,
décrit à l'unanimité comme une "approche juste et équilibrée", et la proposition de son soi-
disant plan d'autonomie montrent également son manque de volonté politique pour résoudre
le conflit de manière pacifique, juste et durable conformément aux résolutions de l'ONU et
la doctrine relative à la décolonisation.
Huitièmement : Qui est responsable de la rupture du cessez-le-feu et de l'escalade du
conflit?

2020 dans la zone tampon de Guergeurat et ont attaqué un groupe de civils Sahraouis qui
manifestaient pacifiquement à Guerguerat dans le territoire libéré du Sahara occidental. La
puissance occupante au Sahara occidental a même admis, le même jour, que ses forces avaient
mené une opération dans la région.
Signé entre la MINURSO et le Front POLISARIO le 24 décembre 1997 et entre la MINURSO et
le Maroc le 22 janvier 1998, l'Accord militaire n° 1 établit une zone tampon de 5 km de large au
sud et à l'est de la berme où l'entrée des troupes ou du matériel des deux parties, par voie terrestre
ou aérienne, et le tir d'armes dans ou au-dessus de cette zone sont interdits à tout moment et
constituent une violation du cessez-le-feu.
Il convient également de rappeler qu'il est un fait incontestable et corroboré par la MINURSO
qu'à la suite de leur incursion dans la zone tampon, les forces d'occupation marocaines au Sahara
occidental ont construit un nouveau "mur de sable" et posé de nouvelles mines en violation de
l'accord militaire N°1. L'incursion des forces armées marocaines d'occupation au Sahara
Occidental dans la zone tampon à Guerguerat le 13 novembre 2020 est donc, et sans aucun
doute, une violation du cessez-le-feu de 1991 et de l'accord militaire n°1 de 1997-8.
Il s'agit, en outre, d'une violation flagrante des résolutions du Conseil de sécurité, notamment la
résolution 2548 (2020) qui a réaffirmé "la nécessité du plein respect des accords militaires
conclus avec la MINURSO concernant le cessez-le-feu" et a appelé "les parties à adhérer
pleinement à ces accords'' et « s'abstenir de toute action susceptible de saper les négociations
facilitées par l'ONU ou de déstabiliser davantage la situation au Sahara occidental »
(S/RES/2548-OP 6).
Le contenu, les fondements et les objectifs du soi-disant plan d'autonomie présenté par la
puissance occupante au Sahara Occidental constituent un précédent dangereux qui menace le
fondement même de la légalité internationale et la Charte des Nations Unies.
Comme l'ont confirmé la Cour internationale de Justice en 1975 et le Conseiller juridique de
l'ONU en 2002, la puissance occupante au Sahara Occidental n'exerce aucune souveraineté ni ne
possède les prérogatives de puissance administrante sur le Sahara Occidental.
En fait, il est bien établi par les résolutions pertinentes de l'Assemblée générale des Nations
Unies que la présence du Maroc au Sahara occidental est une "occupation continue" et qu'elles
ont appelé le Maroc à mettre fin à son occupation du territoire.

Accorder un quelconque crédit à la puissance occupante et à son soi-disant plan d'autonomie du
Sahara Occidental signifierait donc que, pour la première fois depuis la création de l'ONU, la
communauté internationale légitimerait l'occupation et l'annexion d'un territoire et la domination
de son peuple par la force.
De plus, l'idée même d'envisager cette proposition reviendrait à s'accommoder d'un plan
rétrograde allant à l'encontre de la doctrine de décolonisation bien établie et bien connue de
l'ONU.
Ironiquement, ces formes obsolètes ont, toutes choses égales par ailleurs, offert bien plus
d'opportunités aux peuples colonisés, que ce soi-disant plan d'autonomie prétend offrir, dans le
sens où ces formes obsolètes et dépassées ont en quelque sorte abouti à l'autodétermination des
peuples, y compris dans le cas du Maroc lui-même, placé sous protectorat français jusqu'en 1956.
Je vous serais reconnaissant, M. le President, de bien vouloir faire distribuer la présente lettre
aux membres du Conseil de sécurité et de la faire publier comme document officiel du Conseil
de sécurité.
