The attention of the all the Departments of Secre~riat are invited

to the Judgement of Supreme Court of-India-referred above.

2. In different service Rules there are provisions -for appointment by · -·

transfer of employees- of Secretariat · and H~ads of Departments
{?.!longing to the categories of Section Officers. Assistao,t Section
umc:ers and Superintendents Etc.,) to certain executive posts localized
under Presidential Order , like ACTOs, Excise lnspe~ors, . Manda!
Parishad Development Officers, Municipal Commissioners, Regional
Transport Office~ etc., · ·

3. The Hon'ble Supreme Court of India in . judgement dated
