today i would like to talk to you about tort law in spain

today im here to talk about you about if there is in spain any type of concept similar to tort
law

the purpose of this presentation is give my personal opinion and expose my points of view
about this topic

my presentation is divided into three parts

i will beggin with the similar concepts to tort law in spain

then i will look at what i think about this type of law

and last but not least about the advantages and disadvantages about that law in spain

i would like to give you some background information about what is the tort law and the
similar concept in spain

At common law, torts are civil wrongs of a non-contractual nature for which a remedy is
provided. The branch of English law that regulates the rights and obligations arising from
these wrongful acts is called tort law, law of tort, which is the equivalent of civil law for non-
contractual purposes , but can also cover issues within other branches of law, such as criminal,
labour or administrative law.
I think it is interesting to add the fact that common law contains a number of unlawful acts
such as negligence, trespass to land, assault, battery, libel, nuisance, etc. which is different
from Spanish law. The law of torts in spain, arises from article one thousand and ninety-two,
which requires:

- an act or omission

- that causes damage

- with fault or negligence

which arises for both contractual and non-contractual liability.

now i would like to move on the idea of what i think about this law

Personally, it is one of the branches of private law that I like the most, especially professional
negligence, I think this law is very important for the relations between private individuals.

damages caused between individuals, even in the absence of fault, should be compensated or
indemnified.
this is importante because The victim does not have to bear the negligence of third parties
and therefore this right arises, which is related to consumer law.

to sum up the adventages and disadvantages about this spanish law compared to tort
lawSpanish law devotes some articles to the fact that it is a branch of law in Anglo-Saxon
systems.
THE DISADVANTAGE OF HAVING A CLOSED CATALOGUEas indicated above, is that only those
that fit into the category will be compensated whereas in Spanish tort law, any damage that
fulfils the three elements will be compensated.
common law tort law only serves to compensate, and Spanish tort law also has the possibility
to ask for compensation.
