AFFIDAVIT/SWORN STATEMENT/UNDERTAKINGS
IN RE: DENIAL

I, FRECEL FONTILLAS SALVAŇA-TINOY, of legal age, married, Filipino Citizen and presently residing at
Papag, Cateel, Davao Oriental, under oath states:

1. That I am the sister of AZENITH FONTILLAS SALVAŇA, representative and signatory heirs of
AURORA FONTILLAS SALVAŇA as per HIERS OF PERDRO FONTILLAS EXTRA JUDICIAL
SETTLEMENT dated 05 November 2018 attached as annex “A” published dated May 22, 29 &
June 05, 2021.

2. That a copy of “AGREEMENT” dated November 23, 2018 to conduct survey and subdivision to the
land claimed by PEDRO FONTILLAS under lot no. 1849 with an area or 11, 224 sq. meter, lot no.
1848 with an area of 32,178 sq. meters, lot no. 3580 with an area of 1,782 sq. meters and lot no.
3582 with an area of 3,650 sq. meters situated in Mahayahay, Ban-ao, Baganga, Davao Oriental
AND a copy of “SUBDIVISION PLAN” for RAUL TAMBILAWAN from DENR REGION XI
SURVEYS & MAPPING DIVISION with huge mistake of assigning claimant with wrong figure of
calculation and was claim By RAUL & ANNA LOUISE certified by Geodetic Engineer DAVE MARL
A. MENOR was presented to the undersigned by my cousin RODRIGO FONTILLAS today June
21, 2022 at 10:00 in the morning;

3. That I vehemently and categorically deny the said “AGREEMENT” and “SUBDIVISION PLAN” as I
am not aware about it and has no knowledge and idea thereof;

4. That I did not sign any document/instrument more specifically said “AGRREMENT” and
“SUBDIVISION PLAN”, hereto attached copy as ANNEX “B” & ANNEX C and made an integral
part hereof; or even give permission to ROSALIE FONTILLAS to request for Survey.

5. That these documents of FRAUD and the illegal sell of ROSALIE A. FONTILLAS to RAUL
TAMBILAWAN and ANNA LOUISE TAMBILAWAN has caused us in huge trouble, damage,
devastation and I cannot enter, cultivate, use and position since the forceful entry and cutting of
COCONUT TREES of RAUL TAMBILAWAN in November 18, 2018.

6. That in order to protect my share from the property of HEIRS OF PEDRO FONTILLAS, I do hereby
request the Honorable Office concerned DENR-CENR to cancel and deny said application for
PRE-PATENT purposes against RAUL M. TAMBILAWAN, Forester III; DAVE MARI A MENOR,
Geodetic Engineer II; EVER LOUIE S. POGOSA, Land Management Inspector (All of City
Environmental and Natural Resources, Office – Baganga, Davao Oriental;

7. That I am executing this Affidavit to attest to the truth of the foregoing and to deny categorically and
specifically under oath that I warrant, affirm, undertake and confirm that above stipulation is true
and correct as far as my personal knowledge is concerned under the penalty of perjury;
