Dear Sir.
RE: Demand for Indemnification of KSh. 25,162/- owed to
Isaac Kibe Wangari -Our Client.
The above captioned matter refers. We have instructions from our client to address you as
hereunder:-
a) That on or about 15.11.2018 you applied for a loan facility of KShs. 215,000/- from
UNISON SACCO and requested our client to stand as your surety to guarantee the said
loan which was advanced to you. Facts and particulars are well within your knowledge,
information and understanding.
b) That you defaulted in the loan repayment and our client’s shares valued at KSh.25,162/-
were deducted to offset the loan. Facts and particulars are well within your knowledge,
information and understanding.
c) That despite numerous demands from our client to indemnify him the aforesaid sum of
Ksh. KSh.25,162/- , you have adamantly neglected, failed and or refused to do so.
d) Be advised that our client as a guarantor has the right of subrogation, indemnification
and reimbursement which rights are recognized under the law and enforceable against
yourself as a debtor.

ACCORDINGLY our instructions are to demand from you, which we HEREBY DO that you
indemnify our a client the aforesaid sum of KShs. 25,162/- being the principle amounts
deducted from our client’s shares; and to reimburse a sum of KShs. 3,000/- being the cost of
making this demand and an additional KShs. 2,500/- being our debt collecting charge all
totalling KShs. 30,662/- within the next FOURTEEN (14) days from the date herein.

TAKE NOTICE that if the said sum of KShs. 30,662/- is not paid to our chambers within the said
FOURTEEN (14) days, our peremptory and irrevocable instructions are to take such further
steps in this matter as may be necessary, including the institution of legal proceedings against
yourself for the recovery of the sum demanded, at all times holding you liable for the costs
thereby incurred and other consequences ensuing therefrom, without any further
communication to you whatsoever.

We trust that this will not be necessary and look forward to hearing from you within the
aforementioned time.
