MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Memorandum of Agreement is made and entered into by and between:

ROBEE CAMILLE EPHAN DESABELLE, Nurse 1, Provincial Health Office, a regular

employee of the Provincial Government of Davao del Sur, hereinafter referred to as the “FIRST
PARTY”.

and
THE PROVINCIAL GOVERNMENT OF DAVAO DEL SUR, with postal address at
the Provincial Capital Compound, Brgy. Matti, Digos City, Davao del Sur represented by
HON. MARC DOUGLAS IV C. CAGAS, Governor, hereinafter referred to as the
“SECOND PARTY”.

WITNESSETH:

WHEREAS, the FIRST PARTY wanted to avail of Study Leave, a privilege granted
by the Civil Service Commission pursuant to Section 68 of the CSC Memorandum
Circular No. 14, s. 1999 as amended by CSC Memorandum Circular No. 21, s. 2004;

WHEREAS, a study leave is a time-off from work not exceeding six (6) months with
pay for qualified officials and employees to help them prepare for their Bar or board
examinations or complete their master’s degree. For completion of master’s degree, the
study leave shall not exceed four (4) months. The leave shall be covered by a contract
between the agency head or authorized representative and the employee concerned;

WHEREAS, the FIRST PARTY will be taking the February 2022 Bar Examination
for his professional advancement;

WHEREAS, the FIRST PARTY has already manifested to the SECOND PARTY his
intent to avail of the said privilege, to which, the latter has signified his approval;

NOW, THEREFORE, for and in consideration of the foregoing premises, the FIRST
PARTY and SECOND PARTY do hereby agree and stipulate on the following:

1. That the FIRST PARTY shall enjoy a six (6) months study leave starting on May
02, 2021;

2. That the FIRST PARTY shall not resign from employment within six (6) months
following the grant of the study leave to be counted from the first day of his scheduled
leave;

3. That the failure of the FIRST PARTY to abide by the preceding paragraph will
oblige him to pay in sum of money, as a form of refund, the number of days of her leave
of absence with pay to the SECOND PARTY in accordance with the computation
provided under the Civil Service Laws, Rules and Regulations;

4. That in the event the FIRST PARTY is unable to continue the six (6) months
study leave privilege, she shall be obliged to pay in sum of money, still as a refund, the
number of days of his leave of absence with pay to the SECOND PARTY in accordance
with the computation provided under the Civil Service Laws, Rules and Regulations.

This agreement shall take effect on May 2021 and shall continue until the six months
period shall have expired.

IN WITNESS WHEREOF, the parties have hereunto signed this MEMORANDUM

OF AGREEMENT this _____ day of _____________ at the Provincial Capitol, Brgy.

BEFORE ME, a Notary Public, this _____ day of _________, at Digos City,
Philippines, personally appeared the parties with their competent proofs of identities
as above indicated, personally known to me to be the same persons who executed
that foregoing instrument and they acknowledged that the execution of the same is
their free act and deed.

This instrument refers to a Memorandum of Agreement consisting of two (2)

pages including the page on which the acknowlegment is written. The parties have
signed on each and every page of this instrument.
