RESOLUTION

This case was originally referred to this office for the conduct of inquest proceedings. She did
not submit her counter-affidavit despite having been subpoenaed to file one. The uncontroverted facts
are as follows:

Julita G. Manuel, a 65 years old married Filipino and a resident of Bantay, Solana, Cagayan after
having been duty sworn to in accordance with the law do hereby depose and state that:

She has six (6) children I her first nuptial and one (1) in the second nuptial. Her second child
named Roger G. Manuel got married to Rose Marie Caccam of Basi Solana, Cagayan. They got five (5)
children namely: Robin, Ricky, Raiger, Rachel, Rowel and Randy all surnamed Manuel.

Sometime in the year 2016, her daughter in-law Rose Marie C. Manuel went abroad (Bahrain) to
work as Domestic Helper up to this time leaving her five (5) minor children in the custody of her son
Roger, who is a farmer and a laborer and are living at Bantay, Solana, Cagayan.

Her daughter in-law Rose Marie seldom sends money to her family but with their help, her son
Roger was able to send all his children to school.

Sometime on April 2019, the ordeal of her son, Roger started when his five (5) children were
invited by their uncle Cholo Caccam, the brother of his wife, Rose Marie, to attend the birthday party of
their cousin in Basi, Solana, Cagayan. Her son Roger, accompanied his five (5) children to Basi, Solana,
Cagayan but he immediately returned home leaving his five (5) children to his brother-in-law Cholo
Caccam thinking that his children would just take their vacation to their mother’s relative.

When he went back to Basi, Solana, Cagayan to take his children, his brother-in-law prevented
him to take his children and said that this was the order of his wife.

 When enrollment came in the year 2020, her son Roger went to fetch again his children but his
brother-in-law Cholo Caccam prevented the children to go home to their father Roger and ordered the
latter’s children to go inside their house every time he was there to fetch them.

On October 6, 2020, they went to accompany her son Roger to the MSWDO of Solana, Cagayan
for a confrontation with Cholo Caccam regarding the custody of his children. The MSWDO of Solana said
that while Rose Marie C. Manuel is in Bahrain, the children will stay in the custody of their father Roger
Manuel. Attached hereto is the amicable settlement marked as Annex “A”.

After the confrontation in the DSWD of Solana, Cagayan, her daughter-in-law Rose Marie
Caccam Manuel AKA “RHEA KOUR RIPUT” in Facebook started to post in Social Media a very defamatory
remarks against her and her family, to wit, “Shout out iti in ani lakay mi nga mangilablabelab. nga mapan
manin iti kakabsat ku ti sweldok,!! Awan bibiang yo nu pappapanan ti kwartak.. nagabrodak uray pisu
awan pulus intulong ta anak mu kanyak..awan nk tuy nu saan nga gapu iti kakabsat ku…agyaman nak
kuma kenka ta konsern kan kada Gita anak Ku, saan nga pada iddi halus bugawim sikami!!..iddi awan
dagita ubbing issa sidung yo naragsak ka knu eh..tatta imintres kan tik unam..suportahak isuda pweeee…
Aglabelab ka latta…dois ti kumuyug kanyam.” Attached are the photocopies of the screenshot marked as
Annex “B” and Annex “C”. Even Cholo Caccam posted defamatory remarks in his Facebook account on
October 25, 2021, to wit, “kahit kalian nakakasura yang biyanan mong basura nay an. Konti na lang
itatagal sa mundo hindi pa gumawa na lang ng Mabuti.” (See Annex “D”).

Cholo Caccam posted another defamatory remark against her to wit, ”yo talaga nga makapesti
yo familya yo atawam pareparehu da mukat kwartu. Lalo yo pesti kanyan nga babakat juling nge.
Bessang la yo attolay na kanyo utun lusat ngin mari peba mangwa kang nakasta. Gagange mukat kwartu
da pe mgammin yan.” (See Annex “F”).

The said defamatory remarks ruined the reputation of her family particularly the herein
complainant who is now a senior citizen and their allegations were not true. In fact, they are the ones
helping her husband and children in their daily needs since she seldom sent them financial support. The
said defamatory remarks were even read and seen by her children, her relatives here and abroad and
even her barangay mates. Said remarks was even sent by her niece Vangilis Zinampan who is working
abroad thru messenger to her daughter Angelina Pacion.

That she is executing this affidavit to attest to the truth and veracity of the foregoing facts;

She understood the contents of it after it was read and translated to her in Ilocano and Tagalog, the
dialect she was familiar with and for the purpose of filling a case against Rose Marie Caccam Manuel and
her brother Cholo Caccam for Violation of RA 10175 (Cyber Crime Prevention Act of 2012).

Meanwhile, the complainant/s and the respondents in the above-captioned case, agrees to
settle their dispute as follows;

The custody of the 3rd and 5th children was ordered to the father, Roger temporarily provided
that he will be assessed and monitored by DSWD (Ginet). That he will provide the needs of their
children, Rose will send assistance to her daughter, Racquel for their school needs only. That Roger will
pick-up the modules of his children here in, Roger promised that he will change for his children, and that
Roger was warned that if he commits any form of abuse towards his children, the DSWD officer will take
necessary action.

The parties bind their selves to comply honestly and faithfully with the above terms of
settlement entered into 6th day of October 2021.
