Sub: Resurvey- ROR- Joint Pattas being registered in one name- Tahsildars to
invoke the ANDHRA PRADESH SPLITTING UP OF JOINT PATTAS ACT 1965 and
split joint pattas- instructions issued- regarding

The attention of the Collectors in the state is invited to the “ANDHRA


PRADESH SPLITTING UP OF JOINT PATTAS ACT 1965”. As per Section 3 of the Act,
“every Joint Patta granted to, or held by, Joint Pattadars immediately before
commencement of this Act, except granted to, or held by, a Joint Hindu Family,
shall be split up ..............”

1) Further the attention of Collectors in the state is invited to Rule 9(1)(a)


(iii) of Andhra Pradesh Record of Rights in Land and Pattadar Pass Books Rules,
1989 wherein it is mentioned that “............ Joint Pattas held by Hindu Joint Family
shall not be split unless the family request for it in writing.......”

A) The Collectors are instructed that keeping in view the above


provisions, in all cases of Joint Pattas, the Tahsildar shall take
immediate action to split the pattas and grant separate pattas duly
following the procedure envisaged in ANDHRA PRADESH SPLITTING UP
OF JOINT PATTAS ACT AND RULES 1965, unless it is a joint patta of a
Hindu Joint Family. In case of Hindu Joint Family the consent of the
Family is necessary for splitting up of the Joint Patta.

2) The Collectors are further informed that it is noticed that in the webland
in cases of Joint Pattas, PPB is issued in the name of the frst pattadar only. This
issue is resulting in legal problems leading to unnecessary civil dispute, as the
frst pattadar is many a time disposing the land without the knowledge of the
other pattadars.

A) The Collectors are instructed that all such Joint Patta cases where
PPB is issued in one of the pattadar’s name, shall be identifed and
action taken to issue a separate PPB in the name of all Joint Pattadars,
duly cancelling entries made in the passbook of the single pattadar.

B) The same position may be refected in the webland I-B, ie the land
with multiple pattadars may be assigned a diferent khata number and
NOT the khata number of any one of the joint pattadars. PD CMRO may
take necessary action to enable the same.

The Collectors are requested to adhere to the instructions diligently and


issue instructions to the Tahsildars to take up the Splitting up of Joint Pattas on
priority basis
