APPRENTICESHIP AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This contract made and executed by and between:

XXXX, of legal age, Filipino, and a registered/licensed architect with


postal address at XXXX hereafter referred to as the MENTOR;

-and-

XXXX, of legal age, Filipino, and with permanent address at XXXX,


hereafter referred to as the APPRENTICE;

-WITNESSETH-

WHEREAS, Section 13 (c), Article II of RA 9266, requires that candidate for


licensure examination in architecture must be a holder of a degree of Bachelor of
Science in Architecture conferred by a school, college, academy or institute duly
recognized and/or accredited by the Commission on Higher Education (CHED) and in
addition has a specific record of at least two (2) years or equivalent of diversified
architectural experience duly certified by a registered/licensed architect.

WHEREAS, the APPRENTICE is of legal age having been born on XXXX,


a holder of a degree of Bachelor of Science in Architecture conferred by a school,
college, academy or institute duly recognized and/or accredited by the Commission on
Higher Education (CHED) and agrees to train as ARCHITECT’S APPRENTICE
under this Apprenticeship Agreement;

WHEREAS, the MENTOR and APPRENTICE agree on the following terms


and conditions:

1. TERM:

The term of this Apprenticeship Agreement shall commence on XXXX and will end
on XXXX;

The aforesaid period is considered a probationary period of the apprentice;

2. PLACE OF WORK and TRAINING/APPRENTICESHIP:

The Apprentice shall train as an APPRENTICE of XXXX located at XXXX and/or


at any place the MENTOR have assigned the APPRENTICE to work at;
The Apprentice will be under the TRAINING/APPRENTICESHIP of a
REGISTERED/LICENSED ARCHITECT;

3. TIME OF TRAINING/APPRENTICESHIP:

The Apprentice agrees to work for eight (8) hours a day from Monday – Saturday.

The MENTOR reserves the right to require the APPRENTICE to train on different
days and/or different schedule to meet the increase or decrease in demand for the
products and services of the MENTOR’s Architectural Practice;

The Apprentice shall approximately undergo 960 hours of on-the-job training as well
as supplementary theoretical instruction during the TRAINING/APPRENTICESHIP.

The Field of Practice in which the apprentice shall be trained and the approximate
time to be spent on the job in each field are as follows:

4. COMPENSATION AND OTHER BENEFITS:

Under the Article 72. Apprentices Without Compensation, of the Department of


Labor and Employment – Bureau of Labor Relations, Title II
Training and Employment of Special Workers, Book Two - Human Resources
Development Program; the Secretary of Labor and Employment may authorize the
hiring of apprentices without compensation whose training on the job is required by
the school or training program curriculum or as requisite for graduation or board
examination.

However, in consideration of the services to be rendered by the APPRENTICE, the


MENTOR shall be giving the APPRENTICE, training/apprenticeship allowance as
follows:

a. Apprentice shall be given Php XXXX per day or equivalent to Php XXXX per
hour of training/apprenticeship;

b. Allowance shall be given every 16th and 1st day of the month, subject to
submission of Daily Accomplishment Log Sheet;

c. The “No Work No Pay Policy” shall apply.

d. In case of Overtime, the MENTOR shall pay an additional:

25% of the hourly rate for work performed in excess of 8 hours on ordinary
day.

30% of the hourly rate for work performed in excess of 8 hours on rest day,
special day or regular holiday.

6. ADHERENCE TO POLICIES.

The APPRENTICE undertakes to follow strictly all existing policies and code of
discipline of the MENTOR;

7. OWNERSHIP OF THE ARCHITECTURAL DOCUMENTS

All architectural documents, not limited to plans, designs, drawings,


specifications, reports and copies thereof, prepared and furnished by the Architect
in connection with the Architect’s Projects pursuant to this Agreement, are
instruments of professional service. As instruments of service they are the
intellectual property of the Architect whether the work for which they are made
may be executed or not, and are not to be reproduced or used on other work
except by written agreement with the Architect. This is in pursuance with the
pertinent provisions of Republic Act (R.A.) No. 9266, promulgated on March
17, 2004, effective 10 April 2004, and of R.A. No. 8293, otherwise known as
the "Intellectual Property Code of the Philippines" approved in 1997.

8. RESIGNATION

In case of resignation by the APPRENTICE, he/she is required to notify the


MENTOR in writing, of her intention to resign at least THIRTY (30) days prior to
the intended date of resignation. Failure to comply with the 30-day notice
requirement shall entitle the MENTOR to liquidated damages in the amount of
not less than Php 10,000.00;

9. TERMINATION

The MENTOR reserves the right to terminate this agreement even before the
expiration of this contract under the following conditions:

a) For just causes and authorized causes under the provisions of the Labor Code
and
b) For failure to comply with the existing policies and code of discipline of the
MENTOR;
c) the APPRENTICE violates the terms and conditions of this agreement.

10. SERVICE OF NOTICE:

All written notices to the parties shall preferably be by personal service but in the
event that personal service cannot be complied with or there is refusal to accept the
written notice, such notice shall be sent by registered mail to the address of the
parties indicated in this contract unless a written notice of change of address has been
served by the parties. The notice sent by registered mail to said address shall be
sufficient and is deemed the actual notice to the parties within 3 days from mailing
thereof.
