HELD ON AUGUST 14, 2019 IN LIEU OF AUGUST 13, 2019, 9:00 A.M., WEDNESDAY,

CITY RESOLUTION NO. 158-08-2019

A RESOLUTION APPROVING THE MEMORANDUM OF AGREEMENT VVITH VARIOUS


INSTITUTIONS/BUSINESS ESTABLISHMENTS FOR THE PREPOSITIONING OF GOODS,
RESOURCES, SERVICES, RELIEF AND RECOVERY BEFORE, DURING AND AFTER
DISASTERS, CALAMITIES, EPIDEMICS OR EMERGENCIES AND GRANTING
AUTHORITY TO THE CITY MAYOR, HON. ATTY. JEFFERSON P. SORIANO, OFFICER IN
CHARGE/ACTING LOCAL CHIEF EXECUTIVE OR THE DULY AUTHORIZED
REPRESENTATIVE TO SIGN THE SAID MEMORANDUM OF AGREEMENT

WHEREAS, Section 2, Paragraphs (L) and (P) of Republic Act No. 10121 state that "it is the
policy of the State to recognize and strengthen the capabilities of LGUs and communities in mitigating and
preparing for, responding to and recovering from the impacts of disasters" and "to provide maximum care,
assistance and services to individuals and families affected by disasters, and facilitate resumption of nonnal
social and economic activities," respectively;

WHEREAS, Republic Act No. 10121 mandated all local government units, through the Local
Disaster Risk Reduction and Management Councils, to respond to and manage the adverse effects of
emergencies and carry out recovery activities in the affected area, ensuring that there is an efficient
mechanism for immediate delivery of food, shelter and medical supplies, and to manage casualties like the
dead and the missing;

WHEREAS, Section 53.2 of the 2016 Revised Implementing Rules and Regulations of Republic
Act No. 9184, otherwise known as Government Procurement Reform Act states that "In case of imminent
danger to lift or property during a state of calamity, or when time is of the essence arising from natural or
man-made calamities or other causes where imniediate action is necessary to prevent damage to or loss of
lift or property, or to restore vital public services, infrastructure facilities and other public utilities. In the
case of Infrastructure Projects, the Procuring Entity has the option to undertake the project through
negotiated procurement or by administration";

WHEREAS, there is a need to foster partnership with various institutions/business establishments


to facilitate quick response and relief before, during and after disasters, calamities, epidemics or
em.ergencies;

WHEREAS, the City Government shall be represented by the City Mayor, Hon. Atty. Jefferson P.
Soriano or whoever is the Officer in Charge/Acting Local Chief Executive or the duly authorized
representative.

NOW, THEREFORE, RESOLVE, as it is hereby RESOLVED, to approve the Memorandum of


Agreement with various institutions/business establishments for the immediate prepositioning of goods,
resources, services, relief and recovery before, during and after disasters, calamities, epidemics or
emergencies and to grant authority to the City Mayor, Hon. Atty. Jefferson P. Soriano, Officer in
Charge/Acting Local Chief Executive or the duly authorized representative to sign the said Memorandum
of Agreement.

RESOLVED FURTHER, that the Memorandum of Agreement shall be effective during the term
of office of the incumbent elected City Officials and, after which, shall be subject to a stakeholders' meeting
for renewal.

On motion of Hon. Raymund P. Guzman, without the presence of Hon. Maila Rosario T. Que who
asked pennission to leave early and without any objection, CITY RESOLUTION NO. 158-08-2019 was
APPROVED under suspended rules.
