JUDICIAL AFFIDAVIT
OF ANITA TARUC

This Judicial Affidavit was given by ANITA TARUC, of legal

age, widow, Filipino and a resident of Brgy. Kanapolo, Magsaysay,
Davao del Sur, Philippines. The witness answered the questions asked
of her fully conscious that she does so under oath and that she may
face criminal liability for any false testimony or perjury contained
therein.
This judicial Affidavit was supervised by ATTY. ANNA
MARGARITA A. RAZONABLE-MAMUAD, in Visayan dialect, a
dialect which private complainant knows and fully understands, at
the Law Office address, Unit 8, 2F, DASURBACO Bldg., Magsaysay-
Jacinto Sts., Zone III, Digos City, Davao del Sur. The questions
propounded were in Cebauno, while the answers given by ANITA
TARUC, were also in the Cebuano dialect and the corresponding
English translation of her testimony are respectively provided after
each question and answer of the witness.
The Judicial Affidavit will constitute and serve as her direct
testimony pursuant to Administrative Matter No. 12-8-8-SC
otherwise known as the “Judicial Affidavit Rule”.

PURPOSE: The testimony of the witness is being offered for the

following purposes:

 (A)To adopt the allegations and facts of her Counter-Affidavit as
her Direct Testimony in this Judicial Affidavit and Court;

(B)To corroborate the truthfulness of the allegations in the

Counter-Affidavit she executed, especially the fact that she
trusted Raymundo Punzalan as the one responsible for securing
the necessary permits with the Philippine Coconut Authority
before cutting the coconut trees;

The following is her sworn statement as inquired by the above-

mentioned counsel and its corresponding answers which the accused-
witness voluntarily gave during the Testimonial Examination,
including the exhibits appended thereto:

1. Q: Boluntaryo ba ang paghatag nimo karon sa imong gipanumpaang

saysay? (Is the taking of your sworn statement, voluntary?)

A: Oo, boluntaryo. (Yes, it is voluntary.)

2. Q: Kabalo ka ba na mag-atubang ka ug criminal na kaso o perjury

kung muhatag ka ug bakak na saysay? (Do you know that you
may face criminal liability for false testimony or perjury
for any false statement you will make herein?)

A: Kabalo ko attorney. (I know, attorney.)

3. Q: Unsa man nga inistoryahan ang gamiton nato niining pakighinabi

kanimo? (In what language do you want this interview be
made?)

A: Cebuano attorney. (Cebuano, attorney.)

4. Q: Boluntaryo ba nimo gihimo ug gipirmahan ang maong Affidavit?

(Did you voluntarily make and sign the said Affidavit?)

A: Oo, attorney. (Yes, attorney.)

5. Q: Nganong naakusahan man ka sa kaso nga illegal nga namutol og

kahoy? (Why did they file a case against you for illegal
cutting of trees?)

A: Ila akong gipasangilan nga namutol kuno ko ug kahoy nga lubi

ingon pa ni Aurora Deluao. (They alleged that I cut down

 coconut trees according to Aurora Deluao.)

6. Q: Unsa man gihimo nimo human ka gipasakahan og kaso ni Aurora

Deluao? (What did you do when Aurora Deluao filed a case
against you?)

A: Ako siya gitobag pinaagi sa pag pasa nako sa akong counter-

affidavit. (I answered her by filing my counter-affidavit)

7. Q: Naa koy ipakita nimo na dokumento nga gibuhat adtong

Desyembre 9, 2014, nakaila ba ka aning dokumentoha? (I am
showing to you a document executed on December 9, 2014,
do you recognize this document?)

A: Mao na siya akoang gipahimo nga Counter-Affidavit, Attorney.

(This is my Counter-Affidavit that I executed, Attorney.)

8. Q: Naay isa kapirma aning dokumentoha sa taas sa ngalan ni ANITA

TARUC, kinsa man ning pirma? (There’s a signature on top of
the name ANITA TARUC, whose signature is this?)

A: Akoa ni Attorney. (This is mine, Attorney.)

Counsel’s Manifestation and Marking: Your Honor, the

accused-witness identified and handed over the copy of her Counter-
Affidavit including her signature which was executed on December 9,
2014, may we request the said document attached to the records be
accordingly marked as our Exhibit “1”, the signature and the name
of Anita Taruc as Exhibit “1-A”, and the name and signature of the
subscribing officer as Exhibit “1-B”. May we pray also that said
Counter-Affidavit shall be made part of her direct testimony.

9. Q: Unsa man diay ang tinuod nga nahitabo? (What is really the
truth behind the incident?)

A: Ang tinuod man gud, Attorney, kanang yutaa gibayad sa utang sa

kanhing mag asawang Vicente Deluao ug Eufemia Deluao pinaagi sa
berbal nga kasabotan, nga ginikanan ni Aurora Deluao, katung tuig
1990. (The truth of the matter, Attorney, that land was
subject to oral dacion en pago from the late Sps. Vicente
Deluao ug Eufemia Deluao, the parents of Aurora Deluao,
in 1990.

10.Q: Paghatag anang yutaa sa imuha isip bayad sa utang, unsa man
imong naobserbaran sa yuta? (Upon delivery of the land as
substituted payment for the loan, what have you observed
on the land?)

A: Ang yuta kay wala kaayoy tanom nga manga ug lubi ug napuno sa
tag-as nga sagbot. (The land has a few mango and coconut
trees and the rest of the area was filled with tall grasses.)

11. Q: Unsa man imong gibuhat sa yuta human sa paghatag isip bayad sa
utang? (What did you do after the delivery of the land as
payment of the loan?)

A: Akong gipalimpyuhan, gitamnan ug saha sa lubi ug saha sa manga

ang maong yuta. (I commissioned the cleaning of the land,
and the planting of mango and coconut seedlings.)

12.Q: Sukad sa imong pag-angkon sa yuta gikan 1990 isip tag-iya, unsa
imong nabuhat sa maong yuta? (From the moment you take
possession of the land since 1990 as owner thereof, what
have you done to the said land?)

A: Sukad 1990 hangtud karun sobra byente (20) katuig, akoang

gipalambo ang maong yuta pinaagi sa pag uma ug pag tanom ug saha
sa mga lubi ug manga. (Since 1990 until now or over 20 years,
I have cultivated the land through farming and planting of
mango and coconut seedlings.)

13. Q: Nakaila ba ka aning tawhana sa ngalan nga Raymundo

Punzalan? (Do you know a person by the name Raymundo
Punzalan?)

A: Oo, Attorney. (Yes, Attorney)

14.Q: Nganong nakaila man ka ani niya? (Why do you know him?)

A: Nakaila ko niya kay ilado mana siya sa among barangay nga

mamutulay ug kahoy. (I knew him because he is known in our
barangay as lumberjack)

15.Q: Aduna bay higayon nga imu siyang gihangyo nga ipaputol ang
tanom nga lubi sa imong yuta? (Was there an instance that you
requested him to cut the coconut trees in your land?)

A: Oo, Attorney. Ako siyang gihanyo nga mamutol sa maong mga

lubi sa kondisyon nga iyang lihukan sa pagkuha og permit sa
pagpamutol diha sa Philippine Coconut Authority una siya magsugod

 sa pagpamutol sa maong mga lubi (Yes, Attorney. I requested
him to cut the coconut trees subject to the condition that
he will process in obtaining a permit to cut in the
Philippine Coconut Authority before he can start cutting
the coconut trees.)

16.Q: Ngano siya man imong gipili sugoon nga muputol sa imong mga
lubi? (Why did you choose him to cut your coconut trees?)

A: Siya akong gisugo kay nailhan naman na siya nga mamutolay og

kahoy unya ilado pud na siya nga siya napud ang nagalihok para sa
mga panginahanglon nga permits diha sa PCA una magsugod sa
pagpamutol og kahoy. (I chose him because he is a known
lumberjack and a known person who secures the
necessary permits from PCA before he can start cutting
trees.)

17.Q: Anaa baka sa imong lugar atong panahon nga gipamutol ni

Raymundo Punzalan imong mga lubi? (Where were you at the
place when Raymundo Punzalan cut your coconut trees?)

A: Wala, attorney. Wala ko niadto sa maong lugar kay nagsalig nako

ni Raymundo Punzalan nga aduna na siya’y sakto nga permits una
mamutol sa mga kahoy’ng lubi kay ingon pa niya, siya na bahala sa
tanan. (No, Attorney. I did not go to the said place because I
trusted Raymundo Punzalan that he already secured the
necessary permits to cut coconut trees because he said
that he will take care of everything.)

18.Q: Imo ba siyang gibayaran para mamutol sa lubi? (Did you pay
him to cut the coconut trees?)

A: Wala. Wala me nagsabot nga ako ang mubayad sa iyaha. Siya

dapat ang mubayad sa akao kay iya man paliton ang maong pinutol
(No. We did not agree that I will pay him for cutting the
coconut trees. He should be the one paying me because he
will buy the cut coconut trees.)

19.Q: Unsa diay inyong sabot ni Raymundo Punzalan? (What was

your agreement with Raymundo Punzalan?)

A: Nagsabot me nga paliton niya ang punaan sa lubi ug siya napud

ang muputol human makuha ang panginahanglanon nga permits
para makaputol sa mga lubi ug iya rakong bayran pagkahuman na
mahalin sa mga pinutol. (We have agreed that he will buy the
coconut trees and he will secure the necessary permits

 before cutting the coconut trees and by then he will pay
me after the coco lumbers were sold.)

20. Q: Aduna ka ba’y nadawat nga kwarta isip bayad sa mga lubi nga
iyang giputol? (Have you received money for the payment of
the cut coconut trees?)

A: Wala koy nadawat maskin sentavos gikan kang Raymundo

Punzalan isip bayad sa mga pinutol nga lubi. (I have not received
even a centavo from Raymundo Punzalan as payment for
the cut coconut trees.)

21.Q: Unsa ang nahitbo paghuman og putol ni Raymundo Punzalan sa

maong mga lubi? (What happened next after Raymundo
Punsalan cut down your coconut trees?)

A: Sa pagkahibalo nako nga nahuman na siya og putol sa mga lubi,

ako siyang gipangutana kong aduna na ba siyay saktong permits nga
nakuha una niya giputol ang maong mga lubi. (After I learned
that he is done cutting down the coconut trees, I asked him
if he has obtained the necessary permits before cutting
down the said coconut trees.)

22. Q: Unsa man iyang tubag sa imong pangutana? (What was his
answer to your question?)

A: Wala daw siya makakuha og permits para mamutol sa maong mga

lubi. (That he failed to secure permits to cut the said
coconut trees.)

23. Q: Imo ba siyang gisugo o nagbayad ka ba og mga tao aron dalahon

ang maong mga pinutol sa lain nga lugar? (Did you order or hire
people to transport the coco lumbers to another place?)

A: Wala, Attorney. Wala ko magsugo og wala pud koy gibayadan nga

tao para dalhon sa laing lugar ang maong mga pinutol kay among
sabot si Raymundo na ang bahala sa tanan og wala nako kabalo
unsaon niya ang mga lubi human niya maputol. (No, Attorney. I
did not order nor hire people to transport the coco lumber
to another place because my agreement with Raymundo
was that he will take care of everything and that I do not
know what will he do with the coco lumbers.)

24. Q: Aduna kapa bay lain nga ikasulti? (Do have something more
to say?)

 A: Wala na sa pagkakaron, Attorney. (No more for the moment,
attorney.)
