Fundamental Rights
Constitution is the fundamental law of the country. All laws inconsistent with this constitution
shall, to the extent of such consistency, be void. It was endorsed on sep 16, 2015 by the Constitution
assembly.
The following rights are regarded as the fundamental rights according to the Constitution of
Nepal, 2015, part 3 are:
2. Right to freedom
Everyone have freedom of opinion & expression, form unions & associations, move and
reside in any part of Nepal, practice any profession, carry on any trade & business in any part of
Nepal.
3. Right to equality
All citizens shall be equal for law. No discrimination shall be made on the basis of origin,
place, race, religion, sex, physical condition, marital status, economic condition, etc.
4. Right to communication
There shall not be any prior censorship of publications and broadcasting, or information
dissemination or printing of any news, editorial, article, feature or other reading material, or the
use of audio-visual material by any medium, including electronic publication broadcasting and
printing unless and until it is opposed to law.
No person shall be detained without being informed of the ground for such an arrest.
The person who is arrested shall have the right to consult a legal advisor of his/her choice and
be defended from the time of arrest.
No person shall be held under preventive detention unless there is sufficient ground to
believe that there exists an immediate threat to the sovereignty and territorial integrity of Nepal or
public peace and order.
28. Right of social securityPerson who are economically poor, physically incapacited and helpless
single women, person with physical impairment, children and the person who is living in
community shall have the right to get the social security.
29. Right of consumers
It’s the fundamental right of every citizen to get quality product & services and if they
are not getting as per the law they have right to be compensated.
