Fundamental Rights
Constitution is the fundamental law of the country. All laws inconsistent with this constitution
shall, to the extent of such consistency, be void. It was endorsed on sep 16, 2015 by the Constitution
assembly.

The following rights are regarded as the fundamental rights according to the Constitution of
Nepal, 2015, part 3 are:

1. Right to live with dignity


Every person shall have the right to live with dignity , no law shall be made to death
penalty to anyone.

2. Right to freedom
Everyone have freedom of opinion & expression, form unions & associations, move and
reside in any part of Nepal, practice any profession, carry on any trade & business in any part of
Nepal.

3. Right to equality
All citizens shall be equal for law. No discrimination shall be made on the basis of origin,
place, race, religion, sex, physical condition, marital status, economic condition, etc.

4. Right to communication

There shall not be any prior censorship of publications and broadcasting, or information
dissemination or printing of any news, editorial, article, feature or other reading material, or the
use of audio-visual material by any medium, including electronic publication broadcasting and
printing unless and until it is opposed to law.

5. Right relating to justice

No person shall be detained without being informed of the ground for such an arrest.
The person who is arrested shall have the right to consult a legal advisor of his/her choice and
be defended from the time of arrest.

6. Right of victim of crime


The victim of crime shall have the right to be informed about the investigation &
proceedings of the case regarding his/her victimization and right to rehabilitation and justice.

7. Right against torture


No person in detention shall be subject to physical or mental torture & treated in a
cruel, inhuman or degrading manner.
8. Right against preventive detention

No person shall be held under preventive detention unless there is sufficient ground to
believe that there exists an immediate threat to the sovereignty and territorial integrity of Nepal or
public peace and order.

9. Right against untouchability & discrimination


No person shall be treated with any kind of untouchability or discrimination in any place
on grounds of caste, ethnicity, origin, community, occupation or physical condition. They have
equal right to do any work at any place as other.

10. Right relating to property


Every citizen have right to acquire, sell, gain profit, utilize or dispose of own property.

11. Right to freedom of religion


Each person is free to process, practice & preserve their religion according to their faith
& have the right to manage & protect its religious places & religious trust in accordance to law.

12. Right to information


Every citizen have the right to seek information, except confidential to be maintained as
per law, on any matters of concern to her/him or public.

13. Right to privacy


Every citizen has right to keep privacy relating to relation to person, their residence,
property document, records, statistics and correspondence & their reputation.

14. Right against exploitation


Every person have shall have the right against exploitation. No person shall be subjected
to human trafficking or bonded labor, and such an act shall be punishable. Similarly exploitations
on the basis of religion, custom, tradition, culture are also punishable.

15. Right to clean environment


Every citizen shall have right to live in clean & healthy environment & victim of
environmental pollution & degradation shall have the right to be compensated by the polluted
as per the law.

16. Right relating to education


Every citizen shall have the right to get basic education, right to basic compulsory and
free basic education up to the secondary level.
17. Right to language and culture
Every person and community shall have the right to use their language, participate in
the cultural life of its community, preserve and promote its language, script, culture etc.

18. Right to employment


Every citizen have the right to employment, they have right to select employment.
There shall not be any discrimination in employment on the basis of gender, caste, language etc.

19. Right to labor


Laborer means a person who physically or mentally engages in work for employer for
remuneration. They have right to appropriate remuneration, facilities and contribution based
social security. They also have the right to form trade union, participate.

20. Right relating to health care


Every citizen shall have the right to seek basic health care services from the state and no
citizen shall be deprived of emergency health care. Every citizen shall have equal access to
health care, clean water and hygiene.

21. Right relating to food


Every citizen shall have right relating to food and be safe from being in danger of life
from the scarcity of food.

22. Right to housing


Each person shall have the right to appropriate housing. No one shall be evicted from
the housing owned by him/her except in accordance with law.

23. Rights of women


Every citizen shall have equal right relating to lineage without any gender
discriminations. There shall not be any physical, mental, sexual or psychological or any other
kind of violence against women, or any kind of operation based on religious, social and cultural
tradition.

24. Right of child


Each child shall have the right to get education, health care nutrition, appropriate
upbringing, sport, recreation and overall personality development from the society and state.
They shall not be engaged in factory, mines or any hazardous work.

25. Right of dalits


People from dalit community shall have right to participate in all agencies of state,
provisions of free education with scholarships. They have also right to use, preserve and develop
their traditional occupation, knowledge skill and technology.
26. Right of senior citizens
Every citizen shall have the right to get special protection and social security.

27. Right of social justice


Every person has right to get equal opportunity and facilities in the areas of education, -
health, housing, employment, food and social security.

28. Right of social securityPerson who are economically poor, physically incapacited and helpless
single women, person with physical impairment, children and the person who is living in
community shall have the right to get the social security.
29. Right of consumers
It’s the fundamental right of every citizen to get quality product & services and if they
are not getting as per the law they have right to be compensated.

30. Right against exile


No citizen shall be exiled.

31. Right to constitutional remedies

There shall be right to constitutional remedy in course of implementation of rights


granted in this part.
